The borough fathers haTC rotten into a
snarl and deadlock that is likely to result
in chaos if some compromise is not soon
reached, the necessity therefor being made
bulginglr evident on last Monday
evening, when the Sergeant at Arms
was unable to muster a quorum.
At there are so far no symptoms of a violent
uprising of the populace, there is no imme
diate danger of a necessity for calling out
the N". G. P., bnt some think there may De
before the end of summer.
The trouble has existed ever since the
spring election, but it was hoped that a way
out would be found. The path seems to
grow more dim as time flies. As near as
can be learned the borough Council is a tie
on everv important matter before it, and
when either side finds that its full strength
is not out, it absents itself, and Burgess Mc
Cabe is not given a chance to declare a
quorum present to do business.
ONE "WAT TO BBKAK A QUOETTM.
The leaders of the opposing forces are
Messrs. McDonald and Jolly. Last Mon
day night a proposition to declare all the
streets of the borough open was pending.
and it is said that when oue of the Jolly
party found that his presence would make a
quorum and allow the opposition to tri
umph, he dropped up, or rather left his post
ot observation on tbe outside, irora wbicb be
had been making memoranda. Consequent
ly the borough farmers are still able to raise
crops on ground exempt lrom taxation, ana
some people who own property on unopened
streets and want boardwalks made to it are
exasperated.
Some weeks ago, when the qncstions at
issue were at fever heat, Mr. McDonald re
ceived a telegram jnst as Council was about
convening, asking him to meet a party at
some hotel in this city. At first he thought
of taking a train and coming to the city,
but holding the telegram to his nostrils for
a moment, he thought he detected on it the
anna of a rodent. Accordingly, he tele
graphed the sender to await him, and be
would come on a late train. He did so,
and then found for certain that tbe telegram
was a decoy to keep him from the Council
meeting.
THE DODGE WOEES "WELL.
At a subsequent meeting tbe same dodge
was tried, and again without effect. Since
then the no-quorum dodge has been played
effectively.
Another bone of contention is the fact
that the borough has no legal helm. It is
said the Jolly party want Arch H. Bowand
for Solicitor, and the opposition are de
termined that be shall not be. Some say
the Burgess has power to break a tie, while
others say be has not, but each side is able
to prevent the putting of the question to
test by breaking a qnorum. It is said the
opposition candidate is not disposed to make
a strenuous effort, though willing to fill the
position if it can be had without the mud
smearing incident to a political row.
The necessity of getting down to work is
admitted on all hands, as tbe question of
finance is getting to be a serious one, and
extensive improvements are necessary if the
village is to prosper.

The bearing in the Carr-Pfeiffer election
contest before Commissioner John S. Bobb,
Jr., yesterday, came near being a failure
again. Mr. Bobb was on hand and so was
Judge Fetterman for Pfeiffer, but there was
a long wait for Mr. Brennen. As he was
known to have gone to Tarentum, or to some
other town up that way, it was feared he
might have fallen a victim to the fumes
emitted bv that stack at the Pennsylvania
Salt Works. After waiting uutil near 2
o'clock Mr. Carr agreed tbat the ballot
boxes might be identified and this part of
tbe work began.
Ko sooner had both sides cleared for action
than there was another hitch. Arthur
Evans, Judge of Election, identified a box
as the one that had been used in the Third
district. He said it hadnot been out of bis
possession since the February election.
Another box was then put in evidence, with
tbe expectation that Alderman Hartman
wonld identify it, but he said that, though
it bad been in bis office since that time, he
knew not for certain whence it came, or
whether it was the box wanted, and be
didn't appear to care whether it was or was
not tbe box. He said he did not see it
brought in.
After some time spent pow-wowing it was
mutually agreed that there could be no
issue regarding the state of the weather and
tbe meeting being held upstairs, the inter
vals between drinks were necessarily too
long to make investigation a success and an
adjournment was taken.
Henry Pfeiffer, Republican, got the seat,
and P. M. Ctrr, Democrat, contests, hold
ing tbat there were irregularities and that
Carr had the majority of the votes cast.
Commendable.
All claims not consistent with the high char
acter of Syrup of Figs are purposely avoided

The Opinion or Witnesses on tbe Johns
town Flood Dlasater.
The case of Tarbell against the Pennsyl
vania Railroad Company, to recover 550,
000 damages for the loss of his wife and
three children on the day express during
the Johnstown flood, was continued before
Judge White yesterday. At the opening
in the morning, the counsel for the defense
moved for a non-suit on the ground that
the plaintiff had lailed to produce evidence
of negligence on the part of the railroad
company; and on the ground that the flood
was of such extraordinary proportions that
it could neither be anticipated nor averted;
and that it wonld be folly to hold any
hnman agency responsible.
Judge White overruled the motion on
the ground that it would be best to hear
both sides of the case. In the afternoon
Vincent Wierman, H. W. Planner, F. M.
Geary, Simon Coursan, J. S. Keal, Dr.
Deverah and G. B. Stevenson were ex
amined for the defense, and testified to the
unlooked-for and unusual rise in the river
from tremendous rainfalls.

A Jnry Unable to Agree on One of Mc
Kelvey'a Speak-Easy Caaea.
In the Criminal Court yesterday Mike
Lydon pleaded guilty to sellingliquor with
out a license and on Sunday. Edward Burke
was convicted of the larceny of a watch
from Melinda Adams. The jury in the case
of Michael and Bridget Lafly, tried on the
charges of selling liquor without a license
and on Sunday, on information of Inspector
McKelvey, after having been out all night
reported that thev could not agree. They
were discharged, and the case held over for
another trial." Howard Gross, colored,
pleaded guilty to the larceny of a pocket
book from Mary Wall. He" was sentenced
nine months to the workhouse.
Thejuryisout in the case of Charles
Sterap, tried for the larceny of 5105 from
Fred Benbel. John Finucan pleaded
guilty to illegal liquor selling, and was sent
3 months and 20 davs to the workhouse.
Robert "Weider, a shoe dealer of McKees
port, is on trial on tbe charge of assault on
the 10-year-old daughter of John Heimin-sa-

tbo Unon Switch and Signal Company, for the
infringement of a patent. He objected to new
matter introduced in tbe cross bill, and said
tbat if it be eliminated he would allow the
cross bill to be filed.

