To Talk About Parents who Send Their
Children to Public Schools.
A QUEEI POE THE EXAMINING BOARD
The semi-annual convention of all the
Catholic priests of the 'Western Pittsburg
diocese will be held to-day at the Episcopal
residence on Grant street After the con
ference, a meeting of the clergy interested
in the Pittsburg Priests' Mutual Aid
Society will be held, and a permanent or
ganization formed. About 50 or GO priests
will be present at the meeting. The East
ern conference will be held at Altoona, on
Thursday, and -Rill be attended by the
priests at the eastern end of the diocese.
At the conference to be held in the Epis
copal residence to-dav, a number of impor
tant matters pertaining to the diocese will
come up for discussion. Among them will
be several cases of parents sending their
children to the public schools. Some priests
now refuse to give absolution to parents at
confession lor refusing to take their chil
dren from the public schools and send them
to the parochial schools. Many are the
reasons given for the action, and in some
cases there seems to be a special reason for
allowing the children to continue their
studies at the ward schools.
ONE OF THE BEASONS.
Some time ago one of the Pittsburg priests
had a case where a young Catholic girl was
preparing herself to become a teacher in a
public school. The priest had a rnle on the
matter, and at first refused to give the girl's
mother absolution. The circumstances of the
case were snch, however, that he waived
the rule and absolvea the parents. The
case came up so frequently of late in different
churches that some of the priests want to hear
what the conference has to say abont it. It is
likely that some general Iae about the matter
will be adopted.
Kev. Father F. L. Tobin, pastor of St. Mary's
Church, Lawrence ville, will be master of the
conference. Another matter likely to come tip
will be a discussion about the whereabouts of
the synod, appointed several years ago to regu
late parochial school matter.'. At the conned
of Baltimore, it was recommended that an ex
amining board to be composed of members of
the clergy, be appointed in each diocese, for
the purpose of examining parochial school
teachers. In certain sections of the country a
claim has been made by parents who refused
to send their children to the parochial schools,
that the youngsters had received all the in
structions the nnns conld give them, ana they
thought it necessary to send the children to
schools where the teachers take npthe higher
branches.
ABE 2TOT PBOFICIEXT.
If was also claimed in this city that some of
the Sisters did not possess the same standard
of proficiency in teaching that teachers in
public schools did. To prevent this claim from
arising again, it was decided to create an ex
amining board, and before a nnn conld teach
in a parochial school, she would have to pass
an examination before the board and secure a
certificate. Like the public school teachers, if
.they could not pass the required examination
and make a certain percentage, ihev could not
got a certificate to teach. The Pittsburg Synod
was appointed, but no one can be tounofwho
knows what became of it.
After the discussions at the conference are
ended the meetine of the Priests' Mutual Aid
, Society will be held. The Committee on Con
stitution and By-Laws will make its report, and
the latter will be adopted. The object of the
society is to assist needy priests, and when any
; of the clergy are sick they will be paid a certain
sum of money each week.
The examination of priests who have not

be held this year on November 11, 12 and 13.
The "retreat" will be held in July.

terday on the question relating to the dis
tribution of funds of the estate of the lateJI.
"W. Beltzhoover, who diea in 1879. The
trustees, "William A. Caldwell, James J.
Sonnell and John G. Holmes, asked direc
tions as to whether they could pay the sev
eral annuities of the legatees if the income
from the estate did not warrant it, and
especially the annuity bequeathed to Mel-
chlor S. Beltzhoover, the adopted son of the
testator. To bim had been left $3,000 a year
until be became 2L $5,000 a year until he be
came 25, and $7,000 a year until ba became 50

until such time as he chose to ask for what haa
been left him absolutely.
Judge Over, after citing the fact that
Melchior S. Beltzhoover was the principal
object of bounty says: The annual payments
tbe executors are directed to make to him
arise from the income of the residuary estate,
which vests in him absolutely when be becomes
SOyearsof ace. These are' not annuities, but
an absolute appropriation of that much of
income io mm, ana it is not reasonable to sup
pose that it was intended it should betaken
from tbe collateral inheritance tax on the
corpus of the estate. It alone is subject to
tax and cannot be deducted from these pay
ments. There is no apparent reason why the
general rnle imposing tbe burden of collateral
inheritance tax on annuities by legacies should
not apply to the annuity given bv the testator.
It must be deducted from them."

The Grand Jury Comes to the Conclusion
That McKcIvey Was Right.
The grand jury yesterday returned a true
bill against John Clark, of the Southside,
charged by Inspector McKelveywith selling
liquor without a license and on Sunday. Tbe
bill was ignored on Friday, but upon the matter
being presented to Judge Collier, and the state
ment made that five witnesses bad testified be
fore the grand jury to having bought and
drank beer and whisky in Clark's place, the
ease was returned to the grand jury for fur
ther consideration. Yesterday the case was
taken up sgain. and, it was stated, exactly the
same witnesses and testimony heard. This
time a true bill was returned.
The other true bills returned were: Thomas
Walters, James Walters, Henry Ruhe,
Humphrey Campbell, Aaion Mazerskv, assault
and battery: F. K. Bankert, assault: Dora
Wilde. Frank Gibson, larceny: Naunie Camp
bell, larceny from the person; Robert Agnew,
Harry Brown, W. Kraus, maintaining a nui
sance: Ann J. McMonacle, malicious mischief.
Tbe following bills were ignored: Henry Tur
ner, aggravated assault and battery; Hugh Alc
Lain, larceny and assault and battery: Maria
Devlin, selling liquor without a license and on
Sunday.

