Threatening skies and a humid atmos
phere could not crush the spirits of the 1,500
good fellows who went out to Homewood
yesterday afternoon to witness the events of
the third day of the Grand Circuit meeting.
The track was muddy and slippery, and the
monotony of the'yellowEoil and the gray sky,
while it was broken, was not relieved by the
bright hues of the Stars and Stripes flutter
ing from the flagstaff, or the cheerful strains
of the Great "Western Band.
Nevertheless, everyone was happy, while
anxious that the sport should go on. The
countenances of the association officials were
closelv scanned, but their features showed
nothing but a moody thoughtfulness that
iwas not encouraging. The track was being
smoothed off, and two or three trotters,
driven by dyspeptic-looking individuals,
were slowly moving around the circle.
Herdic leaned over his auction stand and
conversed cheerfully with friends, the fact
that he would have no pools to sell not
worrying him in the least. He realized that
for one Jar he could give his nimble tongue
a rest, and would not have to furnish bail
for pool-selling before he ate his breakfast in
the morning.
HAD SOME FUN.
Mayor Gourley, of Pittsburg, and Mayor
"Wjrman, of Allegheny, were at the track;
the former because he is fond
of horses, anyway, and the latter
to see his former property, Kinsman, pace
in the 223 race. Among the others present
were "W. D. Porter, Esq., ex-District At
torney; City Solicitor Elphinstone, Cnief
Murphy and Health Officer Bradley, and
Councilman William Bader, ot Allegheny.
In fact, it appeared to be Allegheny's dav.
"Well, we've got to have some fun, any
way races or no races," said one man to
another, and the sentiment was quickly
taken up and passed around.. This may
have acted as an incentive to Detective
Fitzgerald and Inspector "Wnitehouse, as
tbey immediately challenged each other to a
mile race on mustangs. Inspector Wnite
house owned one of the animals, with a wicked
eye, the backbone of a snake and a bay coat.
A gray mustang, owner unknown, was tied to
a fence, and Fitzgerald mounted it and rode
out on the track, closely followed by White
house EiDrNG to vrrx.
They started on even terms, Fitzgerald keep
ing well on the gray's neck to keep him from
rearing, while Wnitehouse sat well back, so
that in case of his horse bucking ho might be
able to get a hold before be passed over its
ears.
Bay and gray ran side by side to the quarter,
and at the half both were whipping. A man
who had a stop watch said the half was done in
1:0 bnt later confessed that his watch was
ont of repair and could not be relied upon to
a minute. At the three-quarters the bay led,
the Inspector taking his seat amidships on the
animal's back, and thereby securing a more
oven keel. Fitzgerald was pushing the gray,
which was throning up clods of mud until the
horizon had the appearance of hammered
brass.
The racers wheeled together into the stretch
Etde by side and made a brilliant race to the
wire. The band left McGinty at the bottom of
the sea and joined the throng that rushed to
the fence. Excited Individuals with fat pocket
books offered "8 to 5 on the bay, bucking
barred," which was accepted by men whose
countenances were crevassed by emotion as

A TEBRIBLE STRAIN.
On they came. Strong men held their breath,
hlrh was in itself a test of strength in many
cases; small boys yelled, and Officer Crossan, the
embodiment of calm snaTity, nnbent for once,
and cheered the riders. At the last furlong both
horses were coming under the whip, the bay a I
win, and fearlessly kept his horse from falling
down by taking a firm cinch around its neck.
The Inspector had no time to get a bold on the
bay, so simply used the whip in the hope
that the animal would the sooner run down.
Just as the horses reached the wire the bay,
which had apparently been there before,
etretched its neck and thrust out its tongue,
winning by Scinches. Several hundred dollars
changed hands on the race.
Just about this time President Kerr an
nounced that the races were off for the dav, the
track being so heavy that the drivers refused
to bring ont their horses. The races would be
run to-day (Friday) regardless of the weather.
Then the crowd prepared to go borne, but a
pay crowd who wanted action for their money
determined to have one more event before they
went. They got together eight or nine boys
and entered them in a 60-yara dash. The son
of Driver Pridmore was at once made a fa
vorite against the field, and sustained his
backers' judgment by winning handily. Several
hundred dollars were staked on the result.
Then everybody went home, but none ap
peared to regret that they had gone out.
After Herdlc'a Scnlp.
Thomas R. Kerr, President of the Homewood
Driving Park, gave bail yesterday In ISOO each
for Frank Herdic, bamuel English, and Harry
Johnson. They will have a hearing to-day on
a charge of pool-selling.