Section 1 Be it ordained and enacted by tbe
city of Pittsburg. In Select and Common
Councils assembled, and it is hereby ordained
and enacted by tbe authority of tbe same
Tbat tbe Chief of tbe Department of Public
Works be and is hereby authorized and di
rected to advertise in accordance with the acts
of Assembly of the Commonwealth of Pennsyl
vania and tbe ordinances of tbe said city of
Pittsburg relating thereto and regulating tne
same, for proposals tor the construction of a
pipe sewer 15 inches in diameter on Aiken
avenue and Clay bourne street, commencing at
tbe north end of bridge over P. R. R.;

free libraries. ,
Whereas. Andrew Carnegie has generous
ly offered to the city of Pittsburg a gift ot free
libraries, as set forth in the following commu
nications: Pittsbubg. Pa, February 6, 1890.
To tbe Mayor and Councils of Pittsburg:
Gentlemen Some years ago I bad tbe
fdeasnre ot offering to expend npon a free
ibrary for the city ot Pittsburg the sum of
two hundred and fifty thousand dollars. The
finances of tbe city were not then in condition
to permit of its acceptance Having expended
more than tbat sum in our sister city of Alle
gheny, I subsequently intimated tbat I was
prepared lo expend not le3s tban half a million
ior ntisDurg; sucn, nowever, nas ueen me re
cent growth of the city, such are Its prospects
for the future, tbat careful consideration has
led me to the conclusion that, in order to pro
vide such libraries as Pittsburg shonld have
will require even a larger sum,
I think tbat Pittsburg requires a central
building containing a reference and circulat
ing library; also suitable accommodations for
works of art. which I believe its citizens would
soon provide; that there should also be added
rooms for tbe meeting of tbe various learned
societies of tbe city. The experience of New
York, Baltimore and otber large cities has
proved tbat a central library Should be supple
mented by branch libraries. Tbe Free Circu
lating Library, of New York, has now four of
these: the city of Baltimore has five! Tbeyare
not extensive structures, but each contains a
small supply of tho books most in demand and
a reading room, and is operated in connection
with tbe central library. Such branches, I
think, should bo established in the various dis
tricts of the city, probably one in Birmingham,
another in Teinperancevifle, anotber in East
Liberty, a fourth in Lawrenceville. perhaps a
fifth in tbo older part of the city. All of tbeso
sbonldbe thoroughly lire proof, monumental
in character and creditable to the city.
To provide these buildings with suitable
books, ete, I offer to expend not less tban
one million of dollars. 1 propose tbat their lo
cation, erection and management shall be en
trusted to a board of trustees, composed ex
officio of tbe Mayor; the Presidents of Select
and Common Councils, the President of the
Central Board of Education, and a library
committee oi ure -appointed oy tne councils,
sucb as you bave done me the honor to appoint
to confer with me. To these I would add the
names of 12 well-known citizens of Allegheny
county, who sbould have the power as a body
to provide for the re-election of its members at
stated times, and also to fill vacancies in their
number.
Tbe libraries to be formally banded over to
the city upon their completion, free from lien,
in trust for the purposes specified. The city to
agree to receive and support same at its own
proper cost, under tho management of tbe
trustees, as .ibive provided.
The city of Bill! more paj s $50,000 por annum
for tbe support of its public libraries, estab
lished by Mr. Enoch Pratt, who gave 31,000,000
for the purpose, bnt I believe tbat $40,000 per
annum would be sufficient to maintain those of
Pittsburg; and not less tban tols sum per an

place at the disposal of tbe Library Trustees to
be expended npon them,
1 am clearly of tbe opinion that It Is only by
the city maintaining its public libraries, as is
maintains its public schools, that every citizen
can be made to feel tbat he Is a joint proprietor
ot them, and that tbe public library is for tho
public as a whole and not for any portion tbere
ot.and 1 am equally clear that unless a commu
nity is willing to maintain public libraries as
tbe pnblic cost, that very little good can be ob
tained trom them. Not to save me further
expenditure therefor, but for the best Interests
of the clty.I make It a condition that they snail
he properly maintained by tbe city.

members of a Board of Trustee, composing
the commission therein named, in conjunction
with the nine persons heretofore appointed by
the said Andrew Carnegie and the Library
Committee appointed under the second section
of this ordinance.
Section 2 That Immediately upon the pas
sage of this ordinance and at the organization
of each Council hereafter tho Presidents ot
Councils shall appoint a standing committee
of flvo persons, two of whom shall be members
of Select Council and three of whom shall bo
members of Common Council, bo shall be
known as the Library Committee, authorized
and empowered to act as members of a Board
of Trustees in conjunction with the other of
ficials and with the persons named by tbe said
Andrew Carnegie and theirsneccssor-). and any
vacancies occurring in said Board of Trustees
other tban tbosu caused by changes of public
officials shall be filled by tbe majority of such
remaining members of tbo Board who are not
public officials.
Section 3 That tbe libraries as herein pro
vided for "ball be known and designated as
tbe Carnegie Free Libraries of tbe city of Pitts
burg. Section 4 That any ordinance or part oi or
dinance conflicting with the provisions ot this

as far as the same affects this ordinance
