The Fidelity Title and Trust Company,
administrator of the estate of Henrietta
Hammersfahr, yesterday, entered suit
against the German Protestant Orphan
Asylum ot Pittsburg, to recover 51,000.
The suit is brought under the act of Assembly-which
provides ttint charitable bequests
in wills made within 30 days prior to the
death of the testator, shall be void. The
money at issue in this suit, 51.000, it is
stated, was bequeathed to the orphan
asylum by Mrs. Hammersfahr. Her will
was executed January 1, 1890, and she died
13 days later, within the time specified in
the act of Assembly. The monev so left
was in the hands of the Rev. Mr. KuofF, who
is President of the Board of Managers of the
asylum, and he, it is alleged, has refused to
rive the money to the administrator ihen it
was demanded. The suit is brought to compel
the return of the money to the estate.
Other charitable bequests made by Mrs.
Hammersfahr were $100 each to the German
Catholic Church of Fulton Street, the German
Catholic Orphan Asjlnm of the Soutbslde,
and Passavant's Hospital. The balance of the
estate is given to her sister. Sirs. Amelia Of.

Judge Acheson. of the United States District
Court, yesterday handed down an opinion in
the case of William Jackson against the city
of Allegheny. The smt -was for damages for
the loss of floats and flatboats carried away
from the Allegheny wharf bv the flood of Feb
ruary. 18S4. It was claimed the city was liable
for not furnishing sufficient pots, nng bolts,
etc, for the secure moonngof craft.
Judge Acbeson held that negligence on the
part of the city was not proen sufficiently.
Also that the fact that the chains broke and
the posts held fast indicated that the plaintiff
was guiltv at least of contnbutorv negligence.
He dismissed the case putting the costs on the
plaintiff.

A Relic of the Singe Condi Days Put on the
Common Plena thrift
An ordrr was made in Common Pleas Court
No. 2 j csterday to the effect that hereafter the
court w ill convene at 9.30 A. si. instead of 10
o'clock on account of the increased business of
the court.
The habit of convening at 10 o'clock was a
relic of the old days when jurors, litigants and
witnesses from the country districts had to
travel to tow.i in stage coaches and other slow
means. With the many railways covering the
county now the judges think the people can
get to court at any hour.
nUCKESTEIX'S BIG TEEDICT.
The Nunnery Hill Incline Corapnny Ordered
lo Pay Him 510,200.
John Huckcstein yesterdaj received a verdict
in his favor for $10,200 in his suit against the
Nunnery Hill Incline Plane Company. Ihe
case was an action for damages forinjurr to
Huckestein's property caused by the erection
of the incline.
In addition to injuring lots owned by him the
incline destroved a road affording the only way
in and out of Huckestein's brickworks, causing
him, he claimed, to stop work.
Another Miner Wants Damages.
Nicholas Winter yesterday entered suit
against Jesse Sanford, owner ot the Leetsdale
coal mine, and Peter Watkins, pit boss, for
53,090 damages. Winter was severely injured
by an explosion of firedamp. He alleges to at
the owner and boss of the mine are lianle for
not keeping the mine safe, and sending him
into a dangerous place to w ork.

pointed conirrissioner in the divorce case of
Ellen McDonnell against John McDonnell.

"William McCutcheon $. Co., an action on a
contract to furnish Ice machines, is on trial be
fore Judge blagle.
THE jury is out in the suit of M. J. Fenton
against William and David Carnahan. an action
for damages for fruit alleged to have been taken
from an orchard contrary to an agreement of
sale.
George C. BuKGwrc, assignee or Oliveretta
Wharton, yesterday filed bis account. It
showed that he had received S73 392 93 and
disbursed the same amount less $37 28, a cash
balance on hand.
The suit of Wm. S. Graham and wife against
the Pennsxlvania Company is on trial before
Judge Stow c. The case is an action for dam
aces tor injuries recened bv Mr. Graham in

