Dear Sie Referring to Tour request
made to me during the trial of the Starr
'case, that I should, after consultation with
Mr. Wcyman, inform you what additional
precautions ought to be adopted by the Penn
sylvania Company to protect the public at
the Federal street crossing in Allegheny,
and your assurance that you would use your
influents to have the same adopted, allow
me respectfully to submit that Federal street
is the most crowded thoroughfare in Alle
gheny, and every reasonable precaution to
prevent danger to life and limb should be
used at that crossing. At present, however,
trainmen are not required to give any notice
whatever of the approach of trains gojng
u est on your company's lines, but the put
lie, are compelled to gain their knowledge of
such approach from two gatemen, who, on
Account of their positions, or because they
themselves have not had timely warning
thereof may not know that a train is ap-
proacuing in time to warn me puoiic or ex
clude them from the track. It some
times happens that by reason of crowds
of pedestrians, vehicles and street cars,
upon or crossing over the tracks, the
view of these watchmen is so obscured that
they may not see a train until the danger is
imminent, and it is too late to avert an acci
dent; and these causes may be aggravated
by darkness or other unfavorable conditions,
and it is of the utmost importance that these
two watchmen, to whom is committed the
fearful responsibility ot guarding the lives
of the tens of thousands who daily pass and
repass their gates, should be warfcd by
every contrivance for safety known in rail
road management.
Every railroad company in the land rec
ognizes the engine bell as a practical and
adequate means of giving notice of the ap
proach of a train. When trainmen ringthe
bell both the gatemen and the public are
notified of the approach of the train, not
only through the sense of sight, but also
through the sense of hearing, and a double
security against accident is thus afforded.
The necessity for this double warning has
been repeatedly recognized bv the courts,
so oiten, indeed, that the Supreme Court
has laid on all who attempt to
cross a railroad the duty of first
stopping to look and listen. But if a train
may approach a crossing swiftly and silent
ly, without the sound ol either bell or
whistle, then no duty rests on trainmen com
mensurate with tha required of those at
tempting to cross. On the contrary, how
ever, the duty is equally binding upon all
railroad managers and employes to give ade
quate -warning to both eye and ear of the ap
proach of eveiy train to a grade crossing.
This is true even of country roads where
travel is light and infrequent, and bence in
finitely more so of crowded thoroughfares
in a great city. Even though your
company" should deny the validity of the
city ordinance ot Allegheny, which requires
all trains to ring a bell on approaching a
crossing, it cannot deny that what I have
stated above is the common law of Pennsyl
vania in regard to the approach of trains to
grade crossings. The rules ol your com
pany should therefore be so formed, at once,
as to require bells to be rung on every train
approaching this thronged street.
Again, the watchmen at Federal street are
notified of the approach of every train going
east, by an " electric bell. As a further safe
guard,' at Sandusky and Anderson streets
towers have been erected which enable the
watchmen to see approaching trains and
operate the safety gates from an elevated
position, which increases the facilities for
observation. "Whv should not the Federal
street watchmen have warning as well from
the east as the west, and also be placed in
elevated towers out of reach of the crowds
which" Interfere both with their' work" and
their view. Because howeverffsxiive the
safety gates when down, to preverit'Sanger,
the vjtal point, after all, is to have, timely
warning given to the watchman in order
that he may lower them before it is too late.
In furtherance, therefore, of your humane
proposition and of your evident desire to
contribute to the public safety by the adop
tion of every proper precaution, permit me
to recommend the three methods of giving
warning above referred to that is to say:
First, by causing the engine bell to be rung
by all trains approaching that crossing; sec.
ond, by so placing an electric bell as to give
notice of the approach of trains from the
east, and third, by the erection of a suitable
tower for the watchman.

opened in the presence of attending bidders,
for furnishing about f our hundred and twenty
eight (42S) tons (2.240 pounds) of sUel protective-deck
plates, forty- (40) pounds per squaro
foot, for use In the construction of said cruiser,
aboiit two hundred and fourteen (214) tonjef
such plates being for the upper layer of plat
ing, and about two hundred and fonrteen
(214) tons for the lower layer there
of. Such plates to be delivered
at such place or places in the navy yard,
Brooklyn, N. Y.. as the Commandant of that
yard may designate. Deliveries to commence
within thirty (30) days from the date of con

cordance with a detailed schedule, which may
be seen on application to the Bureau of Con
struction and Repair, Navy Department. All
such plates to bo of domestic manufacture,
and to be accepted only after passing such
tests as may be prescribed therefor by the Seo
tetary or the Navy. Proposals must be mads
in accordance with forms which will be fur
nished on application to the Bureau of Con
struction ana Repair. Each proposal must be
accompanied by satisfactory evidence that the
bidder is able to furnish and deliver the mate
rial for which he bids. Each proposal mnst bo
accompanied by a certified check, payable to
the order of the Secretary of the Navy, for an
amount equal to 5 per cent of the bid. The
check received from the successful bidder will
be returned to him on his entering into a
formal contract for the due perform
ance of the work, and giving bond
for the same, with satisfactory surety, in
a penal sum equal to 25 per csnt of the amount
ot bis bid: but in case he shall fall to enter
into such contract and to give such bond with
in ten days alter notice of the acceptance of
bis proposal, the check accompanying such
proposal shall become the property of the
United States. All checks accompanying pro
posals which are not accepted will be returned
immediately after tho award shall have been

and shapes of plates, and all other information
