."ft1 V t THE PITTSBURG TjISPATCH, TUESDAY, -MARCH 19, 1889., TO .ENFORCE THE POLICY. An Action to Slake nn Accident Ass oclatlon Fay Up m Per Alleged Agreement Novel Paints Involved In It. J. D. 'Watson, Esq., yesterday filed a precipe in behalf of Kobert Graeey in a suit against the People's Mutual Accident Association. The suit is for 525 per 'week, accident benefits, for a number of weeks, and, involves a queer point. Mr. Graeey, who is a foundryman on Water street, had an 'accident policy from the company, on which he paid the assessment every CO days, the com pany collecting the money, which was payable in advance. The money was not called for on one occasion, and two days later Mr. Graeey fell and dislocated his shonlder. Three days after that the scent came around and collected the money. The company, how ever, refnsed to pay the weekly benefits for .Mr. Graeey s Illness, claiming that tho Insur ance only dated from the time the money was paid, and that the policy was void for tho five days during which Mr. Gracev was hurt, inter veninc between the end of the nrevious 60 days and the time of the payment for the next 60 oara. Attorney Watson holds that the policy cov ered that time, and that there was an atrree rnent in It that the company should collect tho money, and It was their iookout-if they did not collect it on the first day: also, that when they um accept, mc money it was an acceptance on their part of the old terms of the policy.