In the Criminal Court yesterday Elmore Dalzell
pleaded guilty to larceny of 12 quarts of orange
butter from W. H. Holmes. John Freeman
was convicted of a felonious attempt to enter
the store of John Patton. J. M. Carroll was
acquitted of tbe larceny of two pairs of pants
from Joseph Kobillnski. Mrs. Margaret Mur
phy was convicted of an offense acainst moral
ity with Walter Boyce. Ignatz Korelfski
pleaded guilty to assault and battervon M.
SatofskL He was sentenced sir months to tha
workhouse. Frank Lauer pleaded cmlty to as
sault and battery on John Smith while the two
were prisoners in the same cell in the Twenty
eighth ward station. Lauer was sentenced five
months to the workhouse. Charles Miller was
convicted of larceny. Nancy Planz pleaded
guilty to the larceny of a ring and $2 GO from
Caroline Becker.

Tho trial of tbe snit of TarbeU against the
Pennsylvania Railroad Company, was contin
ued yesterday before Judgo White- Robert
Fitcairn. Superintendent of the company,
showed the location of the railroad tracks. He
.defended the action of his subordinates who
acted under his instructions, in ordering the
two sections of the day express to stay at
the Conemaugh yards for the reason that It was
in his judgment tho only sate place they could
be placed. Washouts ahead and behind pre
vented the train being sentCelsewhere and it
was never thought the South Fork dam would
break.
He detailed all that had been done by the
company to prevent disaster, and thought they
could not have done better. He said the com
pany had objected to the constrnction of the
dam but their objections were unavailing; and
they adopted-the best means possible for the
construction of the tracks in the valley.

appointed appraisers yesterday of the effects OT

dock, a Roman Catholic congregation of Slavs.
An application for a charter was filed yester
day for the German Oak Singing Society, of
Harrison township. The object of the society
is the cultivation of music. The officers are :
President, August Roehner; librarian, Albert
Richter; trustees, F. Roehuer, Albivin Schulz
ana John Willi.
The testimony taken in tbe divorce case of
Mathias Barbus against Maggie Barbus was
filed yesterday. It was alleged that Mrs. Bar
bus, who was married in 1886. at the age of 18
years, left her husband a few weeks later and
returned home. Sometime afterward she went
to live with Peter Leuz.
The testimony In tho divorce case of Hattie
H. Grove against G. W. Grove was filed by tbe
Commissioner yesterday. The couple were
married by Alderman McKenna, in October,
1888, and separated in January of this year,
after numerous family quarrels, alleged to be
brought on by the husband's cruelty. General
cruelty and abuse is allege 1.
Judgb Acheson yesterday handed down
an opinion in the United States Court in the
case of N. J. Kellar and others against Henry
C. Stolsenbach for damages for the infringe
ment of a patent on a sand and gravel sepa
rator. As tbe Infringement had onlx lasted
about six months and was not characterized by
bad faith, the Court thought 1.000 damages
for the plaintiffs would be sufficient, and
awarded that amount. .
Judge Hawkins yesterday beard testimony
on the exceptions to the account of the execu
tors of the late Captain R. C. Gray. It was
claimed that the price at which the Gray's
Iron Line of steamboats was sold by the execu
tors was wholly inadequate and not near tbe
value of the property. Captain Sam Brown
and a number of other rivermen testified as to
tbe estimated value of different boats ot the
line. Major Brown appeared for the exceptant,
and D. T. Watson and G. P. Hamilton for the
executors.
Judge Over, of tbe Orphans' Court, yester
day handed down an opinion in the matter of
tbe distribution of the estate of tbe late Will
lam Carr. In his will Mr. Carr bequeathed
$20,000 to Harry R. Hilliard, tbe son of bis
wife by a former marriage, on condition tbat
his wife should accept the provisions of the
will and not elect to take under the intestate
laws. Mrs. Carr declined to accept under the
win ana elected to take under tbe intestate
lans. The question then arose as to the
widow's refusal to accept settinir aside the
legacy of Hilliard, The matter was anrued be-

House.
Section 1 Be it ordained and enacted by tbe
city of Pittsburg in Select and Common Coun
cils assembled, and it Is hereby ordained and
enacted by the authority of the same. That
tbe Chief of the Department of Pnblio Safety
is hereby authorized, empowered and directed
to forthwith purchase from John B. Jackson
for the use of tbe Fire Bureau of the city of
Pittsburg, all tbat certain lot or piece of
eround situate in the First ward of the city of
Pittsburg and adjoining No. 1 Engine House,
running parallel witb Fourth avenue 11 feet
and at right angle 13 feet 6 inches to line of old
building; thence 16 feet 6 inches to point of be
ginning. Section 2 That tbe price or sum to be paid
therefor shall not exceed 500.
Section 3 That any ordinance or part of
ordinance conflicting with the provisions of
this ordinance be, and tbe same is hereby re
pealed so far as the same affects this or
