COURT SEWS OP 1ESTEEDAI IN BRIEF
The fate of Frank Grade, indicted for the
mnrder of his step-daughter on tbe 16th ot
last March, is now in the hands of the jury.
All dav yesterday the case was argued and
it was 6:30 last evening when Judge Magee
finished his charge to the jury. Attorney
Dicken opened the argument for the defense
and was followed by W. D. Moore, Esq.,
and between them three hours were con
sumed. The defense laid particular stress
on their plea of insanity and insisted on
an acquittal. District Attorney Johnston
made a masterly argument to the jury, coing
over every bit of the testimuny and explaining
it with the minutest detail. The expert testi
mony of Drs. Wiley, CIiesrown, McCord and
others was treated liehtly and. ttoe District
Attorney argued, could bear but little weight,
as none of them had seen the prisoner until
some time after the commission of the act.
Judge Mageeliegan hischargeatSo'clockand
finished it at 6.30. Ills, Honor conbned himself
strictly to the lams bearing on the case, paving
particular attention to explaining what a
reasonable donbt was. Expert testimony was
also taken up and his Honor stated that to a
certain extent it was good evidence but the
Jurv could take it with considerable allowance.
During the entire day theprisonersat silently
in his chair lookmg direcilv in front of him,
net er for a moment shifting his attitude or
changing the position of his eyes.
THE POOL-SELLING CASE.

dicted by Itir Grand Jury.
The hearing asked for on Monday by William
Yost, Esq.. for leave to produce evidence to
sustain his petition for the return to the grand
jury of the case against Frank Herdie, was
held before Jndge White, yesterday morning.
Mr. Herdie bad been charged with selling pools
at the Homewood races last July, Captain
Wishart being the prosecutor. Tbe grand jury
ignored tbe bill and placed tho costs on Mr.
Wishart. Mr. Yost petitioned the Court to
take them off. and also to return tbe case to the
grand jury. His evidence to show cause for
his plea Le produced in tha persons of Police
man White. George FlsherandBruceCnnning
ham, tocetber witb pool tickets sold by Herdie
White and Fisher did not buy tickets, hut saw
tbem sola. Cunningham had bought them.
Mr. Yost said these three had given the same
testimouj before the grand jury, and other
witnesses had been excused. He offered to pro
duce them. Jndge White said that was enough.
William Hunter, Esq., for Mr. Herdlc said
there was not a bit of evidence to hold Herdie,
but Jndge White said there had been plenty,
ana enough to warrant the grand jnry in find
ing a true bill. He took the papers a'nd prom
ised ac early decision.
A BOXED UP CASE.
Questionable Who Renllr Did Use tbe Knife
nt Picnic.
In the Criminal Court, yesterday, a stir was
created by Judge White. William Ambrose
had been on trial for aggravated assault and
battery on John Thnrroff, the result ot a row
at a picnic at Butcher's Grove last June. At
tho trial several witnesses testified that it as
Ambrose who struck Thurroff, while others
testified that it was John Hartman. Hartmaa
was placed on tbe stand, but declined to say
wbetber or not he had hitThu:roff. Judge
White ordered him to give $1,000 bail for bis
appearance on the charge of assaulting Thnr
roff. The jury in the case returned a verdict
of not guilty and placed half the costs on the
prosecutor. Judge White became indignant
and ordered the verdict set aside as to tbe pros
ecutor. He then directed the County Detec
tive to enter information against Hartman for
aggravated assault and battery and agaiust
Ambrose. John Hemmidfsh and John itetiman.

County Detective Beltiboover went before
Alderman Reilly and lodged the informations.
Hartman and Ambrose gave bail for a bearing
and warrants were issued for the others.

The American Wire Company Sue tbe
Cblcnco Cotnpnnv on a Contract.
Tbe American Wire Company yesterday filed
a statement in their suit agamst the Chicago
Wire and Spring Company. They stated that
tbe defendant agreed to purchase from them
1,000 tons of soft fence wire rods, at ?50 per ton.
They shipped them the rods as per contract,
and they received and paid for the first ship
ments, amounting to 304.29J pounds. Tbe bal
ance. 1,935,710. the defendants refused to take.
Aa a consequence, the were obliged to sell the
rods where they could elsewhere.
They did not realize within JS.016 35 of the
contract price with the defendants, and now
sue to recover that amount trom them.

against Susan Devlin and Michael Ran for
larceny. The following bills were ignored:

assault and battery. '

Michael McGeart was convicted of as
sault on J. Kennedy.

THE suit of Samuel Bing against C. L. Wll
ley. an action on a contract, is on trial before

A divorce was granted yesterday in the case
of Jotin A. Bennett against Emma Bennett.

lam Shanaban, an action on an account, a ver

George Taylor pleaded guilty to the lar
ceny of a dog and collar, aud was sentenced by

The suit of John Meyer against the Birm
ingham and Brownsville Turnnike Company,
an action for damage to property caused by the
obstruction of a drain, is on trial.

Catharine Flinn against the Allegheny Heat
ing Company, for damages for injuries caused
by a natural gas explosion, a verdict was given
vesterdav for tbe plaintiffs in the sums of $75,

The Fidelity Title and Trnst Company, as
assignee of the Lawrence Bank, yesterday ob
tained the permission ot tbe Court to sell at
public sale the bank building at the corner ot
Penn avenue and Butler street which was ap
praised at 520,000.
The suit of, George W. Parker and John
Potts against the steamer Acme was argued
before Judge Acbeson in the United States
Court yesterday. The defendants claim the
United States Courts have no jurisdiction in
tbe case as the boat is a ferry-bofA in the
Beaver river, which is not navigable. Decision
was reserved.

spent her childhood, and the youug bud,
was just bursting into womanhood when
Bodhidharma, a missionary, became enam
ored of her and proposed to take her to
China. He promised to show his lover to
the world and introduce her to many
people.
To China Bodhidhanna carried hg treas
ure. Thea was introduced to the Emperor
and his nobles, and flourished in her new
borne. Thea was blessed with many chil
dren, aud one of these was introduced to
Mivoye and taken to his home in Southern
China. Another daughter came under the
notice of a noble named Lo Yo, and was
taken by him in captivity to his borne in
NorthernChina. Aud so this family grew
and multiplied until there were so many of
the genus Thea Sinensis in China that a tax
was levied on each subject having commer
cial relations with them it being hoped by
this means to stamp out the whole tribe, root
and branch.
Bnt this strange family multiplied so rap
idly and gained such favor at court that ere
long there was hardly a person in the East
who did not know of the Thea Sinensis fam
ily, and all good subjects to this day wor
ship this Thea each morning the first thing
uu arising.

people have at present much knowledge.

ters in The Dispatch. It is earnestly

bias, and the object will have been accom
plished if the reader is interested and
amused, and, incidentally, has or her at
tention called to the author. The second
