Lawyers Advise Keeping the Carnegie Gift
Out of Politics,
TWO COMMISSIONES ARE EECOMMENDED
The ordinance placing the Allegheny
Carnegie library in the hands of the City
Property Committee will be finally disposed
of to-night at the regular meeting of Alle
gheny Councils. It now turns out that the
special legislation secured for Pittsburg, so
as to make it possible to accept Mr. Car
negie's proposed gift, applies to Allegheny
as well. The act of May 23, 18S7, provides
"tht it shall be competent for any incor
porated city within this commonwealth, and
the same is hereby empowered to take and
hold any grant or donation of money, books
and manuscripts or property, real or per
sonal, for the purpose of establishing a free
library within the limits of such corpora
tion, and to make provisions, by annual ap
propriations, for the maintenance of such
free library."
Of course, while this act is in force there
is also authority under which the Board of
School Controllers may maintain a library
of their own, and the logical argument is that
when the controllers have had a library es
tablished for years thev should be allowed a
representation on the board baring charge
of the one.
STJPFOBTED BY TAXES.
The present library was purchased by the
Board of School Controllers and has ever
since been maintained by school taxes
levied and raised by the board. The posi
tion of tbe matter now seems to be that there
is in existence one very good library, and
the disposition on the part of the City Prop
erty Committee is to maintain a second one,
which might result in two insufficient insti
tutions. To maintain both would be a large ex
pense for the taxpayers to meet, as the city
would no doubt be compelled to start theirs
from the beginning. There is no probability,
nor does it appear to be legal for the Board
of Controllers to hand over their library ab
solutely to the city. Since it appears that
both bodies have a legal right by acts of As
sembly to maintain a library, those who
have favored the plan of placing the new
library in the hands of a commission unin
fluenced by politics, argue that there is all
the moi reason that this course should be
adopted, or at least that tbe Board of Con
trollers and City Councils should be equally
represented on tbe commission.
By this means the present library could
be merged into the new. By the creation of
such a commission as Mr. Carnegie has seen
St to suggest, an end would be put to all
controversy, and, it is claimed, the best in
terest of the city would be subserved.
Several attorneys were spoken to yester
day with a view of presenting to The Dis
patch readers the legal status of the mat
ter. W". B. Sogers, Esq., ex-City Solicitor
ot Allegheny, said: "I have an idea that
the man who drew up the act for Pittsburg
had in mind snch a question as is now con
fronting our people. It does not provide
that Councils must take charge of the li
brary. It gives them the power to provide
for the management in any way they see fit,
and my opinion is that it ought to be placed
either in the hands of the Board of Control
lers, because it is an educational enterprise,
or a commission composed of representatives
of all city bodies."
HIS SENSIBLE ADVICE.
SS. A. McClung, Esq., said: "The new
library should be kept clear of politics, and
especially of city politic There is nothing
to prevent the City Property Committee
from taking possession of the building, but
this does not follow tnatthe school con
trollers mnst give up their books. That
places the matter in an awkward position.
One committee would have tbe bnilding.the
other tbe books. I favor tbe original plan."
Colonel "W. A. Stone said: "The gift of
Mr. Carnegie is intended ior a general li
brary, and it ought to be managed without
restrictions. I feel very confident that the
Board of Controllers and Councils will carry
ont the wishes of the people."
Arthur Kennedy, who (ought the ordi
nance before the City Property Committee
so hard, said he thought tie matter would
be amicably settled by the City Property
Committee having charge of the music hall
and the school controllers taking charge of
the library. "The citizens are demanding
some snch a plan," he concluded.
Mr. John S. Lambie said: "I am not a
citizen of Allegheny, but by all means the
educational board of the city should have
charge, as they have already a large library
established. It would be better to main
tain one good library than two poor ones."
The general supposition is that it Coun
cils decide to assume absolute control, the
School Controllers will refuse to give up
their books, valued at about $15,000. This
will place the matter in a more complicated
position, as it brings up the question of
whether the citizens will snbmit to a double
taxation for the support of two institutions.
About two years ago my wife had a Tery
troublesome congb, ot so serious a character
that we all became tery anxious; indeed, it
seemed that we had but little to hope for.as the
lungs were affected. We tried various medi
cines, but very little if any benefit seemed
to be derived from anv of them; so that it
appeared the disease had complete mastery,
and nothing but death would bring relief.
I was then advised to give Dr. D. Jayne's
Expectorant a trial, and doing so, to our
surprise found great benefit from its use.
Persisting with it, she gradually commenced
improving, until the principal symptoms
disappeared' entirely, and she has enjoyed
reasonably good health ever since. John