An Attempt to Clenr.a Murderer on the Flea

Slott Slnnd Trial.
An inquest as to the sanity of Frank
Gerade was held in the Criminal Court yes
terday betore Judges Collier and Slagle.
On March 15 Gerade murdered his 9-year-old
stepdaughter at his home on Shady
Lane, Allegheny. He grasped her by the
legs and dashed her .brains out against the
side of a cradle standing in the room. Mrs.
Gerado ran from the house and told the
neighbors of the occurrence. When the police
arrived tbey found the body of the child on the
floor and Gerade in the cellar, with a butcher
knirein his hands. He was overpowered and
placed under arrest. His trial was fixed for
yesterday, but when he was arraigned his at
torney. J. C. Dlcken, made a special plea. He
claimed that Gerade is now insane and incapa
ble of making a defense, and asked that a jury
be impaneled to inquire into his sanity. A
Jury was obtained, and the inquisition com
menced. Dr. Cbessrown, Jail physician, was the first
witness called. He stated that he bad seen
Gerade every day, in jail, for the last four
months. From his actions and appearance, he
thought be was insane. At times be would not
cat, and wonld not wear hit shoes. Dr.McCord
testified that he had examined Gerade once,
and from his conduct thought him insane. He
had only been with him 20 minutes. Jailers
Marshall. Price and Irwin gave it as their
opinion that Gerode was insane. When bewas
bronght to jail he looked as if he had been on a
sproe. He has refnsed to talk to them, and for
a time recused to eat or take his daily exercise.
Dr. Wyliu was placed on the stand lor the
Srosecution. Ho was formerly a physician at
lixmont. He said he would not be able to say
a man was insane, after but a SO-minutes' ex
amination, and It was often hard to distinguish
between real and pretended insanity. Dr.
J. Guy McCandless gave similar testimony.
District Attorney Johnston maintained that
Gerade was sane, and that because a man re
fused to cat or wear his shoes occasionally, un
der the circumstances, did not make him a
lunatic Attorney Dicken argued from the
testimony, etc., that Gerade was insane, and
asked the jury to so find.
Judge Slagle charged the jury briefly, saying
that they were only to find whether or not
Gerade was now insane, not if he was so at the
time ot the crime. If Insane he would probably
be sent to an asylum, and wonld not be tried
until, if he ever did, he recovered his sanity.
The jury was out but a brief time, and returned
a verdict to the effect that they found Gerade
to be sane. Gerade was remanded to jail, and
his trial for murder fixed for next Thursday.
SAVED CONSIDERABLE TIME.
A Ulan Accused of Receiving Stolen Goods
Pima's Guilty.
The case of Philip Bpealer, charged with re
ceiving stolen goods, was put on trial before
Judge Collier yesterday afternoon. Spealer's
wife and daughter were convicted two weeks
ago for stealing a lot of goods from Porter t
Donalson. Judge Collier is anxious to have
this case finished, and ordered a night session,
so that the case could be ended.
When court reconvened in the evening, the
case had proceeded but a short time when
Bpealer was placed on the stand and pleaded
guilty. He was remanded to jail for sentence
and court adjourned.
Must Pay the Costs.
Judge Achcson, in the United States District
Court, yesterday refused to open a case fur ar
gument on the question of costs. The case was
that of some deckhands of the steamboat Twi
light, who refused to pull out ashes and were
discharged from the boat. The deckhands de
manded pay for the entire trip, but the court
onlv allowed them wages for the time they ac
tually worked. The costs in the case were as
sessed against the libelants, and they protested
that the costs should be placed on the defend.

Wants $5,000 Tor a Broken Leg.
Alexander Cantley filed a suit yesterday
against William H. Barnes, receiver of the
Allegheny Valley Railroad, for 5,000 damages.
Mr. Can tier alleges that on the 15th of last
March he was working at Shoenbergor's mill
loading pig iron on a car. There was a plank
leading from the gronnd to the car, and, while
walking up this plank the train was moved, al
though the trainmen bad been notified not to
move the train as the car was not loaded, and
the plain tin 'a leg was broken at the leit ankle.