So One of the Defendants In the Lone
Drawn-Out Inclined Plane Soya Per
tinent Minutes of a Meeting Brought to
Llslit.
The case of the Pittsburg and ML Oliver
Inclined Plana Company against the Pitts
burg Incliued Plane Company got another
airing yesterday before the Master, D. F.
Patterson, Esq. Mr. C. J. Schulti, of the
plaintiff company, was cross-examined, and
then the testimony of Fred Hanipe and A.
Ii. Schuilz, Jr., was taken. It was similar
to that already mentioned regarding the
securing of the right of way by the Pittsburg
and ML Oliver Inclined Plane Company, and
although quite long was merely corroborative.
Secretary Grimes, of the Pittsburg Inclined
Plane Company, sajs that the presentation of
its case will put a very different face on the
matter. He says the movement by the plaintiff
was ab initio merely for the purpose of shut
ting out competition, and that on May 1, when
his company gave notice to property holders
that it proposed to secure right of way. there
was a flurry in defendant's camp and that their
meeting on May 2 was nothing more than an
attempt to cover shorts. In proof, ho cites the
following from tbo minutes of the meeting as
follows, which, he says, discloses, the animus
without the necessity of an v marginal notes:
"Pittsburg and Mr. Oliver Inclined Plane
Railroad Company, May 2. 1S9. Special meet
ing. The TJoard of Directors of the above
company met in special se-sion at the call of
the President at 3 P. M. On motion of Mr.
Keeling Daniel Beach was elected Secretary
and Treasurer. The call for the meeting was
read and the following resolution was offered
and pissed:
"WHEKEAS. It has been ascertained irom an
examination of the minuto book of this com
piny that the resolution adopted by the Board
of Directors of this company on the 5th day of
lebruarj, 1SS9. in reference to the survey and
location made by Carl Von Wagoner for an
inclined railway was recorded in said minute
book by John P. Beach, deceased, the Secre
tary at ihit time.
"Therefore be it resolved. That the present
secretary be authorized to place in the minute
book, asof the date aforesaid, the following as
a copy of the siid resolution:
Resolved, That the survey and location
made by Carl Von Wagoner to the company
originally, as shown on his plan for an inclined
plane and railway now before the board, be
tween Eleventh and Twelfth streets, in the
Twentv-seenthand Twcntj-ninth wards of the
city of Pittsburg, from Carson street to Wash
ington avenue, 20 feet wide, be and the same is
hereby adopted and ratified upon which an in
clined plane railway shall be constructed."
A PUSHING K0AD.
The Pccmickey Will "Soon be Double
Tracked to McKeesport.
In a short time the Feemickey road between
Pittsburg and McKeesport will be double
tracked. Two tracks have already been laid
except between Becks Run and Homestead,
and the grading for this work is finished. The
rails will be put down shortly.
The Lake. Erie now has about 1,800 men at
work at Shousetown grading for another track.
It is the intention of the company to lay a
double track to Youngstown as soon as they
can. The Nypano"s additional track to Cleve
land was completed last falL Not long ago
the Lake Erie placed a big contract for freight
cars. Thev aie being delivered every day.
Secretary Robinson said yesterday that about
500 would be shipped in AprlL The Lake Erie
is well supnliea with first-class equipment.
President Newell is still in Europe, and until
he comes home nothing will be done with the
resignation of Snperintcndent Holbrook.

act relating to Allegheny county, approved the
1st day of May, 1861, and of the amendments of
the said section, approved the 30th day of
March, 1866, 1 do hereby give notice that the
duplicates for the several wards, boroughs and
townships will be open, and I will beprepaied
to receive the county. State and poor taxes for
1890 on and after the 1st day of May, 1S90. Said
taxes cau be paid at this office until the 1st
day of August with a deduction of 5 per
cent for prompt payment to all persons paying
the whole amount of these taxes.
There will be no reduction allowed during
the month of August.
There will bo 10 per cent added to all taxes

All license not paid on or before the first
Monday in March, 1890, will be placed in the
hands of police officers for collection, subject
to a collection fee of 50 cents.
And all persons neglecting to pay on or be
fore first Monday in May. 1890, will be subject
to a penalty double the amount o' the license
to be recovered before the proper legal author
ity of said city.
The old metal plate of last year must here
turned at the time licenses are taken out, or 25
cents additional will be charged on the license.
Rates of license: Each one-horse vehicle,
6 00; each two-horse vehicle, S10 00; each four
horse vehicle, 12 CO; each four-horse hack,
115 00; omnibuses and timber wheels, drawn by

with Craig street sewer.
Section 1 Be it ordained and enacted by the
city of Pittsburg, in Select and Common Coun
cils assembled, and it is hereby ordained and
enacted bv the authority of the same. That the
Chief of the Department of Public Works be
aud is hereby authorized and directed to adver
tise In accordance with the acts of Assembly of
the Commonwealth of Pennsylvania and the
ordinances of the said city ot Pittsburg relating
thereto and regulating the same, for proposals
for the construction of a pipe sewer 15 inches in
diameter on Henry street from a point 300 feet
west from Craig street to a connection with a
sewer on Craigstreet.tbe contract therefor to be
let in the manner directed by the said acts of
Assembly and ordinances. The cost and ex
pense of the same to be assessed and collected
in accordance with the provisions of an act of
Assembly of the Commonwealth of Pennsyl
vania, entitled "An act relating to streets and
sewers in cities of the second class," apnroved
the lGth day of May, A. D. 1SSU.
Section 2 That any ordinance or part of or
dinance conflcting with tho provisions of this
