Ask Court to Choose Between Oakmont and
Hal ton-for a Same.
TYKOXG FIGURES AS TO A KEW JUSTICE
There was argued before Judge Collier in
Criminal Court, yesterday, a case that is
causing some good people up the Allegheny
Valley Railroad a great deal of thought.
It seems that the borough of Verona is to
be divided. It was rather large lor a bor
ough, and, by mutual consent, the borough
is to be split in two. The First waid re
mains as the borough oJ Verona; while
residents of the Second ward are casting
about for a name, and that is what caused
the argument in court.
Mr. George P. Graver, representing a
number of petitioners, -wanted the new
borough called Oakmont, and his reasons
were that the largest number of freeholders
wanted that name, because they thought it
would he suitable.
C. a Lee, Esq , also represented a large
number of petitioners, who, however, desired
the name of the new borough should be Hul
ton, and their reasons were that Hulton was
the old established name and was known
throughout the world because they have witbln
their limits a large spring factor, extensive
glassworks and other manufactories whose
wares are known over the land: as likewise the
factthat their factories were located at Hnl
ton, Fa. Mr. Lee Intimated that the oppo
sition had no grounds upon which to base their
demand, except inclination, and the only
ground for wanting the old name of Hulton
done away with was that it did not exactly suit
tbeir tastes.
The Court ordered the attorneys to circulate
among the resident freeholders and get from
them an expression on the name and report to
the court to-day.
DID THEY FIGURE IT WROXGT
A Contest As to the Election of a Baldwin
Township Justice.
A contest was commenced yesterday in the
matter of the election of Justice of the Peace
in Baldwin township. A petition was filed in
the Quarter Sessions Court, asking that a cer
tificate of election be issued to F. O. Wolff. It
is stated there were two Justices to be elected,
the terms of .Nicholas Hayne and Wolff both
expiring on the first Monday of May, ISS9.
There were three candidates, Thomas Mc
Govern and Havnc and Wolff. The vote stood:
McGovero, 341: Wolff, 305, and Hayne, 278.
The judges of election, however, in 'adding
up the vote of the districts, made Wolffs total
vote SOS, instead of 303. and certificates of elec
tion were issued to McGovem and Hayne. It
is asked that the election of Hayne be declared
Illegal, and a certificate issued to Wolff in his
place. Judge Collier made an order fixing Sat
urday, March 10, at 10 A. 3L, for a hearing in
the case.

Glass Manufacturers to Defend Themselves

William P. Leng yesterday entered suit
against D. O. Cunningham, the glass manu
facturer. Leng claimed that in 1874, when a
minor, he was indentured to Cunningham to
learn the trt and mysteries of glass blowing.
For the first year S50 was to be retained from
his wages, and for the second, third and fonrth
years 100 each, which w as to be paid him when
his tune was un
He did not work at the trade the f nil time,
owing to the works shutting down, etc: but,
, for the time he did work, he claims that $150 is
dne by the terms of the agreement. He asks

' Augustine Fredericks sues the Pennsylvania
Railroad for $20,000. He was struck and killed
by a West Penn train.
Si3feexas in divorce were Issued yester
day in the cases of Jacob Gerwig against Annie
Gerwig, and Kate Coulson against John E.
Coulson. Desertion was alleged in both cases.
The business of Criminal Court was closed
up yesterday morning, the business of the term
having been completed. To-day a nu-nber of
arguments on motions for new trials will bo
heard.
Feakk Beckett, Esq , asked Judge Coflier
yesterday to grant an extension of time on the
'forfeited bail bond of a man named James
Bradley, who had been indicted for false pre
tenses. The request was refused.
Am argument was had In the Orphans' Court
yesterday in the contest of the will of William
Burke, Sr. J. Scott Ferguson. Esq., appeared
for the contestants, and W. C. Erskine, E'q , m
support of the wiH. No decision has yet been
made.