Notes From the Courts.
The jury in the case of John Urocken,
charged with assault on Bessie Bryan, was yes
terday discharged, having been unable to agree.
Thabiah Ackermajt and George Altwater
were placed on trial before Jndge Slagle yes
terday for burglary. The case is still on.
The Fourth National Bank of New York,
yesterday, entered suit against J. F. Sadler A
Co.. to recover 5,000 on a promissory note given
in 1851.
Roger Hartley, yesterday, entered a snit
in ejectment against William P. Marshall, to
obtain possession of a lot in the Fourth ward,
Allegheny, the title to which, he claims, is
vested in him and not in Marshall.

Each proposal must be accompanied by a
bond, with two sureties, probated before the
Mayor or City Clerk.
The Department of Awards reserves the right

Section 1 Be lt oraained and enacted by the
city of Pittsburg, in Select and Common Coun
cils assembled, and it is hereby ordained and
enacted by the authority of the same. That
the Chief of the Department of Public
Works be and is hereby authorized and
directed to cause to be surveyed and opened
within 60 days from the date of the passage of
this ordinance, Lebanon street from Sterling
street to a point 40 feet west of Barry street, at
a width of 40 feet, in accordance with a plan
on file In the Department of Public Works,
known as John H. Page's plan of Knoll lotB.re
cordedin the Recorder's ofilce ot Allegheny
county In plan book, vol 3, page 76, and plan of
partition of tbo estate of Caroline Ormsby. de
ceased, at No. 1, September term, 1879, Or
phan's Court of Allegheny county. The dam
ages caused thereby and thebenefits to pay the
same to be assessed and collected in accord
ance with the provisions of an act of Assem
bly of the Commonwealth of Pennsylvania, en
titled "An act relating to streets and sewers
in cities of the second class," approved the
18th day of May, A. D. 1889.
Section 2 That any ordinance or part of or
dinance conflicting with the prorisions of this
ordinance be and. the same is hereby repealed
bo far as the same affects this ordinance.

erty abutting upon Brownell, avenue, in the
plan of Irwin place. Twentieth ward,as laid out
by Xhomas H. Cbapman, do hereby set apart
and dedicate to public use forever said Brown
ell avenue, and we do hereby waive any and all
claims tor damages that might come to ns by
roason of the appropriating of the property for
street purposes, and hereby authorize the
proper officers of the city to take possession of
said street as other streets that have been
formally opened by law.

A JOINT RESOLUTION GIVING TO THE
Western Pennsylvania Exposition Society
the right and privilege to bore for oil or gas
npon tbe premises covered by their lease from
the city of Pittsburg, and to have and to use for
its own pnrpose the product of any such boring
or well.
Whereas, Tho city of Pittsburg, by ordinanco
duly passed and approved, leased to tho West
ern Pennsylvania Exposition Society certain
property npon Duquesne way for the purpose
of an Exposition; and
Whereas, Under said leaso tho said society
has erected large and costly improvements, in
curring thereby heavy indebtedness; and
Whereas, The said society is largely sup
ported bv voluntary contrlbntions of the citi
zens of this city, and all money arising there
from or tbrougb any source is applied to the
general good of tbe public; and
Whereas. It is to tbe interest of said city'to
promote the general prosperity of tbo Exposi
tion and to encourage tbe general exhibit of all
branches of domestic industry and trade, and
to seenre such dcvclpment of our resources as
will add to the general welfare; and
Whereas. The said society designs at Its com
ing annual exhibition to display tho entire
work, labor and machinery used in the drilling
of oil and gas wills, that all visitors theroto
may become familiar with the process thereof;
and
Whereas, It may be that on the prosecution
of such work, oil or gas may be discovered or
developed; and
Whereas, As this work is to be done at tbe
expense of said society, and no legal right Is
given under said lease to said society either to
0 such work or retain oil, or gas if found;
therefore, be it
Resolved, By the Select and Common Coun
cils of said city that the Western Pennsylvania
Exposition Society shall have and is hereby
given permission to bore or drill upon and
within tbe ground enclosed by its lease for oil
and gas and other substance, and that should
the same be found and secured, the said Expo
sition Society shall and may have and use tbe
same for its own pnrpose without any cost,
claim or demand from said city; provided,
however, that this privilege or license is
granted upon condition that all information
of any interest relating to the geological forma
tion and other matters discovered in the proc
ess of such work or drilling, shall be furnished
by said society officially to said city as soon as
the same may become known.
