in the Case of Joe Dimmy,

In opening the case of Joseph Dimmy,
charged with the murder of Special Officer
Miller, last September, District Attorney
Porter told the story ot the crime, and stated
that he would ask for a verdict of murder in
the first degree. The accused was represent
ed by Thomas 1L Marshall, Sr., and Thomas
M. Marshall, Jr., and "William Reardon and
John S Kobb were called in to assist the
Commonwealth.
A sad-faced woman, attired in deep mourn
ing, was the first witness, and perfect silence
fell upon the crowd as the widow of the
murdered man told her story.
She said her husband had been employed
as private watchman by the residents of the
streets about Western avenue, Allegheny.
On the fatal night of September 3 be left home
early. She was ill at the time, and heard noth
ing of the affair until her husband was brought
home dead the next day.
Joseph Speer said he was on a Western ave
nue car at about 1:20 in the morning, and heard
a shot jnst after they crossed tho railroad
bridge. Ho saw a man running through the
park and ran after him. The man had a re
volver in his hand which he pointed at Speer
and cursed him, and said: "I'll let you have
one, too." They grappled and Speer threw him
down, and Officer Fitzgerald helped him to
arrest the man. They found Miller lying on
the pavement.
Dr. Stewart Patterson testified that Miller
was taken to the hospital in a dying condition.
There was no evidence of disease, and death
was caused by the pistol shot wound.
William Bown, the jrunsniitb, said the bullet
was a 32 caliber and the revolver an American
bulldog double action.
Officer Patrick Fitzgerald, of the Pittsburg
force, was next called, and said he was in Al
legheny that night looking for a man at the
Union Rink. A boy who was with him sud
denly said: "I think there's a fuss." Then a
shot was heard and a man jumped into the
park and Fitzgerald followed. The man turned
and flrcd twice and the officer fired twice at
him. The man jumped out on Western avenue,
where Officer Speer caught him. Thistesti
monv was corroborated by the boy, who also
testified the prisoner said to Fitzgerald: "Is
that jon, Paddy? I thought vou were the man
I first shot at."
Joseph Diebold said he helped undress Miller
at the hospital and took the revolver from his
pocket. All the chambers were f uIL Court
then adjourned until 9 o'clock this morning.

The County Commissioners heard appeals
yesterday from the county assessments.
Magnns Pflaum had been assessed 2,200 on a
house there, but he claimed a road had been
built below it and the house had virtually slid
down the hill from one ward almost into an
other. The assessment was promptly reduced

slander, was awarded $1 66, and in Charles
Barbour against Cribbs the latter received a
verdict.
A verdict by agreement was taken yester
day for 200 for the plaintiff in the suit of
Robert Galbraith against Blythe fc Co., a suit
on an account.
A C. Patterson filed a bill In equity against
the heirs of Robert Ashworth to compel them
to give a clear title to a piece of land in the
becond ward, Allegheny.
A verdict for $4,500 was rendered yesterday
in favor of Thomas McCann against the B. &
O. R. R. Co., on a suit for damages for injuries,
received in a wreck on that road.
A voluntary non-suit was taken yesterday
in the suit of Wilcox fc McGeary, for use of Ida
McGeary, against the city of Pittsburg for
damages for the opening of a street.
A bench warrant was granted yesterday
by Judge Ewing, on motion of C. A O'Brien,
attorney for Henry Terheyden against George
C. Roll, on theallegation that Roll had fraud
ulently purchased a gold watch valued at $175.
A NON-Surr was entered, yesterday, in the
suit of Mrs. Sarah Toole and others against B.
F. Jones and others, for damages for the kill
ing of her husband, a conductor of a cinder
tram, in the mill of Jones & Laughlins, South

The Pittsburg Company Meets at Crelghton
and Chooses Officers.
The annual meeting of the stockholders of
the Pittsburg Plate Glass Company was
held yesterday at Creighton, "West Penn
Railroad. After hearing the reports and
enjoying a good dinner, the following
named officers and directors were elected for
the ensuing year:

President; E. L. Ford, Secretary; John F.
Scott, Treasurer; Directors, E. Ford, E. L.

FOE CAMPAIGN PURPOSES.
Claimed the Firemen Are to be Assessed to
Help Out Spring Elections.
Although denied by the officers, the after
noon papers, yesterday, claim the firemen, in
addition to the police, have been assessed for
the municipal elections.
Some of the firemen, when spoken to, said
the elections generally cost a good deal, and
they would be willing to get off at $9 a head.

