Among the most important of the opinions delivered by the Supreme Court to-day was one by Chief Justice Faxson regarding the incumbency of the present Superintendent of Public In struction, D. .1. "Waller, in which the judg ment of the lower court is reversed and 31'. "Waller is allowed to hold the office for the unexpired term of E. E. Higbee. This was a writ of quo warranto issued at the request of the Attorney General directed to D. J. "Waller, requiring him to show by what authority he claims to exercise the duties of Superintendent of Public Instruction of the Commonwealth. On the 1-hii of February, 1890, Governor Heaver appointed and commissioned D. J. "Waller, Jr., Superintendent of Public In struction, vice E. E. Higbee, deceased. In juiruar.cc of this appointment "Waller duly qualified enterad upon the performance of the duties ot the office, and has con tinued therein until this time. The Senate was not in session at the time of this appointment. The next session of the Senate began on the first Tuesday of January. 18fll, and on the (5th of the same monthlleaver, being ytill Governor, nominated Waller to tho Senate for confirmation to the ofllce for the term of four rears to date from the first day of March. 1S90. and on tho 20th day of the same month (January) tho Senate confirmed such nomination and appointment. Governor Beaver vent out of office Janu ary 20, 1S9L and Robert E. Pattison was on the same day duly inaugurated Governor. o commtsion was issued to Waller by Governor Pattison. "On the contrary, he ap pointed Z. X. Snyder to the office, which ap pointment t as rejected bv the Senate-Mav 2. ISM. On the dav after the Senate ad journed the Governor appointed and com missioned Snyder to the office for the full term of four years, notwithstanding his re jection by the Senate. The Court say: There are three tilings about which there is no dispute, viz.: There was a vacancy: the vacancy t. as filled by appointment. by the Governor, and the Gov ernor's appointee was appointed by the Senate. How long Is the respondent entitled to bold the office under his appointment and confirmation uy the Senate? Governor Beaver exercised his power, he filled the vacancy occasioned bv the death of Higbee. His appointee having been confirmed by the Senate, the respondent is in office by virtue or an appointment properly made uiider the Con-titutiou and laws of the State. The confirmation of the respondent bv the Sen ate necessarily extends his original appoint ment for the balance of the unexpired term. THE BB00KS LAW O.K. The question of oondtneii. which has troubled the lawyers since the discovery of the date of approval of tho amendment to the Brooks law, was settled by the Judge reading a well-prepared decision, in which he held that as the amendment speaks of the eighth section, and as the Brooks retail act is the onlvlianor law that has moro than three -ectlont,, it cannot be an amendment to any other law, and that the Court can correct errors when the same are merely clerical, and even in an act of Assembly n hen as it Is written it involves a manifest absurdity and the error is plain and obvious. Another sensational caso involving a Perkins dctec tivo has just been placed on the court docket here to be tried in the spring. Claude Per kins is defendant, while Miss Mollie 3Ieek, or East Palestine, is plaintiff. She had young Perkins arrested last December. Subsequently she declined to prosecute, but tho Township Trustees to-day carried the case into court. Tne girl alleges Perkins betrayed her while he was in East Palestine laving his lopes for young Canfield. Tho trial will likely again bnng up the Canfield case, as it is said the girl cither knons sometulng re garding it or has been the recipient of young Peikius' confidence. Diphtheria Always Worst in Tillages. New Castle, Jan. 4. Special. In Stone boro, Mercer county, members of 23 families ate don with diphtheria. From the very first the disease assumed a virulent form. Many deaths have already occurred. Physi cians here say that it is significant that the disease appears in its most terrible form only in villagrs, and argue that this proves the sanitary conditions must be unfavorable. That a verdict has been reached in tho trial of Mrs. Emma F. Koons by the Canton Belief Corps on charges of unbecoming conduct is acknowledged by those in authority, but what that verdict is cannot be surmised. Mrs. Belle Tcnney was very reticent, but said she expected the verdict and sentence to be back in time to be reported at tho meeting of the corps Wednesday night.
