Trjins to Show that (he Prisoner Sane and Also Yiclous. Was ACTION OP THE VARIOUS COUETS The trial of Frank Grade for the killing of his stepdaughter in March last was re sinned before Judge Macee yesterday. Herman Grade, a brother of the defendant, testified to having visited his brother's honse the day prior to the killing, and found his brother standing in the middle of the floor staring at something and would not speak. The witness testified that Graae and his wife did not get along well together. John Steinmender was a partner of the de fendant seven years, and noticed signs of a failing tnind as long ago as last February. 'Squire "William Buff", of the Eleventh ward, Allegheny, says defendant looked wild the morning before the killing. Louis Wetzel, Al bert Grade and Henry Pliaul testified that they had never known the defendant to treat the dead child different from the other chil dren. John Phillips tcsufied as to the charac ter the prisoner,which closed the testimony for the defense. The prosecution opened with Dr. e. b. Ward bum. the Alleghenj City physician, on the stand. Ho interviewed the prisoner tn jail, and says he was sharp enough to keep his month shut. He did not think Grade had the first symptom of insanity. A number of the prisoner's old neighbors testified that they bad never noticed anv insane actions. Mrs. Kate Lintncr testified that she lived in the same house with the defendant for several months, and knew Grade to strike bis wife frequentlv The dead child cried at this, and Grade did not like the little one. She further said that the prisoner threatened to kill her whole familv. This closed the testimony. District Attornev Johnson offered the court record of the trial of Grade for insanity in July last, when he was declared sane, but the Court ruled it out. The arguments to the jury will be made to-day. DECIDED FOB THE EAUBOAD The Master Pnj the Company Hnd a Right Prior to "llr. Chambers'. Thomas Hemott, Esq , yesterday filed bis re port as master in the case of James A. Chambers against the Baltimore and Ohio Railroad Com pany, operating the Pittsburg and Connells ville Railroad. The suit is a dispute over a Y" track on Chambers' property at McKees port. In 1S69 Michaels, Roeblicg A Co. con structed a glass factory at that point, and at their request the railroad built the Y." Br agreement it uasto boused jointly between the parties. Michaels. Roehling Co. cvent nallj failed, and in course of time Chambers became the owner of the property In the meantime the Y" was used considerable, the rmlrojd company turning their engines and trains by means of it. Last March Chambers notified the company to rcroov the track from bis property. Tncy neglected to do so and he tore it up. The company started to relay it and Chambers filed a lull in court asking for an injunction. The railroad filed a cross bill and the case was reterred to a master. The master in his report holds that itls now too late for Chambers to disavow the agreement af ler taking advantage for so many years of its provisions benefiting him. and further, the railroad could have condemned the propertv and paid the damages assessed to the original owner, the propertv being necessary to them lor the operation of their road. In conclusion be recommended the dismissal of Chambers' bilL THE PAWNBROKERS INDICTED. Work of the Grand Jury Yesterday and the True BUN Found. The grand jury yesterday returned true bills against X. DeRoy, Emanuel DeRoy, Leo Weil, Isaac Gelder and K. Wilkowskv, the pawn brokers arrested Saturday charged with receiving stolen goods. True bills were also returned against William A. A PECULIAR WILL CASE William V, Scott Appenls From the Pro bate of n Letter. "William W. Scott yesterday filed an appeal from the probate of the mil of his father, the late John Scott, President of the Allegheny Valley Railroad. Mr. Scott died March 24, 1889. leaving a wife and ten children. His will was dated March 16, 1SS9, and divided his estate among his children, some getting more than others. John F. Scott and William Stewart were the executors of the wilL William -cott in his appeal alleges that the document probated was not the last will and testament of his father. He asks that the pro bate be set aide and that the letters issued to tbe executors be revoked. The document probated was a letter written to John Dalzell, Esq , by Mr. S;ott, containing directions for the disposal of his property to be embodied in a will to be prepared for Mr Srott's signature. Before the will could be made in duo form Mr. Scott died, and the let ter, which was signed by him. was presented as a testamentary document for probate. Its standing as such is the point at issue raised by the appeal. KO PAEK ON THE "WHAEF. A Motion for n New Trial Rcfased by Jndse Collier. Judge Collier has rcfased the motion for a new trial prayed lor by E. M. BIgelow in the suit brought against him bv Beesei Thorn who objected to Mr. Bigelow's mode or im proving the wharf into a park. A verdict had been given for the plaintiffs, who alleged that Mr. Bigelow. George Eagan, Michael Eagan and George L. Peabodj, the latter being in the street department, were damaging their facih. ties for shipping by the building of a wall along the Allegbenj river front. K A new trial was asked for on the ground that thecasowasnot properly tried and that the evidence was not .-ufficieut to warrant the ver dict.