Co yesterday entered suit against thePauld--ing
Iron Company, limited, for 70 1M 66. for
money advanced and goods furnished. The
suit Is for rse of James W. Friend, James M.
Bailey and James Pickands, to whom the ac
count was assigned.

entered suit for 6.000 damages against C. A.
Balph, the contractor who built the power
house at the forks of the Toad for the Citizens'
; Traction Company. They claim that in exca
vating for the power house Balph did not do

damaged.
There was a further hearing yesterday in
the alleged irregularities in the Dimmey mur
der Jnry. JohnD. Crea, Samnel McElbaney
and Henderson Crider testified to having se
cured a drink, while J. D. Prophater. J. W.
, Undercmtt G. L. Browning and H. E. Folk
bad no liquor. The jurors said when the liquor
was served it came in roffec cups; but there
were no jurors affected by liquor.

A POLISH GIRL'S DEATH. .
A Little Child Is Suddenly Hilled While on
Her Way to School.
Mary Xbvak, a Polish girl, whose parents
reside at No. 1012 Sarah street, was killed
at the Eleventh street crossing of the P., V.
& C. R. R., yesterday morning, while on
her way to the St. Adelbert's parochial
school. The child was 8 years old. Her
body was badly mangled. The crossing is
on a curve, and the girl was struck by an in
ward bound freight train.
Her head and one arm were severed from
the body. The remains have been taken to
her parents' home.

of certain streets, avenues and highways
to the Central Traction Company.
Section 1 Be it ordained and enacted by the
city of Pittsburg, in Select and Common Coun
cils assembled, and it is hereby ordained and
enacted by tbe authority ot tbe same Tbat tha
Central Traction Company shall have the right,
with the consent ot tbe Central Passenger
Railway Company, to enter upon anystreet on
which the Ceniral Passenger Railway Company
now is or may hereafter be constructed,
and also shall have the rigbr, with
tbe consent at the Transversa Pas
senger Railway Company, to enter
upon that portion ot Sixth avenue lying be
tween Smlthfleld street and Wood street and
that portion of Wood street lying between
Sixth avenue and Fourth avenue, being the
same portions of said Sbrth avenue and Wood
street, between the points namfd upon which
the Transverse Railwaynow is tor the purpose
of constructing, maintaining and operating in
and npon any or all of said streets and avenues
such motors, cables, electrical or other appli
ances and such necessary and convenient ap
paratus and nseahanlcal fixtures as will provide
ior tne traction oi cars.
Section. 2 The Central Traction Company
shall have tbe right in, npon or beneath tbe
surface of any and all of said streets and ave
nues to construct and maintain such subways
or conduits, and from time to time to make
and maintain such sidings, turnouts to power
houses or otherwise, and such alterations in
tracks as may be necessary or convenient In
supplying motive power for the traction of
cars.
Section 3 Tbat tbe said Central Traction
Company, before constructing snch sub-ways ,
or conduits; shall submit plans for the same toSgi

Section 1 The construction of said motors
and snb-wars shall be "commenced within 90

ordinance are expressly given upon condition J?
that tbe Central Traction Company shall pave
with block stone, asphaltum or other equally
good material, to be approved by the Chief ot
the Department of Public Works, and keep tha
same inYerpetual good repair, in manner to ba
apnroved by tbe said Chief of the Department
of Public Works, between and one foot outside
of the tracks upon which It shaU supply power,
to the cars, wherever the route upon which
power is supplied is over paved streets or ave
nues, and it shall alsopay its just and equitable
share of tbe cost of paving such portion of tha
said route used as shall not bave been paved
prior to the time of occupancy thereof by tha
Central Traction Company.
Section 6 Provided that before this ordi
nance shall go into effect, and within 30 days
after Its approval by tbe Mavor, the said Cen-.
tral Traction Company shall file its written aix
ceptance of this ordinance, sealed with the seal
of said corporation. '
Section 7 That any ordinance or part of
ordinance conflicting with the provisions of
thi3 ordinance he and the same Is hereby re-1-pealed
so far as the same affects this ordinance.
