Another suit against the Duquesne Trac
tion Company by the Pittsburg Traction
Company was filed yesterday. It was in the
ihape of a bill in equity filed by the latter
company, lessee of the Central Transit Com
pany and the Pittsburg, Oakland and East
Liberty Passenger Bail way Company
against the Duquesne Traction Company,
lessee of the Howe Street Passenger Railway
Company.
It is stated that rights of way on Den
niston aTenue, from Fifth avenue to Penn
avenue, were owned by tho Central Transit
Company and the Fittsbnrg. Oakland and East
Uberty Railway Company, and they bad their
tracks on the street. Within the past few
weeks the city wanted to construct a sewer on
the streetand rcpave it, and notified tbe plain
tiffs tbat they would have to temporarily lift
their tracks. The tracks were lirted with the
distinct understanding that upon the comple
tion of the work tlie city would replace them.
Tbo work was finished some eeksago. and,
though the attention of the Chief of the De
partment of Public Works has been called to
the matter, no steps hare been taken to restore
tbe track.
Continuing, it is stated that the Howo Street
Railway Company claim a richr, under an or
dinance passed in February, 1S30. to lay tracks
and operate its line on Denniston avenue, be
tween the points named. The Duquesne Com
pany, lessee of the Howe Street Hallway, has
deposited rails on the gronnd and put up poles
for an electric railway. The Hovie street com.
pany. it is aliened, has no right to occupv tbe
street, and its attempt to do so is in violation
or the plaintiffs' rights. Tbe intention of the
Duquesne Company is to go on Denniston ave
nue immediately and construct Us line and ap
propnatc the right of way of the plaintiffa
The latter want to resume the use of their,
route on the street, but the defendants intend
and threaten to resist then lu the use of the
route aud tracks and tbe operation of their
line.
The Court is asked to necree that the defend
ants have uo rizhts on Denniston avenue, be
tween tbe points named, and to crant an in
junction, restraining; the defendants from lav
ing its tracks or interfering with the plaintiffs.

By Judge Stowe in the Criminal Court The
l'olico Cases.
In Criminal Court yesterday when Police Offi
cers Cross and Hanley were called for sentence,
reputable citizens came forward to testify to
tbe former's good character. The Judce with
held sentence for a week to give opportunity
for a motion for a new trial. Hanley paid the
costs, and sentence was suspended in his case.

Harry Hopp, same off cuse, 6 cents fine and

Andrew Swir.Scn, same offense, six months to
tbe workhouse: I. Billinger, criminal assault,
HO and costs: Walter liuriis, same offense, $10
and costs; Andrew McCune. nuisance, 6 ceuts
fine and costs; Ed. Devers. larceny, three
months to the workhouse: W. Waters, lar
ceny, six months to the workhouse; Fannie
Campbell, larceny, one year to tbe workhouse;
W. H. Wilkinson, carrying concealed weapons,

WAUTS THE PSOFITS DIVIDED.
A Bill in Equity riled Against a Bridge
Builder.
A bill in equity was filed yesterday by A. A.
Hutchinson against Gustar Licdenthal and
N. M. McDowell. It is stated that in 1853 Mc-'
Dowell obtained the contract for tbe erection
of the Seventh streetbridgeoverthe Allegheny
river. McDowell made an agreement with
Hutchinson, tbe plaintiff, whereby Hutchinson
was to furnish the money and McDowell carry
out the contract, each to receive one-half the
profits. The tw o then contracted w ith Linden
thai to furnish the material and do tbe actual
work of construction for 22b.32S. The agree
ment was that in case Lindenibal realized more
than 15,000 profits be would repay the excess
to McDowell and Hutchinson. Lindenthal
also agreed to submit to tbem a statement
showing all tbe expenditures, profits, etc
Tbe bridge was completed and Lindenthal
made more than 15,000, but be refused to give
anv statement or information. McDowell bas
refused to take ,pait in the legal proceeding,
and in consequence he was joined as a de

placed on record in the Recorder's office yes
terday. All the property of the firm, including
a planing mill in the Sixteenth ward, stable
and office on Forty-first street, and four
two-story dwellings on Atlantic avenne. is
assumed.
The execution filed against tho firm on Fri
day lor $30,000 was the prime cause of tbo
trouble.

WiUJ, a plumber of Coraopolls, against
Joseph Overy for $10,000 damages. The plain
tiff alleges tbat the defendant was the cause
or his arrest on the charge ot receiving stolen
goods, of which he was acquitted after being
20 days in jail.
