TESTERDAT K THE -COUNTr COURTS In the Criminal Court yesterday W. C V. Johnston was. tried on a charge of larceny. The case "was an odd one, and raised a peculiar point. He shipped a trunk full of clothing from Braddock to Bankin station. "When the trunk arrived it was placed "on the platform, and in the absence of an agent Johnston, it was charged, had the trunk hauled away. He then claimed that it had been lost by the Baltimore and Ohio Bailroad Company and put in a bill for $200 The. company was about to pay the claim when their officer, It.. T. Shephard, discovered that Johnston had the trunk. An information for the larceny of the trunk was then made against Johnston. In charging the jury Judge Ewing said that it was a peculiar question. The trunk belonged to Johnston, but they might find hira guilty ot stealing the check. He cau tioned them to take into consideration what Johnston's intentions were when he took the trunk. If he did not then Intend to de fraud the company, and his claim wa an afterthought, he could not be convicted of larceny. lie referred to an old Fngllsh case of a similar nature. He a sued for larceny and the case referred to learned Judjres. Three took one iew and three another. In the present case Judge Ewing left the decision for the Jury. The jury, however, was not hindered by a legal technicality, and In a shoir time returned a lerdict of "guilty as indicted." Indictments Made by the Grand Jury. Gasney, John Laughran, attempted rapei Amelia Jones, keeping a disorderly house, Dudley JIalia, larceny by bailee; W. J. McXortori, embezzlement. How George Owrejr Got Free. George B Owrey, who was convicted Wednesday of bigamy and released from iail the same evening by mistake, was re turned to jail yesterday. Owrey's release had been caused by a clerical error made by Clerk Long, of the Criminal Court He had Rlanced at the w rong papers, and made out a release for Owiey instead of a commit ment. Controller Morrow's amendment to the ordinance tor a vote on increased city debt will 'be adopted. At the last meeting of Councils the ordinance was referTedback,1ov, the Finance Committee to correct some errors in wording. A nieejing of the cdm mittee was called for yesteday jafternoori, but lacked one of a quorum. "No official' action could be taken, but there va9 a gen eral discussion on tho idea, of the Controller to insert in the bill a clause designating the time and percentage on the bonds proposed to be issued. Chairman Magee aud Committeeman Keatinz both opposed the plan at-tirst. They claimed that these details were unnecessary at the time, and could be provided'for by ordinance after the people bad voted on the miln question of issuing the bonds. Con troller -Morrow agreed, that they would have to he embodied in an ordinance utter the vote, lint also held that they should be in-, sertcd in the original bill so that tho people would know just exactly what they are to otetor. After considerable discussion aU the members present agreed to support the amendment, and w hen the committee se cures a quorum there is little doubt of its passage. Tho amended portion of the ordi nance will then read as follow s: "That the question of increasing the bonded indebtedness, ofsaldoity of Pitts-i burgto an amount not cSceedinj $2,000,010 bv the issue of bonds bearing interest at a rate not exceeding 5 per cent per annum and maturing in not exceeding 10 vears from the date or the Issue thereof in 1KB, and to the redemption of which at maturity so much of the monejs as may be neces sary, collected under the so-called, cura tive legislation, shall be pledged, shall be submitted to the electors thereof at a spe cial election to be held on the 8th day of De cember, A. D. 1891, in the manner and upon the terms pro ided and prescribed in an act of Assembly of .the CommonwealtU of Penn sylvania, entitled "An act to regulate tho manner of increasing the indebtedness of municipalities, to provide for the redemp tion of the same, and to impose penalties for the illegal increase thereof,'.! appro ed the 20th day of April, A. D. 1871, and the var ious supplements thereto." After the meeting the Controller said:, "The clnusc relating to money collected un-' der curative legislation will enable me to deduct from the $2,000,000 worth of, bonds all the money that will lia e been collected un der the curative acts at tho time the bond issue is made. For instance, if $500,000 will have been collected under the curative acts by the time the binds are ready to issue I will only issue $1,500,000 or the bonds, and the'lndebtedness w ill only be increased that much."
