A DANCING SKELETON.
The Strings In the Love Divorce Case Tailed
Once More Mr. Lovo Insists That His
Wife Shouldn't Have the Two Children
He Denies Habitual Drunkenness.
Another chapter in the case of L. E. Love,
of AVilmordine, who has sued for a divorce
from his wife, was provided fortho Court
yesterday. Mr. Lovo tiled a replication to
the statements made by his wife in her
answer to his petition for a wait of habeas
corpus to secure possession of their threo
children. Ho stntes that Mrs. Love is not a
fit person to be entrusted with the care, con
trol and moral training of the children by
reason of her habits of vice, drunkenness
and profligacy. She has absented
herself from her houso and chil
dren, and two of them, Frank,
aged 4 years, and Florence, aged 2 years, ba e
wandered away from their home. Frank
has been found asleep in the park at 10 p. w
and Florence wns lost for some time and
found at tho railroad station.
On July St Frank was found asleep in a
machine shop, and the same evening his
mother was in East Liberty in company with
"Del" Stevens Sho wns uusnlted In charac
ter to have charge of the children, and was
wholly neglectful of them. Ho said further
that he had just cause tobelleve that she was
given to immoral practices, and is a person of
intemperato habits, profligate in lier ways
and given up to sin and shame. Ho said
that he had al waj s bocn a true, affectionate
and devoted husband. He has bountifully
provided his wife w .th the comforts of life;
furnished her with the best of clothes and
bedecked her in rich jewelry and fine dia-
iuonas. lie aia an lie coma, to maice ner mo
cnjo able and the home circle happy. There
was no disruptidn until her strango acts
were discot ered.
In the spring of ISflO knowledge came to
him of his wife's improper conduct. They
separated in March, 1W0, but wore reconciled
six months later. She, however, persisted
in steklng the company of men, and would
fearlessly meet Del" Stevens In the street,
at the railroad station and In secret places,
until he was forced to sue for a divorce.
Love further said: "That subsequent to
tho presentation of tho affiant's libel in
divorce the said M. D. Lo e has been seen on
the public streets, absenting herself from
her homo and children, and found in tho
diabolical company of hor wretched com
panion, Del' Ste ens, the co-respondent in
tho libel."
Love wns forced by hor conduct and a
sense of honor to leave her. He has still
provided his family with clothes, provisions
and two servants. He denies that he wns an
habitual drunkard. Ho don't deny that he
has taken intoxicating liquors, but ho uses
a sound discretion. He was only under tho
influence of liquor tvico onceaboutllyoars
ago at a banquet of the Elks' Fishing Club,
anil once after a horse trade five yenrsago.
In conclusion, he states that he will amply
provido lor his children, nnd asks to bo
given the custody of them.
BEFORE A HIGHER COURT.
Supreme Judges Will Be Asked to Decide
the High Street Case The Central
Traction Road May Buy the Property
to Save Farther Trouble.
George L Whitney, President of tho Cen
tral Traction road, stated positively last
night that the High street case would be
taken to the Supreme Court and fought to
the bitter end. He said that everything was
lett to the attorney of the company and he
did not know exactly how tho case n ould be
made.
Judge Ewing's decision that the Central
Traction Company must take all its tracks
off High street has created much discussion
from the tact that all the rapid transit lines
in the two cities arc liable to be caught up
the same way. Each one of them is
occupying streets as traction roads
that they do not possess as
passenger railways. It is thought that tho
matter will bo settled by the Central Trac
tion Company buying the right of way from
Messrs. Dean. Pollock, Rnfforty and others.
This cannot, however, be done until tho Su
preme Court has passed on the case, which
will take about two years. Nono of the
traction road officials, however, would
affirm the story that they intended to pur
chase une ot tnem said that in enso tney
were beaten in tho Supreme Court they

It was also reported that the property
owners would ask the court for an injunc
tion to stop the cars running on High street
until the case was settled in Supremo Courts
William J. Brennen, attorney for the prop
erty owners, says that it would probably be
useless ac thecourtwouldhold that tho relief
asked for by the property owners is not of
such a nature as to demand an immediato in

Largest Southside Death Hate Hecorded In
Many Tears.
Pittsburg's mortality for the week ending
July 25 show s a total of 138 deaths, or an an
nual death rate por LOOO of 2S C3, as compared
with 92 deaths during the corresponding
weekofltW. There were 34 deaths in the
old city, 46 In the East End, 9 at tho institu
tions and 17 on the Soutside. Tho South
side mortality was unusually large last
week, and the same number of deaths in
proportion to the total mortality of the
w holo city has not occurred on the South
side for years. Tho largest death rate is
usually in thoEast End, Dut this week" the
Southside was the larger. The deaths were
mostly those of infants and small children,
the majority of which occurred in the
Twenlj seventh ward. The portion of the
city in which the least number of deaths oc
cur is that oorderiug the Mouongahela river
and running back to Carson street from
South Eighth street to the Point bridge.

