So much comment was going the rounds
yesterday with regard to Representative
Laffertv's legislative bill conferring extra
powers upon passenger and raction railway
companies, and so many persons were dis
posed to criticise the anti-parallel clause,
that an authoritative statement, as to the
exact causes and scope of such a bill, was
sought at the hands of F. M. Magee, Esq.,
who, as a traction railway representative,
was known to be familiar with the situation
that seemed to require some sort of legisla
tive relief. To a Dispatch reporter yes
terday, Mr. Magee said that this, or some
similar measure, seemed to be absolutely
necessary to protect passenger railway com
panies that were at present acting under
laws which the Supreme Court had declared
inoperative. Clearly explaining the mat
ter, Mr. Magee said:
"Previous to the adoption of the constitu
tion of 1874, passenger and street railway
coroorations were rovemedlhv.and only op
erated under, special statutes.Xow,under an
amended constitution, no such special legis
lation can be enacted. Very -well. Phila
delphia, with her large population and al
most overwhelming influence upon all leg
islation, has heretofore

of a general art to operate in behalf of or
upon such corporations. The general laws
of 187&-S1 were changed by the Philadel
phia members of the Legislature so as to
confine their provisions to cities of the sec
ond and third classes; and it has been under
these provisions that the "West End, Union,
People's Park, Transverse, Second avenue
and Allegheny electric railroads in this
city and Allegheny were operated.
'"'Last fall the Supreme Court, in the case
of the Vilkinsburg Street Railroad, over
which a car was never run a little 200
suit that nobody supposed would ever
amount to so much decided and flatly de
clared the passenger and street railway acts
of 1879-81 unconstitutional, because they
were directly in the line of the special legis
lation forbidden by the constitution 001874.
"As organized under the acts of 1879-81,
there are about 52,000,000 invested in the,
stock and bonds of street and passenger rail
ways in Pittsburg and Allegheny. These
securities are held by all classes of citizens;
and the only way to render them valid
would be by the enactment of a general law,
authorizing the incorporation and formation
of street and passenger railway companies;
such act to contain a remedial section by
the terms of which companies incorporated
under the color of law and having letters
patent of the Commonwealth upon which
they were actually operating, could, upon
the surrender of the same, have

issued by the Governor. They could be
rendered "valid in no other way; and the
main object ot the legislation for the incor
poration and regulation of passenger rail
ways, now before the Legislature, was to
effect this result
"The limitation of 1,000 feet regarding
parallel lines of new railways was put in by
the Philadelphians, who are very largely
interested in traction and other passenger
railways, and who in fact don't want any
legislation at all passed on the subject. It
really doesn't and can't affect passenger rail
ways in Pittsburg, because no passenger rail
way could be built in this community, and
be made to nav. unless it rot into the down
town triangle of the city; and the streets in
that section are all occupied already.
"The object of the Philadelphians in put
ting in that clause? "Well, sir, it is simply
to prevent the possibility of -further compe
tition by passenger railwavs in that par
ticular city. It doesn't apply to Pittsburg
at all, as I have just shown; nor, indeed,
did Pittsburgers desire the limitation.
Their primary object was to render valid
the investments made in good faith by citi
zens of this community nothing more,
nothing less."

years from January L 1800, the streets, public
places and such public buildings as may be desig

operated and maintained for lighting public build

Uldders must snbmlt with proposals, general
and detailed plans and specifications of the pro
posed system of distributing the electricity, mode
ofsupporttng the lights and wires, and of safety
appliances.
Proposals must be made on blank formaand In
closed In envelopes furnished by the Board of
Public Improvements. The certificate of the
Treasurer ofthe City or St. Louis that the sum of
13,000 has been deposited In the treasury must be
inclosed with the proposal.
The right to reject any or all proposals Is ex
pressly reserved.
