In Agreement of John McKay's Handed in for Probate as a WilL OTHER GENEEAL SEWS OF THE COURTS Miss Lizzie Bender yesterday received a Terdict for 2,000 damages in her suit against Mr. Andrew Signal for breach of promise of marriage. The case was tried before Judge "White: E. Y. Breck, Esq., appearing for Miss Bender, and James H. Porte for Dignal. Both parties are residents of the Southside, and are young, and pood looking. Miss Bender was the first witness; She testified that the became acquainted with Dignal at a ball in Salisbury Hall nine years ago. He was attentive to her until December 22. 1888, when the alleged breach occurred. She staled that he promised to marry ber on three different occasions. The last time was about four years ago at the bouse of Mr. Cruikshault, Nineteenth street. South side. Mr. Cruikshank, at whose house the promise was said to have been made, testified tbat he had beard Dignal say: "Liz is tbe only girl I will ever marry." Mrs. Cruikshank testified that he id be was coins to set married to "L.zzie." Mr. Breck placed in evidence a number of letters written by Dignal to Miss Bender. Sev eral were read to tbe jury, ana their contents were full of love, etc One letter was dated Harvard. 111. It concluded with: "Think of our love tolay. for I am over tbe hill and far away." It also stated that the writer st under a his cedar tree, and tbe wind blew through his whiskers. Tbis concluded the plaintiff's testimony. Tbe defense offered but little evidence, and tbat re tarding but minor details. The arguments of counsel were brief, and the case went to tbe jury. It wis out but a short time, and returned a verdict of $2,000 for Miss Bender. Mr. Forte at once made a motion for a new trial. TWO GKAXD JURIES. Brier Shield Claims John IWcKny'a Signa ture Wat Secured by Fraud. A document was filed in the Register's office yesterday for probate as the will of the late John McKay. The paper Is in the form of an agreement, one clause of whicb is offered as testamentary. It has already been objected to, Brice Shields having filed a caveat in which he alleges that if tbe signature of John McKay was attached to the paper it had been obtained by fraud. The agreement is one in which McKay sets forth that he purchased the Common Gold Mine lor the benefit of his brother, Wm. Mc Kay, of Fresno county, Cal He deeded it to Wm. E. Bronn, of San Francisco, who was to open and develop tbe mine and form a stock company. Tbe capital was to be $1,000,000, divided into 100,000 shares. The clause offered as a will provided that Wm. McKay was to pay to John McKay, the decedent, $3,000 for bis ei- Senditures in procuring the mine. In case of ohn McKay's death, before it was paid, how ever, Wm. McKay was cot to be reauuedto pay the $3,000 to his estate, but it was to be de ducted from his proportion of the decedent's estate before his shite was paid to him. The paper was signed by John McKay, W. E. Brown and Wm. McKay, and witnessed by W. B. Bantley and John W. Pearson. POWERS K0T GUILTY. Other Verdicts Returned In tbe Crimlnnl Court The verdict in the case of misde meanor against E. W. Powers, the coal operator, of Tom's Run, was opened In Criminal Court yesterday, having been delivered sealed on Saturday. The ver dict was for acquittal, and the county pays the costs. A similar case, in which John Peterson is defendant, was tried. He was a foreman at a mine in Scott township, and is alleged to have neglected to take tbe proper precautions for tbe safety of tbe miners. The jury is out in tbe case. Charles Beck plead guilty to selling liquor without a license and on Sunday. Frank Markia was found guilty of illegal liquor selling at 1016 Carson street, on oath of Inspector McKelvey. H. L. McGowan was sentenced 60 days to jail on a charge of extortion. He was a judge of election held last June and, in swearing to tbe return oi tbe board before the Controller, bad said the board bad served two days. The business interests of the city will be materially benefited by an improvement in the postoffice, to be inaugurated to-day. A telegram was received in this city from General Clarkson yesterday, allowing Mr. McKean two additional distributors and two stamp clerks to meet the morning train each morning at Altoona, and between that point and tbis city will do the work that has here tofore been done in this office. Considerable time will thus be saved, enabling banks, manufacturing concerns, mercantile houses and individuals to receive their Eastern mails. Superintendent of Hails Collins is responsible for the scheme,having conceived tbe idea some time ago. He secured the in dorsement of the plan from the business community, including many of the most prominent bankers. Tbe latter particularly are delighted with the arrangement. Mr. Col lins, in explaining the scheme yesterday, said: "At present the train bringing.the morn ing mail from the East arrives at 7:45. It is not distributed until 10 o'clock. Between 12,000 and 15,000 letters come to this city every morning. By the new plan mail reach ing the city by that train can be handled in ten minutes' time after it is in tbe postoffice. As it is now, checks and draits coming to banks from the East in this mail cannot be put through the Clearing House until the following day, but commencing to-morrow tbey will arrive in time to go through the same day. Aside from the benefit this will be to the business men, it will prove a great convenienee to the postoffice. Less help will be required, and the cost of distribu tion will be reduced." A crew consisting of D. N. Williams and J. C. O'Donnell, distributors, and J. H. McGowan and E. J. Fisher left on the fast line lor Altoona last night on their first trip. Postmaster McKean yesterday ap pointed A. C. Frank, of the Southside, as directory and time-keeper, and Z. Z. New comb, of Lawrenceville, as stamp clerk. Both positions pay 