Only 40 cases were heard in License Couit
yesterday. Judge Magee went into details
in every case to an unusual extent so that
the entire matter can be laid before Judge
White. There was but one breeze and that
came from Attorney McCtitcheou. He
claimed that an organization of Allegheny
liquor dealers bad been formed there with
the object of defeating certain other dealers
who are not members. Out of respect to the
memory of the late A. Jr. Watson, court
was adjourned earlier than usual.
At the opening of court the case of Theo
dore Huckestein was recalled. His bar
tender and wife denied the story told by the
Kiemhoflers except that the bartender
aoknowledced selling to the boy, who, he
ijvs, claimed to be 21 years old. The case
o' Emil Wey was also recalled and Mr.
AVey testified that no one had gotten liquor
there on election day. The case of James
E Dowlinz was also recalled. Several
minors were called who testified that they
fcTured drinks at the place. One said he
could get it anywhere, to which Judge
Magee replied:
"I guess you're right there."
Margaret Dora's case was also recalled,
and the same minors testified to having se
cured drinks there. Several neighbors were
i-illeu to testily as to the character of the
house.
The case of Hubert Campbell was recalled
to prove that he kept no restaurant. Albert
Hesser testified that at 12:20 yesterday he
was refuted a rae.il.

Too Much Uooxe Gets a Justice of the Peace
Into Trouble His Bondsman to Be
Indemnified Interesting Insurance Suit
Brier.
Judge Ewing yesterday handed down an
opinion in the matter of the petition for a
rule on D. J. Davis, Justice of the Peace of
West Elizabeth borough, to show cause why
ho should not give security to indemnify hi!
surety. The petition was filed by Enoch
Davis, the bondsman of 'Squire Davis.
Judge Ewing, in his opinion, said: "The testi
mony taken in this case shows that the re
spondent, D. J. Davis, has, by reason of habit
ual continued intemperance, become unfit to
attend to the duties of bis office as Jostles of
the Peace, and that he has thereby increased
the responsibility of his surety."
It was ordered that within 30 days the re
spondent give security to indemnify the estate
of Enoch Davis, his bondsman, in the sum of
1,500 for loss, damage or costs by reason of the
suretyship of tun said Enoch Davis for him for
the faitblul performance of bis duties as Jus
tice of the Peace. The 'Squire was directed to
pay the costs.

An argument was heard by Judge Hawkins,
of the Orphans' Court, yesterday, on excep
tions to the account ot the administrator ot the
estate of Mrs. Justlna Kappek She held an
insurance policy for $2,000 in the Knights and
Ladies of Honor.and in the policy named three
children as beneficiaries. In her will she
directs that all her insurance be divided among
her five children.
The administrator paid the insurance to
those named in the policy, and exceptions

of age, and was decreed to have been a lunatic
without lucid intervals since childhood.
Divorces were granted yesterday in the
cases ot George Glover against Jennie D.
Glover; Robert Wallace against Ann Wallace,
and Emma Deeds against George Deeds.
Is the suit of Ira Ii. Duncan against A. Over
holt A Co., to recover salary under an alleged
agreement, a verdict was given yesterday for
the defendants, and certifying to a balance of
6 cents in their favor.

William A. Sullivan yesterday entered
salt against the Pittsburg and Birmingham
Traction Company for $25,000 damages. The
plaintiff was a newsboy. He stated that on
January 30. 1S91, he got on car No. 23 to sell bis
papers, a privilege accorded to newsboys. The
conductor, E. G. Davis, however, kicked blm
off the car. He fell beneatb a passing wagon
and the wheels rolled oxer him. injuring him
severely.

Common Councils to Consider the Ordi
nance at a Special Sleeting To-Day
Mr. Carnegie Coming to Pittsburg The
Need of Ilaste Opinions on the Pro
posed Site.
Common Council will meet in special ses
sion this afternoon to consider the ordinance,
which has already passed Select Council,
giving the Carnegie Library Commission per
mission to erect buildings on the Forbes
street entrance to Scbenley Park. Some baste
in this connection is deemed advisable, as Mr.
Carnegie is to arrive hero on the 8th insr., when
he desires to see some definite action taken to
ward the erection of the library buildings.
James B. Scott says that as soon as the ordi
nance is passed and has the approval of the
Mayor he will call a meeting of the Library
Commission in order that the work may be
pushed to a conclusion. The Commission, be
bays, has been unable to make any plans, or, in
fact, do anything until the location was se
cured, as the plans will bave to be mado to suit
tbe ground.
"I am glad Mr. Carnegie is coming," said
A. F. Keating, "as it will give an Impetus to
tbe work on the library. I should like to see
the men hard at work to-morrow if it could be
managed so, I would not bo in tbe least sur
prised if Mr. Carnegie is coming here with a
new plan for the advancement of the library.
Perhaps be has fixed on a good site, which
escaped the commissioners."
Mayor Gourley advocates prompt action, and
favors locating the library wherever Mr. Car
negie desires, as the latter gentleman is footing
the bills.

All licenses not paid on or before tbe first
Monday in March, 1891. will be placed in tbe
hands of vehicle officer for collection, subject
to collection fee of SO cents on each license.
And all persons neglecting to pay on or before
first Monday in May, 1891, will be subject to a
penalty double the amount of the licenses, to be
recovered before tbe proper legal authority of
said city. The old metal plates of last year
must be returned at the time licenses are taken
ont, or 25 cents additional will be charged on
the license.
Rates of license: Each one-horse vehicle, 6;
each two-horse vehicle, $10; each four-horso
vehicle, J12; each four-horse hack, 15; omnl
busses and timber nheeli. drawn by two
horses, J10.
One extra dollar will be charged for each ad
ditional horse used in above specified vehicles.
