After Distributing Several Millions

Yesterday the will of the late "William
Thaw was admitted to probate by Register
Connors, and letters testamentary issued to
the widow, Mary Copley Thaw, and three
bods "William Thaw, Jr., Benjamin Thaw,
Alexandria Blair Thaw and his son-in-law,
W. R. Thompson. The will is dated July
C, 1889, and "William Jackson, T. H. B.
McKnight and Robert It. Reed are wit
nesses. It covers 36 pares, legal cap, type
written. The material portions are:
To the executors, their survivors atyl duly
appointed successors, all the testator's estate,
except coal and coal lands otherwise disposed
of, iu trust, that they shall execute the pro
visions ot the will.
With these exceptions the estate is to be
inventoried and appraised by said executors
and then divided into 16 shares of equal value,
certain shares to be increased or diminished
accordiuc vo certain contingencies. The
testator says that as creditors will not probably
need the information, and others interested
can get it from the executors, tho inventory
and appraisement shall not be tiled with the
Register of Wills unless said action be legally
necessary.
Immediately after probate the executors are
directed to pay to Mary Copely Thaw, testator's
widow, $10,000 in cash, in addition to any other
provision made for her, out of and chargeable
to three equal shares, excepting coal and coal
lands, and subsequently called supply parts.
MRS. THATT PROVIDED FOE.
Testator directs that of the 16 equal parts
named three shall be conveyed to the widow,
provided she survive testator 30 days next en
suing after the admission of the w ill to probate.
This provision was intended to enable her to
make testamentary disposition in case she died
before testator or within 30 days of probate the
three equal "parts or shares of my estate to be
allotted or set apart to my children, and the in
creased number of equal parts or shares of my
estate so allotted or set apart to my children
shall be fairly divided Into as many equal parts
as there are children of mine surviving me, ir
respective of their maternal descent, and in
cluding as one such the lawful issue of any
deceased child; and the said executors, or trus
tees from time to time acting, shall carry out
and perform concerning such enlarged equal
parts the directions and provisions hereinatter
contained, relative to the equal parts or shares
of my estate to be allotted or set apart to my
children." At the end of that period, if she
survive, the property ests in her absolutely.
Of all the 18 equal parts 10 are allotted to
testator's children, Eliza, widow of George B.
Edwards; William Slaiy, wife of William R.
Thompson; Benjamin and Alexander Blair,
five children of testator's deceased wife, Eliza
Burd Blair and Henry Kendall. Edward.Josiah
Copley, Margaret and Alice Cornelia, the five
children of testator's wife, Mary Copley; but
these parts are held in trust by the executors.
The three remaining shares, styled "supply
parts,' are devoted to the payment of all lawful
debts, taxes, commissions, expenses, etc., inci
dent to the execution of the will, gifts, be
quests, annuities, etc, and if any residue to be
disposed of as subsequently directed.
Gifts, bequests, etc, are directed to reach
recipients without diminution by reason of any
cause whatsoever, and wife and children are
similarly protected, all charges to be paid from
"supply parts" for two years following testa
tor's death, after which all except annuities
shall bear their own Ian f ul expense.
HOW TO DIVIDE VALUES.
The executors ire empowered to designate
items of the estate which at their appraised
value shall constitute each one of all the 16
equal shares, appraisers to be appointed by
the executors, or trustees then acting, seals ac
knowledged and writings acknowledged andre
corded, if necessary, or expedient.
The property on Fifth street,tstator's home
stead for 36 years, contents, appurtenances,
including stable, horses, vehicles, plate, jew
elry, etc, lot and cottage at Cresson. exclud
ing cash stocks, bonds or shares in action that
may be therein, lot In Allegheny Cemetery, al
together to be appraised at 40.000. and at that

the shares of children, minors at testator'6 de
cease except that his widow is requested to en
joy them for life without charge.
It is directed that testator's lot in the Alle

ants. He directs that his other lot be resold to
the Allecbeny Cemeteryat cost and interest for
roadway purposes, and unless they see good
reason to the contrary the executors are to as
sign his Wood street property, Nos. 46 and 48,
and bis Smithfleld street property, Nos. lOi
104, 106 and 10S. to the shares of his children.
Provision is made that If there be increase of
lawful issue after date of will such issue shall
be taken care of by a reapportionment. The
same provision is made in case of death of My
of the heirs, by which the size of the shares are
increased. "But the whole number of shares
shall in no event be less than 12, my purpose
being that not less thau one-half of my estate
shall go to my children, even shonld a less
number than six of them snrvive me, mcludin"
as one such the lawful h-sue of each deceased
child; in which case the said half, being 12
equal parts or shares, shall be fairly divided
Into as many equal portions as there are chil
dren surviving me, and with reference to said
equal portions of said half said executors shall
perform and carry out all the provisions and
directions in this will set forth affecting the
equal parts or shares to be allotted to or set
apart for my children."
AS JOINT PEOPERTr.
The shares of the minor children are to bo
managed as joint property during their minor
ity. The heirs who are of age are to be paid
at once one half their property.and the minors,
as tbey reach their majority, one-fourth of
their share allotted, the remainder to be man.

