QUEER CASE BKFORE JUDGE GRIPP. Two Lawyers Given a Good Chance to Jaw Each Other for Awhile. WHT A MAN SLUGGED HIS STEPMOTHER Miss Ada Hnber was given a hearing be fore Alderman Gripp yesterday on a charge of larceny. She was the nurse who at tended Father 1 G. Herman, the apostate priest, on his death bed. It is alleged he repented and left half ot his property to the newjtalian church. A previous will had been made, however, and under the instruc tion of tlie late priest Miss Huber had re tained fSO and two gold watches for the brother to whom the original will left all the property. The suit grew out of the re fusal of Miss Huber to turn over the pro perty to the persons who claimed to be the executors of Father Herman's will. The hearing in the case was opened by Attorney J. H. Wise, who cave a short his tory of the manner in which he, in company with James Annshiazza, had been appointed executors of the estate. Some correspond ence between the attorney and Miss Huber was produced. This was principally a re quest made by Attorney AVise to Miss Huber to return the goods which it was supposed she had in her possession. l"nn Among the Lawyers. Attorney "V. D. Moore, who represented Miss Huber, then began a cross-examination between himself and Attorney Wise, which became pretty livelv before they were through. Attorney Moore said that Miss Huber had placed the goods under his charge, and acting under an order of the Orphans' Court, and also advice of a brother of Herman's who resides at Borne, whom Mr. Moore rep resents, he gave Miss Huber a receipt for the goods and placed them with the Safe Deposit Company. Attorney Moore said still further that he had told Attorney "Wise of his connection with the case, and that he should have applied to him instead of to Miss Huber for the goods. Attorney "Wise would not admit that he had been informed of Attorney Moore's connection with the case. The result of this was some lively J taiK oetween the attorneys ana some very close questioning on the part of Attorney Moore. Mr. Moore then asked Mr. Wise it he had not shown him a receipt from the Safe Deposit Company and which he had read. Mr. Wise would not admit reading the receipt, but said that he had some con versation in regard to the case with Mr. Moore at one time, and that he was shown a paper in Mr. Moore's hands which was al leged to be the receipt spoken of, but he faid he was not inclined to believe Mr. Moore's statements. A heated discussion then continued until the Alderman induced both men to take their seats. Then Miss Huber was swon. Her testimony was about the same as that given by Attorney Moore, and was princi pally a corroboration of his statement. Miss Huber's testimonv ended the hearing, and Alderman Gripp reserved his decision in the case. TFhy He TOiipped His Stepmother. Fred Schmidt was sent to jail yesterday morning lor beating his stepmother, but be hind it hangs a novel story which was re lated by 'Alderman McKenna last night. The testimony in the case showed that a bad feeling had existed lor some time between Fred Schmidt and his stepmother, Mrs. Rosa Schmidt, in consequence of which the lormer does not live with his second mother. On Thursday night, after surrounding sev eral of the "enemy," he happened to pars Mrs. Schmidt's home on Liberty avenue. He noticed crepe on the door, and, with wisdom something short of that of Socrates. he reasoned that the black cloth hung there in lieu of his stepmother s departed spirit Being overjoyed at the discovery of the same, he at once sought the company of Monongahela i ye and some other kindred spirits. Mel lowed by this proceeding far enough to be come a good mourner, he returned to Mrs. Schmidt's home to investigate further. His stepmother met him at the door, and over come with disappointment, he administered a sound beating. Life for a time in the county jail is the sequel to the story. FANNIE U. "Warden TVriglit Endeavoring to Do Away "With Prison Stripes. A grade system is being introduced at the Western Penitentiary iu reference to a stvle of uniforms forthe convicts. Three different uniforms will be worn. The thirdj;rade, or the lowest will be a suit with very large stripes. The second will have smallstripes and in the first a plain gray uniform some what similar to those worn by letter carriers will be adopted. The prisoners will be classified according to their merits aud good standing. A prisoner who serves ior six months with a good record will be placed in the second class, ana if be continues the record for a year longer he will be classed in the first grade. Warden "Wright said the system was in vogue at the Huntingdou Ueformatory and that it inspired the prisoners there to main tain a good behavior. The same principle, he said, would hold good in the penitentiiry and serve as an encouragement to the men to rise to the highest grade. Many of the men, lie said, abhorred the large stripes and to win a neat, plain uniform would do anything in their power and, would submit willingly to the necessary discipline.