the contractor guarantees that when
completed and tested for speed, under condi
tions to be prescribed by tbe Navy Depart
ment, tne speed developed by said gnnboats
upon such trial shall be not less than an aver-'
age of 13 knots per hour, maintained success
fully for fotr consecutive hours, during which,
period the air pressure in tbe hreroom shall
not exceed one-half inch of water: and the'
speed developed by said practice vessel upon
snch trial shall not be less than an average, of
12 knots per hour, maintained successfully for
four consecutive hours, during which period
the air pressure in the ash-pits shall not exceed
one-half inch of water; and in tbe case of each
vessel, for every quarter knot of speed so de
veloped above said guarantee, tbe contractor
shall receive a premium, over and above the
contract price ot Ave thousand dollars: and for
every quarter knot that snch vessel fails ot
reaching'said guaranteed speed, there shall bo
deducted from the contract price ths sum ot
five thousand dollars: but that if, under the
conditions prescribed as aforesaid: either of
said gunboats shall tail to successfully develop,
and maintain, for four consecutive- hours, an
average speed of at least 12 knots'
per hour, she shall be rejected, and
if. under such conditions, said practice
vessel shall fail to develop ana main
tain, for snch period, an average speed of at
leastU knots per hour, she shall be rejected.
Said vessels are to be constructed in accord-'
ance witn puns ana speculations provided or
adopted by tbe Secretary of the Navy. Plans
and specifications, forms of proposals embrac
ing a general statement of provisions
to be included In the contract for
the vessels will be prepared by
tbls Department, and may bo seen and
examined at the department, where all In
formation essential to bidders can be obtained.
Said vessels must be completed within two
years from the dates of tbe respective con
tracts, and payments on each vessel will bo
made In twenty equal Installments, as the work,
progresses, npon bills duly certified, from
which ten per cent will be reserved to be paid
on the full and final completion of tbe con
tracts. Tbe cost of said gnnboats, excluding
the cost of armament, but including equip
ment, is limited to an amount not exceeding
350,000 each, and the cost of said practice ves
sel is limited to an amount not exceeding 3260,'

sels will be received "from every American
sbipouilder and other person who shall show,
to the satisfaction of the Secretary of the
Navy, that within three months from the date
of the contract be will be possessed of tbe

divided into four classes, as follows:

tenances, complete in all resnects. in accord
ance with the plans and specifications provided
bv the Secretary of the Navy. Proposals, for
Holland Machinery. Class Z For the con
struction of tbe hull and machinery, including
engines, boilers and appurtenances, complete
in ail respects, in accordance witn tne plans
and specifications provided by tbe contractor.

the same if adopted. Proposals for Hull and
Machinery. Class 4. For the construction of
the machinery, including engines, boilers and
appurtenances, complete in all respects, in ac
cordance with the plans and specifications pro
vided by the Secretary of tbe Navy. For tbe
construction of the bull complete in all respects
in accordance with the plans and specifications
provided by tbe contractor: but no snch pro
posal will be considered unless accompanied by
as full and complete plans and specifications of
such bull as are Issned by tbe Department for
tbe vessel, and a satisfactory anarantee of the
results of the same if adopted. The arrange
ments for tbe accommodation of all machinery;
coal, armament, fittings, equipments and stores
complete, must be for the same articles and
equally convenient and commodious as those
contained in the Department's plans and speci
fications. Bidders who may desire to off er to
construct more than one of said vessels, may
embrace, in one proposal, either two or three
of said vessel, tbe price ot each being given
separately. Bidders are not restricted to one
proposal. L e the same bidder may propose for
one or more oftbe vessels under one or more
of the four classes of proposals, as above speci
fied. Each proposal must be accompanied by
a cash depositor satisfactory certified check
Sayable to the order of tbe Secretary of the
avy. which shall become the property of tbe
United States in case the successful bidder
shall fall to enter Into the requisite contract
and to furnish tbe requisite security on tbe ac
ceptance of bis proposal. Tbe amount of such
deposit or check must not be less than 5 per
cent of the amount of the bid, but bidders in
cluding more than one vessel in their proposal
will not be required to submit therewith a cer
tified check exceeding in amount the sum of
30,000. All deposits and checks of bidders
whose proposals shall not be accepted will, on
ins ansni ui me contracts, do retnrnea to
tbem: the deposits or checks of each successful
bidder will be returned to him when his con
tract bas been duly entered Into and the requi
site security furnished. Every bidder will be
required, within 20 days af terthe acceptance ot
his prODo'al, to enter into a formal contract for
tbe faithful performance of the work and to
Svea satisfactory bond for such performance
a penal snm equal to 15 per cent of the
amount of his bid. Proposals mnst be made, In
duplicate, in accordance with forms which will
be furnished on application to the department,
inclosed in-sealed envelopes, addressed to the
Secretary of the Navy, Navy Department;
Washington. D. C and marked "Proposals for
tbe construction of gunboat No. . or practice
vessel" (as the case may be). The Secretary of
fio Navy reserves tho right to reject any or all
bids, as, in his judgment, tbo interests or tbe
