The decision of the Supreme Court in the
case of McConnell vs. Lindsay, referred to
yesterday, falls far from giving satisfac
tion. Many lawyers contend that legal sub
tleties are a necessity; that business could
sot get along 'without them, but there are
some who, -while admitting that differentia
tion must be allowed to run to a limit where
the line between gambling and legitimate
trade becomes as fine as that contemplated
by geometricians, yet express the hope that
some day eminent lawyers and judges in
the lower courts of this State and the
judges of the Supreme Court may arrive at
some understanding that will take the pro
fession of law at least partly out of the
realm of games of chance. They are tired
of decisions made by a mere majority ac
companied by dissenting opinions, and
would like to 'have the line between prece
dent and common sense more clearly
marked. Here is a case in point:
A WILL AS 'TWAS IKTENDED.
Before Mrs. Eveline Gross, widow of Dr.
A. E. Gross, died, she made a will which
was supposed to be so carefully drawn that
her intentions could not be misunderstood.
The main provisions are as follows:
Sixth I hereby authorize and empower my
executor to sell, mortgage or otherwise convey
and dispose of any real estate of which 1 may
die seized, except the aforesaid homestead
property, for the payment of debts, legacies
and the administration and settlement of my
estate, and purchasers from ber shall not bo
liable for or bound to look to the application of
the purchase money which they may pay to her
upon said purchases or mortgage.
Seventh I hereby bequeath and dense to my
said adopted daughter, Maltilda Gross McCon
nell. all the rest and residue of my estate, real,
personal and mixed, absolutely and lu fee
simple, and including therein any and all lega
cies which mav lapse by reason of the deceaso
of any beneficiary or otherwise. And it is my
will that the said Matilda Gross McConnell
shall take and hold the property given to her
free from the control of her present or future
husband and without any liability for any
debts, liabilities or engagements of such hus
band, but wholly for her own use and benefit
and subject to her own control.
Under the provisions of this will Mrs.Mc
Connell has sold some 20 lots from the old
"Winebiddle estate, out Penn avenue, and
there are some 1,000 or more plotted or in
tended to be and put on the market All
went well nntil a man named Lindsey
wanted to buy a lot, and his attorney, J. A.
Evans, Esq.. refused to pass the title, hold
ing that under the will Mrs. McConnell
only received the estate lor her sole and
separate use, and had no power to make
title. To determine the matter a test suit
was arranged, and Judge Ewing heard the
argument and decided that Mrs. McConnell
bad power to make title. He referred to the
married woman's act, and also held that the
words used in the will were too vague to
create a trust; in other words, th&t she had
a fee simple in the property, and could do
what she chose with it.
ESTTIKELT TOEXFECTED.
Notwithstanding the explicit declarations
of the seventh section of the will above
quoted, the Supreme Court decides that
Mrs. McConnell received the property for
ber sole and separate use, and has no power
to make title to any one else, has merely a
life estate in the property, or as some people
say: She has a fee simple which is not a fee
simple.
The mischief so far as sales have been
made does not seem to be as extensive as
some people imagine. The titles made as
executrix are supposed to oe good, but that
question has sot been adjudicated.
.Nearly all the lots so far sold have
been by Mrs. McConnell in her ca
pacity as executrix, but here is a. large
property with many thousands of dollars
tied up by this decision. It will not pay to
farm it and if Mrs. McConnell can only
pive life leases it isn't likely to be profit
able. There are complaints all the time
about the Schenley and other leases, as
standing in the way of the prosperity of the
city, but here is a woman who appears to be
tied up, with loss to both herself and the
public
C. K. Yeager, Esq., who is interested as
attorney in the decision, says he has no
opinion to give, as he was not at home when
the case was argued in the lower court. In
tbe case in which he is interested, Mrs. Mc
Connell was acting as executrix.

Hopes Entertained That it Will Get Another
Impetus From Some Qnnrter.)
Something is again on foot, or appears to
be, in regard to the ill-starred steel mill in
Coraopolis, the building for which was put
tip two years ago. The project seemed to be
in a fair way to materialize to the benefit of
many people concerned some two months
ago, but the death of Martin Joyce again
put a stop to operations.
During a day or two past some people
have been moving about the ground as
though they contemplated some kind of
action, and the Coraopolitans are on tip-toe
of expectation again. Some of them tried to
discover what was intended, but without
success. It was stated that among the
visitors were representatives of the Bindley
Hardware Company, but a call at that house
on Seventh avenue did not disclose any in
formation. -Mr. Uochran said he knew
.nothing of the matter, but he said it might
be possible that one of the name was inter
ested. It might be that the people who were
investigating might merely be interested in
the settlement of Mr. Jovce'f estate.

Controller Morrow yesterday received from
the Board of Assessors a report of the mill
age necessary in the different wards for sub
district school purposes for the current year.
The school directors of each district reported
the amonnt required for their school, and
the tax levy has been computed from these
figures. The totals in the various wards are
nearly the same as those of last year, but the
mtllage greatly differs in many cases. The
millage by districts and the amounts asked
are as follows:

Funeral of Prof. 1. N. Stephenson an Im
pressive Afl".ilr.
The funeral of Prof. Isaac N. Stephenson
took; place yesterday from his late residence
at Hazilwood and was quite an impressive
affair. Nearly all the school principals of
the city were present and followed the body
to its resting place in Allegheny Cemetery.
"When the cortege reached the Fifteenth
ward school, of which the deceased has been
tbe head for so long, the school children
were found drawn up in line awaiting it.
They then in company with the directors
and teachers marched to the cemetery where
an appropriate hymn was snug, in which
all joined.
The floral tokens were numerous and
costly, one open carriage which led the pro
cession being completely filled by them.

than Joe "Wood and E. B. Taylor. Their
rapid promotion is deserved, 'and appre
ciated by their friends.

Mr. C. J. Bennett, of Ormond, Pa., says
