THE " PITTSBURG ifrSPATCH; SUNDAY, ' JAOTABY" 20, 1889f ,i"? A DREAD PARALLEL Attorney Magee Explains a Phila delphia Bailway Kotion. PITTSBUEGEES WANT PROTECTION For Their Street Railway Investments, Kow Unconstitutional, MT OXLT QUAKERS FEAE TO COMPETE So much comment was going the rounds yesterday with regard to Representative Laffertv's legislative bill conferring extra powers upon passenger and raction railway companies, and so many persons were dis posed to criticise the anti-parallel clause, that an authoritative statement, as to the exact causes and scope of such a bill, was sought at the hands of F. M. Magee, Esq., who, as a traction railway representative, was known to be familiar with the situation that seemed to require some sort of legisla tive relief. To a Dispatch reporter yes terday, Mr. Magee said that this, or some similar measure, seemed to be absolutely necessary to protect passenger railway com panies that were at present acting under laws which the Supreme Court had declared inoperative. Clearly explaining the mat ter, Mr. Magee said: "Previous to the adoption of the constitu tion of 1874, passenger and street railway coroorations were rovemedlhv.and only op erated under, special statutes.Xow,under an amended constitution, no such special legis lation can be enacted. Very -well. Phila delphia, with her large population and al most overwhelming influence upon all leg islation, has heretofore OPPOSED THE PASSAGE. of a general art to operate in behalf of or upon such corporations. The general laws of 187&-S1 were changed by the Philadel phia members of the Legislature so as to confine their provisions to cities of the sec ond and third classes; and it has been under these provisions that the "West End, Union, People's Park, Transverse, Second avenue and Allegheny electric railroads in this city and Allegheny were operated. '"'Last fall the Supreme Court, in the case of the Vilkinsburg Street Railroad, over which a car was never run a little 200 suit that nobody supposed would ever amount to so much decided and flatly de clared the passenger and street railway acts of 1879-81 unconstitutional, because they were directly in the line of the special legis lation forbidden by the constitution 001874. "As organized under the acts of 1879-81, there are about 52,000,000 invested in the, stock and bonds of street and passenger rail ways in Pittsburg and Allegheny. These securities are held by all classes of citizens; and the only way to render them valid would be by the enactment of a general law, authorizing the incorporation and formation of street and passenger railway companies; such act to contain a remedial section by the terms of which companies incorporated under the color of law and having letters patent of the Commonwealth upon which they were actually operating, could, upon the surrender of the same, have SEW AKD VALID CHARTERS. issued by the Governor. They could be rendered "valid in no other way; and the main object ot the legislation for the incor poration and regulation of passenger rail ways, now before the Legislature, was to effect this result "The limitation of 1,000 feet regarding parallel lines of new railways was put in by the Philadelphians, who are very largely interested in traction and other passenger railways, and who in fact don't want any legislation at all passed on the subject. It really doesn't and can't affect passenger rail ways in Pittsburg, because no passenger rail way could be built in this community, and be made to nav. unless it rot into the down town triangle of the city; and the streets in that section are all occupied already. "The object of the Philadelphians in put ting in that clause? "Well, sir, it is simply to prevent the possibility of -further compe tition by passenger railwavs in that par ticular city. It doesn't apply to Pittsburg at all, as I have just shown; nor, indeed, did Pittsburgers desire the limitation. Their primary object was to render valid the investments made in good faith by citi zens of this community nothing more, nothing less." THEIR SHIP IN POET. A Skip Lond of Stone for the Poitoffice Building Arrives. Another section of the new postoffice will arrive in the city in a few days. That is, a ship load of stone from the Maine quarries has arrived in Baltimore. "Work on the building isroineon racidlv. although to those who have not the op portunity of getting behind a single board fence it seems that all work upon the build ing has ceased. ;AIvlEEBKKIMG yowpzz h THE E3T SPICED MOUNTAIN CAKE. (A delightful cake.) To the yolks of fiveeggi, well beaten, add ine cup sugar, one-half cup butter, one-half ;up sweet milk; one teaspoonful ground innamon, one grated nutmeg, then the vhites of two eggs, well beaten, one and a lalf cups flonr having in it one measure 'Banner" Baking Powder; bake in jelly ake pans; when cold spread each layer with in icing made of the whites of three eggs, eaten stiff, and one and a half enps wwdered sugar. The greatest success in baking biscuits, ea rolls, muffins, griddle and fancy cakes, s attained by the use of the old reliable Banner Baking Powder. If there is a lerfectlv pure, high grade cream-tartar in he market and one that deserves the pat anage of a discriminating public the Ban ter is without doubt such a composition. t seems to be the height of folly to trifle rith health by experimenting with every tew and doubti'ul baking preparation that omes along, and if you have been per uaded to test any of these cheap, worthless rawders with poor success, order a pound an of Banner with the Banner recipe boot rom your grocer and satisfy yourself is to he health! ulness and reliability of one that as been used in thousands of our very best amilies for almost a quarter of a century. Saturday next sees the end of our greatest of all busi- " ness ventures of giving away free every twentieth sale, no matter" what the purchase may be, and altho' we have, since the inauguration of " " this great and novel plan of ours, given away OVER TWO THOUSAND PURCHASES, we're willing to make the number r-" ' FIVE THOUSAND BY SATURDAY EVENING NEXT. The more the merrier, the greater the number the better we like it . There's no funny business or any "canoodling" about this offer of ours; it is perfectly legitimate and is carried out in the strictest, fairest and most impartial manner. No matter who the man, woman or child is; no-.;-raatter what the purchase may be, if it be a twentieth sale (if so it will be indicated by the sounding of a gong), the fortunate twentieth pur- -chaser gets purchase money back, goods for nothing, and our congratu-"'1 lations on being the lucky one. . "' WE'VE FURTHER IMPORTANT NEWS FOR YOU, WE TAKE STOCK FEBRUARY I. This means what? Why that in order to r educe our stock to the smallest possible dimensions we offer the most phenomenal bargains in Clothing, Hats, Shoes and Furnishing Goods ever seen; name lower prices than ever heard of before and undersell every competing house from 25 to 40 per cent. In doing these things a great concern like ours must of necessity cause much grief and many s orrows among merchants who pin their faith to "shams." Our whole policy is a standing rebuke' to imposition. Let us advise you: .:. BUY THIS WEEK IF YOU'D SAVE BIG MONEY. .:. . What is more, buy here. , Despite what other dealers say it is our busi ness to see that we are not undersold just as much as it is for us to give you goods which are reliable. We fear not hysterical advertisements from competing stores that are run on the "get all you can principle." Again we say, come and see us this week. GUSKY'S BECH'S t- ,'liiiiiiiinlli Oiillilliii!!