and it is provided that these heirs cannot en
cumber, assign, convey or anticipate, the pro
visions being applicable to the lawful issue of
any deceased child, who shall take the place of
tho deceased. Should any child die without

It is willed that the executors, survivors or
successors shall continue to act so Ion as any
act of administration is necessary. The execu
tors are empowered to associate with them
selves as trustees or as guardians suitable per
sons, but such shall not become guardians un
less to nil vacancies in the number of execu
tors for which the will makes provision. The
number of executors and the number of trus
tees of the shares allotted to the minor chil
dren shall not at any time bb less than three.
"Whenever a trustee or trustees shall be re
quired under the provisions of this will, for
whose appointment direction is not otherwise
given, such trustee or trustees shall be
appointed by the executors of my will
or the trustees from tune time acting
(as distinguished fram the separate trus
tees appointed to hold the respectiv

annual income of $1,300, to be paid in quarterly

A COKE TRUST.
Coal and coal lands, options, etc. in West
moreland and Fayette counties, held by testator,
arc to be paid ror out or the three supply parts or

son, William Thaw, Jr., and Benjamin Thaw,
who arc designated as "The Coke Trust, " to hold
the same as undivided property until It
shall be advantageous to begin mining
the coal, and then to do busi
ness. Recommending that no haste be made to
begin operations nor waste allowed. Care or every
kind Is enjoined, so that schemers be not allowed
to skim the cream: that maps be made and opera
tions so conducted that the entire body shall be
made available and profitablv worked.
The trustees are enjoined rioin running or
coking ror themselves, or being participants
save as lessors, and leases are to be made In such
manner that lessees shall make all improvements
at their own cost, but nothing contained in the
will is to be construed so as to prohibit testator's
sons, William and Benjamin, from o operating
"and should it be round that the best interest orthe
trust call ror the postponement or the date bv
leasing and the coke trust be round lacking

from the three snpply parts or the estate,
but lest the settlement of the estate be hampered
no payments arc to be made except during two

after. It Is ordered that none or said coal shall be
sold in bulk before January I, l'JUQ, nor afterward,
unless It be found for the best interest or the
trust, except to straighten lines or ror better Ten

NO BONDS NEEDED.
The number or trustees is always to be kept at
three survivors to fill vacancies. Neither the
trustees named nor those appointed are Jo be re
quired to give bonds for the faithful performance
of their duties, the power or the courts being in
voked to remove any who shall misconduct them
selves. A6 soon as there shall be a revenue the net pro
ceeds are to be ascertained semi-annually, 10 per
cent to be retained ror the protection or the trust
and the coke trust Is to be continued during the
natural lives oi an tue testators children, grand
children and great grandchildren, during the
lurther period olZl years next enssing after the
death or the survivor or all said children,
grandchildren and great grandchildren, unless
the coat shall have been sooner exhausted,
and they are to receive the net income less the 10
per cent aforesaid. The trust Is to be made per
petual, and as children, grandchildren or great
grandchildren die their snares are to be divided
among the remainder. Particular attention Is
enjoined to secure the interests of daughters,
granddaughters and other female descendants.
The benefl claries are not to be allowed to encum
ber or anticipate, transler or sell for debts and
when the coal Is exhausted the trustees will be al
lowed to sell the lands remaining, the proceeds to
be paid to the beneficiaries.
During the first two jears executors' services
are to be paid out orthe snpply parts ol the estate
and compensation shall not be less than $5. 000 nor
more than $7,000 to each executor ror the entire
term or two years. They are desired to employ
sufficient and competent clerical help, to be
paid out orthe supply parts during two years.
Finally provision is made ror the filling or va
cancies fn the ranks of the executors by those re
maining. Mr. Thaw's estate Is variously estimated to foot
up anywhere from $3,000,000 to $15,000,000.

of
Hcntth Is Explained.
Last week the Allegheny death rate in
creased from 26 to 33. Twelve were of chil
dren under 12 years, and seven oi these were
of mere infants. Nineot the children died
from cholera infantum and three from
whooping cough. Typhoid is reported as
decreasing rapidly, and there was but one
death from that cause.
Superintendent Armstrong says it is the
abundant drinking and use ot water to
sprinkle streets that has kept Allegheny so
healthy. The vrater required daily is 20,
000,000 callons.
Two Xjarse Excursion.
The German Catholic excursions to Cleve
land, yesterday were crowded. The Cleve
land and Pittsburg road carried over 400
persons, and the Pittsburg and Lake Erie
nearly as many. The occasion of the rush
is the great congregation of German
Catholics in the Forest City to-morrow.