5600 per year. The pictures for the art loan exhibition for tbe opening of the Carnegie Library, in Al legheny, are being received. The first lot has been received, and more are expected in a day or two. Those already received are being kept carefully under lock and key, with a special watchman on duty con stantly. Access to the gallery is refused without distinction. Mr. Scott is very de termined that those who .have so kindly loaned their pictures shall not have cause to regret doing so through any act of his. The committee that will arrange the pictures will begin their work in a day or two, and until the gallery is completed it will be closed to all applicants. It was reported in the city Saturday that the sad accident in Washington yesterday might prevent President Harrison from coming here to attend the dedication. Mr. Scott stated, however, tbat he had no fear of the President uot being here. It is over a week until the building is to be dedicated, and it is thought matters will be in shape in Wasbington by that time that he will not have any difficulty in getting away. Mayor Pearson and Mr. ScOtt conferred yesterday on the best means of distributing the tickets for the Carnegie Library open ing, which is fixed for February 15. It was decided that two tickets would be given to each member of the Council, two to each of the city officials and members of the Board of School Control. By this means 400 tick ets will be used, and the rest will be dis tributed by Mr. Carnegie among his per sonal friends. Including stage room, the hall will probably seat 1,200 people. For Scraping Mud in 50 Tears the State Has Spent $200,000,000. COL. T. P. E0BERTS' SUGGESTIONS. The Chamber of Commerce Urges Faster Work on tbe Postoffice. THE RESOLUTIONS SEXT TO MR. WIND0H The regular meeting of the Chamber of Commerce wa held yesterday. Colonel T. P. Roberts, who represented the organiza tion at the recent road convention in Harris burg, made his report. The Colonel, after referring to the opening of the convention and expressing surprise at the number of prominent Quaker City men who were pres ent, says: The Philadelphia Gentlemen appeared to favor the taxation of corporate property now exempt, to assist, it need be, In tbe construc tion of better roads throughout the State. One thing is certain, namely, that we can hope tor no improvement in our country roads so long as the nnit in their control of construction and management is the township. On this point tbe convention agreed unanimously, but there was a difference of opinion as to how far the State should go independently of county action. The majority of the convention favored, I think, a general law applicable to all coun ties, vesting in tbe bands of tbe Commissioners in conjunction with an engineer, which last named official be appointed by the court in each judicial or county district, the authority to classify tbe roads, and to determine from year to year upon which hiehways tbe proceeds of a General county tax might be expended, and f nrtber empowered to supervise the work and harmonize the system of improvement on the less traveled road with a view ultimately of bringing all of tbe public roads into a proper condition. A State Board under this system might be organized to adjust difficulties liable to arise upon roads connecting county seats, and to assist the poorer counties wbicb have such rocky roadbeds, and finally to make taxa tion uniform throughout tbe State. THE MONEY SQUANDEKED. We have during the last 60 years squandered, it is estimated, in this State for scraping up mud from our roads upward of (200,000,000, about $7,000,000 being now annually expended for this same purpose. This system might be pursued to tbe end of time with no good effect in making permanent improvement. In Alle gheny county we have 2,000 miles of roads, not a single one of which is equal to the worst mile of the National turnpike in Washington county which was built 68 jears ago. We should have good roads intermediate between the lines of tbe railroads entering tbis city to tbe agricultural regions of Washington, Beaver, Armstrong, Butler and Westmoreland counties, but must pay a fair share of tbe cost, and must ask the Legislature to authorize the counties to assist in their corporate capacity. If Commissioners by law are authorized to maintain and construct county bridges, and if county aid be extended to tbe constant im provement of bridges, why should it not be given for roads also? In je. erring to the labor of convicts on the roads the speaker said the subject was not considered to any extent at the conven tion; personally, he was not in favor of it, and had been informed by an official at the Western Penitentiary that there were not enough convicts in the State to do the work, and the cost of guarding them wonld result in very little economy. In conclusion, the Lpeaker remarked on" the importance ot im mediate action on the road question, and stated that it was not a holiday work to re build the roads, but years of time, labor and the introduction of the latest machinery, and the annual expenditure of millions would alone accomplish it The report was adopted, and Colonel Roberts thanked ior his kindness in making one out. Resolved, Tbat a copy of these resolutions be forwarded to the Secretary of the Treasury by the Superintendent of this Chamber for his immediate consideration. The resolutions were passed and PresiJ dent Kellv stated that consideration, he was sure, would be given the resolutions. James B. Scott gave a brief review of the success of the committee's efforts in securing the in crease in the appropriation from $750,000 to $1,500,060, and emphasized the needs of the public at present. Colonel Roberts briefly alluded to the fact that the committee se cured the nse of granite instead of any other material used in the construction of the Government building.
