The sudden discharge of the grand jury
by Judge Collier was commented on var
iously yesterday, but, by a large majority
of the rank and file of the people, and manv
officials also, favorably to the Judge. A
(.pecimen was given by a public man, who
said:
"You must not use my name, as I cannot
afford to quarrel with some of the people
interested on the wrong side.
"In the first place, the grand jury is an
institution which the people would not like
to have abolished, for it is a useful one, it
properly managed, but, of late years, every
one who knows anything about it knows
that some matters connected with it have
been infamously managed.
"In the first place, the grand jury is
drawn with the petit jury. The Judges
have a right to choose one-third of the
jurors, and sometimes they exercise it and
at others they do not. The Jury Commis
sioners are elected by the people, and they
only get 52 a day for their services. They
must make a canvass, and that costs money,
and in the prosecution thereof they neces
sarily fall under obligations to politicians.
It may be said that candidates have no busi
ness to allow politicians to get a pull on
them, but we must look at the state of affairs

"There should be some other method of se
curing jurors, and I think Judge Collier's
action will stimulate and expedite it. If
the Commissioners were appointed py the
Court, the Judges sense of responsibility
would be almost certain to work out better
results, and then the Commissioners would
be responsible to the Court. The improve
ment would come at once. "Were it not that
it might be held to be in conflict with the
spirit of our institutions. I would suggest
that the grand jury shauld be drawn separ
ately from the petit jury and only men
worth 510,000, or some other amount, be al
lowed to serve. Of course such a proposi
tion would raise a deafening howl of rage,
and would really discriminate against many
worthy poor men; but it would at least keep
bummers off.
"In this connection it is notamiss to state
that in Philadelphia, where the method of
drawing jurors is the same as here, the
grand jury disposes of an average of 40 to60
cases a day, and years ago the same celerity
was expected and realized here. Often the
jury made an average of 60 to 70 cases a
day.
"Another custom has grown up that
should be abolish promptly, that of the
grand jury visiting public institutions. It
is not authorized by law, and is an evil pure
and simple.

accomplishing nothing more than the
feasting of a score or two ot men periodi
cally. If there is anything crooked in the
management of an institution, an expected
visit of inquisitors accomplishes nothing in
the way of discovery. It simply admon
ishes recusants to sweep the dirt behind the
doors for a few weeks until the grand jury
has adjourned."
If the name of this gentleman could be
riven it would invest the statement with
more than ordinary interest, as he is one
T ho can speak ex-cathedra.
An attempt was made to get an expression
of opinion from Judge Fetterman; but be
was wary as to the main tacts in the "in
dictment" as manv people choose to call it;
but as to the junket he wos'dntepoken.' Said
he.
"There is no excuse whatever for that,

of the county per head for the visitors. The
grand jury in the infancy ot the custom
merely visited the County Home. After
ward the penitentiary was added to the list,
and then one institution after another until
it has grown into an abuse for which there
is no law At first the Home was visited
but once a year. By and by it came about
twice a year, finally quarterly, and now
many people have grown to think it a part
of the grand jury's function."
It will be seen that these visits cost the
county in salary alone some 51,200 a year
beside the cost of the dinners, and, esti
mating that at 50 cents a plate, which seems
to be quite reasonable, adds $300 a year
more, so that if Judce Collier's example is
followed by his brethren the county will be
saved 1,500 annually.

UNSAFE OVER A TUNNEL.
The Wyllo Avenue Colored Church Offered
to the Central Traction Company A
Power Honse May be Built There.
The trustees of the old colored church on
Wyhe avenue, near Tunnel street, have
offered the sale of the church property and
ground to the Central Traction Railway
Company. The price asked is $20,000. The
officials of the company now have the offer,
under consideration.
If the company purchases the property
they will raze the church and erect a
magnificent power house on the site It is
very probable that the power house will be
located at this point, or else on some other
lot between Tunnel and High streets. It
will be necessary to have two
power houses on the line; one at
the foot of the hill, 'near Tunnel street,
to run the cars from there to Market street
at a slower rate of jpeed than east of Tunnel
street, and the other house will probably be
where the stables now stand. The company
owns a large tract of land, bounded by
Herron avenue, Thirty-third and Madison
streets, and as they have plenty of ground
there, they will probably build the largest
power house on this site.
The only objection to the, purchase of the
church property is the fact that it stands
right over the Panhandle tunnel, and has
always been considered very unsafe. Owing
to the passage of heavy trains in the tunnel
the foundations in some of the oldest houses
over it have become loosened, causing the
walls to crack and settle Particularly was
this the case with the house owned by
George Glass at the northwest corner of
Tunnel street.
If the power house is erected on the site
of the church, the heavy cable machinery
will necessitate the setting of extra founda
tion walls.
The question whether the cable cars will
be run out "Wvlie avenue, instead of Center
avenue, has not yet been settled. It is)
thought that it will be necessary to secure
permission from Councils to allow the lay
ing of tracks on "Wylie avenue, if the latter
is decided upon. The work of constructing
the line will be started early in the spring.
WHY THEI RECOMMEND IT.
Finance Committee Reason to Make Alle
gheny Second Class.
The report of the Finance Committee on
the subject of a new charter for Allegheny
was submitted to the Councils last night.
It is a strong argument in favor of making
the city second dass. Messrs. Shiras and
Watson were consulted, but they agreed
with the opinion of the City Solicitor.
The committee points out certain evils in
the legislative act pending for the govern
ment of cities of the third class, as follows:
First, the Mayor would appoint all the offi
cers by ordinance except the City Clerk and
Solicitor, and would have almost absolute
control of the city's finances; second, the
city would go back to the old system of
ward collectors to gather the delinquent
taxes; third, all public improvements of
great moment would depend on the pay
ment of assessments by the property holders
directly affected, while the street and sewer
laws would be defective.
In a second class city the government
would be divided between the heads of
three departments, and the present charter
would remain Intact, except where modified
by the act of 1887. The committee claims
that the police magistrates would earn their
salaries from the lees collected.
