THE CITT IS LIABLE FOR DAMAGES Canines of Allegheny City and of the whole State, in fact, may henceforth bay at the moon unmolested and laugh at the dog catcher and his net. They may make night hideous and have nothing more to fear than the gentle 2ephyrs or the soothing m liir of the passing bootjack. Allegheny's City So licitor has decided it unconstitutional to kill dogs. On the strength of this opinion Mayor Kennedv, of Allegheny, yesterday vetoed the oidinance providing for the licensing of dogs and the establishment of a pound. The ordinance was passed by both branches of Councils some time ago, and approved by Chief Murphy, of the Department of Pub lic Safety. "When it was given to Mayor Kennedy for his approval, he turned the matter over to the City Solicitor for his opinion. Mr. Elphinstone completed his opinion yesterday and on the strencth of it the or dinance was vetoed. Mr. Elpbinstone was of the opinion there was no legal right to kill unlicensed dogs. He says dogs are property and a city has no more right to kill them for non-payment of taxes than they would have to burn down a man's house for the same neglect I'ilNbnrg IVoplo Can Get Damages. From the beginning of time the dog has been a friend, comfoiter and protector of the human race. In our beautiful city theie ate thousands of such animals, and It is emi nently proper, therefore, that befoic a law is enacted pioiding lor the wholesale and ciuel destruction of canine, that tlio authority to enact aich legislation should be most clearly established. The ordinance cannot ho sustained upon any delegation ot police power gien to Councils m the charter of the city or in any other act ot Assembly. As we'&hall pres ently see, such legislation, even If it did ex ist, would bo unconstitutional. The ordinance fixe- a license lee and pro vides that auv dog found running at large without the license plate (uch plate being evidence that the fee has been paid) shall be impounded, and if its owner does not appear withmiS liouis and pay tnc tee and cost of the Impounding o the animal that it shall forthwith be destroyed. No Power to Kill Dogs. The charter of the city of Allegheny (Act of Apt ill, 1S70.) chapter 3, section 7, pro vides that the Councils shall have power "'to nrevent the running at large of dogs, and in juries or annoyances therefrom, and to au thorize the destruction ot tlio same when at large." It cannot be contended that the oi dinance tn question is sought to bo enacted in pursuance of this legi-lation, or that in any sense or to any extent it is warranted thereby. A dog is as much at large with a metal plate attached to his collar as a dog v ithout such an ornament. Unless indeed the license plate should be made heavy enough to prevent locomotion. Councils cannot in order to prevent a dog from running at large summarily kill him. Under sections. articlo 1, or the Constitution of IS74, no man can be depiivedof his lite, lib el t) or independence or property unless by the judgment of his peers or the law of tho land. It has always been held that there was sufficient pi opertv in a dog, registered or unregistered, on which to louud a civil action. It is true that unless registered they could not be the subject of larceny. .Liable for Every Canine Killed. This is the law to-day and I believe the city would be liable to the owner for the value of every dog destroyed under the ordinance in question. The Constitution pro vides that a man cannot bo deprived of his property without due process of law. It cannot bo contended that the dog catcher with his net. ambulance and drowning ap paratus constitutes the due process ot law. We have no more right to kill an unli censed dog because his permit to live, or rather Ins annual tax, has not been paid, than w e w ould have to destroy a merchant's goods because he had not paid his business tax. The penalty for the violation of an ordi nance providing for the taxing of dogs must lie sued for and collected as other like pen alties mi e recovered. The act of June 10, ril contains the same provisions as our cit ctiaiter, and is open to the sanio ob jections. The oidinance does not fix a uniform tax; the male dog is charged $L the female $2, and the ordinanco provides illegal destruction and confiscation of property.