PADPEE IMMIGRANTS.
Mary Robton'a Sad Story She Was Shipped
to Canada by a Lying Steamship Line
and Government, and Drifted Hither.
A strange case of the desertion of a young
girl, and her subsequent privations, was
disenssed in Pittsburg yesterday, which is
another illustration of the wrongful policy
of the English Government in regard to the
pauper emigration question. It seems that
about three years ago an orphaned girl,
living in Newcastle-on-Tvne, was per
suaded by an agent of the Allan Steamship
Line, who was at the same time an agent
of the English Government, to leave her
comfortable home, and emigrate to Canada.
It was represented to the girl, whose name
is Mary Robson, that she would find a good
situation immediately on arriving, and that
the English Government would pay her
Eassage. The deluded girl went, and,
aving arrived in Quebec, was taken in
charge by a branch of the "W. C. T. TJ. For
three days they gave her shelter, and then
left her to shift for herself. Not being
inured to the Canadian climate, she passed
most of her time in the hospital, working
whenever she was able. Some time ago, by
mere chance, she heard of an aunt of hers,
said to reside in Pittsburg. She conse
quently came hither to apply for help. The
aunt's 'ame is Mrs. Isabella Bobson; but
the girl has not found her as yet, and de
sires to go back to England as soon as
possible. She is at present staying with
Mr. Emil Dorner, of No. 1149 Liberty
street, who has kindly given her shelter
temporarily.
The girl says that the English Govern
ment ships hundreds of persons to America
yearly in a similar manner, in orderto get
rid of them, as they consist, for the most
part, of paupers and criminals who would
be anexpense to the authorities.
Another sad case of poverty was discovered
yesterday. Two years ago William Burns
came from England and drifted to Pitts
burg. For a while he got along nicely,
until rheumatism laid him low on a hospital
cot. Recovering, he .sent for his wile and
two children, who only arrived to find him
sick again. Since then, for a month, the
family has been dependent upon the charity
of the neighbors and the Poor Society.

Supreme Court, rendered yesterday, relative
to the duration of certain patents, and the
possible effect thereof on the companies
now engaged in the promotion of the phono
graph, by reason of such companies not
having acquired rights under certain of my
inventions, I take this opportunity to set the
matter straight by saying that all my phono
graph patents, including not only those of
recent date, but also the fundamental pat
ents which are affected by this decision of
the Supreme Court, are covered by the con
tracts of sale and purchase existing between
Mr. Iiippjncott, myself and the other
parties in interest. Mr. Lippincott provided
in advance against this very contingency
which has now happened by including in
his contract of purchase not only my more
recent patents and future inventions, but
also my earlier and fundamental patents.

An Honorable and Generous Action.
The above are the words used by the.
Mutual Life Insurance Company of New"
York, in announcing to the public its ex
ceptional treatment of the case of Mr.
Charles K. Pelgram, of Pater6on, N. J.
The facts in the case, briefly stated, are as
follows: Mr. Pelgram took out a $15,000
policy in the Mutual Life Insurance Com
pany, on the 14th of September, 1874. He
paid his annual premium of $340 50
promptly for thirteen years. When the
fourteenth premium fell due, Mr. Pelgram
was on his death bed, and the policy lapsed
by the non payment of that premium. Al
though the policy had a large value, the
insurance was forfeited, and, under the rules
of the company, could not be revived with
out a certificate of good health, which it
was impossible to furnish. The attorney of
the family represented to the company the
hardship of the case, and the company, by
special action of its directors, suspended its
rules and restored the policy. The attor
ney, in presenting the case, said among
other things:
"Mr. Peleram has paid to you a sum which,
with simple interest, amounts to over $6,000.
He did this to insure his wife to the extent of
$15,000, against loss from his dying. His dying,
with the failure to receive the usual notice, has
prevented the prompt payment of the last pre
mium. Is it possible that the very event against
which Mr. Pelgram made such careful and ex
pensive provision, is Itself to defeat that pro
vision? Must wives leave the dying beds of
their husbands to look for insurance policies?
"I respectfully submit that life insurance is
far less valuable than the public generally are
led to believe, if forfeitures can be established
in such cases as these.
"When women or infants are the benefi
ciaries, a policy-holder would be obliged to se
lect very carefully his time in the year for
dying, and carefully avoid having too long a
last illness, or else his policy would be worth
less." No one "will dispute the claim put forth
by the Mutual Lile "to generous and hon
orable action" in the above case.
At the same time no thoughtful man can
fail to read aright the lesson so emphatic
ally taught.
A husband or a father has no right, if
it can be possibly avoided, to leave so im
portant interests, the fruit often of a whole
life's assiduous toil and care, dependent
upon the trncovenanted mercy of any body
of men, however humane and honorable.
The protection which the Mutual Life
extended to the family of Mr. Pelgram in
this special instance as an act of grace
and favor is extended, without any no
tice or application whatever from the in
sured, as a bight by

If Mr. Pelgram's policy had been issued
by the Mutual Benefit Life Insurance Com
pany, his insurance would not have been
forfeited by his failure to pay the premium,
as, under that Company's nonfobfeitube
system, his insurance wonld have been
carried in full porce for more than
twelve yeabs after his default.
The importance of a fair and just Non
forfeiture System-will be especially appar
ent when it is borne in mind that many
more policies are forfeited or surrendered
than are continued to maturity. According
to the returns made by the 29 Life Insur
ance Companies reporting to the New York
Insurance Department, the amount of in
surance terminated in 1887 by Death or
Maturity was $39,786,526; while the amount
of insurance surrendered for more or less of
an equivalent was $48,356,157; and the
amount of insurance absolutely forfeited
by lapse, no values having oeen allowed lor
same was $91,400,252. The total insurance
terminated by lapse and surrender in the
one year 1887 was therefore, $139,756,409 as
against $39,786,526 which actually came to
maturity.
The Mutual Benefit policy grants the
option of a paid-up policy lor a definite
amount, if the insured prefers a value in
that form to an extension of the fall amount
of the insurance. The Mutual Benefit
policy is also especially desirable owing to
its freedom from all restrictions upon travel,
residence or occupation after the second
year; and to its incontestability except for
fraud, which, of course, must be wilful and
intentional.