Been causing the majority of deaths. Last

3, heart troubles, 5: pneumonia, 5; premature
birth, 3; old age, 4; tumor, 1: gangrene, 2:
debility, 1; violent causes, 9. There wore 61
deaths of infants under 1 jcar of ago, 25 of
children between ages of 1 j ear and a years,
20 of persons betw cen ages of 5 j ears and SO
j cars, 24 of persons betw ecn ages of 30 years
and b0 years, 11 between ages of 60 years and
100 years Eightj -eight were natives of
Pittsburg, 5 of England, 6 of Germany, 12
of Ireland and 4 of Poland. Socially, 2S
were married and 9D were single. There
were 6 widow sand 3 widowers. There wero

A Peculiar Situation That Cannot Bo
Cleared Up for Awhile.

An Allegheny Alderman Complies With a
Demand Made Upon Him.
QUESTION EAISED AS TO AUTHORITY
A.townshIp is a quasi corporation that
comes about ng near to haying no govern
ment as it is possible to get, and, wero it not
for the elasticity of tho functions of somo
justices of tho peace, would go to tho demni
tiou bow -wows. But somo justices and, for
that matter, aldermen in the city also aic
equal to tho emergency. Somo of them
aro quite original in their methods, and care
little for forms of law so that tho ends of
justice be subserved, as witness what fol
lows: Until lately there was no such'offenso'in
tho townships of this State, as a general
thing, as "disorderly conduct." There was
talk of a law being passed at tho last session
of the Legislature extending the penalty
for the offense to townships, but no ono
seems to know whether it passed or not,
and the furnishing of the acts of Assembly
to those who execute tho law is getting to
be a matter that, like tho publication of the
national census, consumes much time.
IN DOUBT AS TO A LAW.
Consequently, most justices of the peace
do not know w hether there bo such law or
not, and lawyers aro no "better off, as they
have not received notice of what tho last
Legislature did. Like the census report, it
is supposed new laws will in time not be
published beforo the next session of tho
tody has adjourned, when some of them
may then be repealed.
Justico Welto, of Allegheny, has been
asked for a transcript of his docket in a case
whero the legal formality of making the
Commonwealth prosecutor in a criminal
case has been dispersed with. The defend
ant wants a certiorari not only on this
ground, but also on the ground that tho
offense charged occurred, if at all, in a dis
trict whore the chargo of disorderly conduct
will not Ho, unless it be held that the juris
diction of an alderman or justice of tho
peace is sufficiently elastic to reach over
the county in any imaginable case, or that
the act above referred to has been passed,
of w hieh it is said that there is at present no
evidence.

A. Kansas Man Who Stands Up Well for
His Own State.
Dr. S. J. Guy, son of William n. Guy, of
Coraopolis, is on a visit to his friend9. Dr.
Guy lives in Winfield, Cowley county, Kan
sas. He says that mortgages, instead of be
ing piled three or four doep m his section,
are not so plenty as in Pennsylvania, and
that the elasticity of tho people of Kansas
has enabled them to recover from tho de
pression caused by the collapse of a year or
tw o ago In the real estato boom.
Dr. Guy savs Winfield Is a very prosper
ous town of 7,000 inhabitants, w itn live rail
roads, public schools equal to any found
anywhere, a Methodist college with an aver
age attendance of 2 0 students, all the im
provements in the way of water and light
ing to be found any whci 0, and has a Chau
tauqua Assembly next in importance to the
parent body in Now York State, and. taking
all in all, is a town in a country not to be
sneered at by any in the Eastern States.
He also says that tho highest priced lectur
ers in the country lecture in Winfield, and
at full rates, and yet the associations em
ploying them are nevor left in tho lurch, the
people's taste in literary matter being suffi
cient to sell all the seats when a man worth
listening to talks.

of it must debouch there to get to the out
side world, for the roads aro harder to make
