Thomas H. Davis, Esq., has prepared the
papers arid will this morning file them in
the case of Joseph Mickel vs the Peoples'
Mutual Accident Insurance Association of
Pittsburg. On the ISth of July, 1887, the
defendant company issued to plaintiff a pol
icy, or certificate, of membership, agreeing
to'pay to him $15 a week "if he should sus
tain bodily injuries which, independent of
all other causes, should prevent him from
prosecuting his regular occupation, and to
pay him the same sum during the continu
ance of such total disability as would immc-
however, 26 consecutive weeks from the tune
of accident. ,..
The plaintiff is a class blower and sets lortn
that on the ISth of October, 1SS7. while encased
In hisregular and ordinary occupation, cut tne
forefinger of his left hand on a class c.uinder
and was wholly disabled during 23 weeks, and

medical men that such was the case; that he
forwarded to the proper agent of the insurance

advisement, and that they were so held until
June 25, 1SSS, when plaintiff was informed by the
Secretary that the claim had been rejected by

There is a provision in the policy making a
death worth something like $3,000 to the repre
sentatives of the deceased, but interest hinges
on certain other provisions in the policy.
A TRAGIC HISTORY.
The Domestic Troubles of the McGearys
Recalled by n Decision.
About ten years ago Henry McGeary died,
leaving an estate valued at from SloO.OOOto
5200,000. His heirs were a widow and four sons.
Henry S . Marshall H., A. L., and Frank Mc
Geary. A few years later, and before the estate
had been settled np, the w idow died, leaving
an estate worth about $50,000. One of the sons,
Henry S. McGeary, was administrator of the
estates of both his father and mother. After
ward" one of the sons, A L. McGeary died,
unmarried, as it was supposed. Henry S. took
out letters of administration in his estate and
an amicable division of it was made between
the surviving brothers. This was followed by
Frank McGcnrv becoming insolvent and his
share in the different estates was purchaseu by
his two brothers.
Two j cars arter the death of A. L. McGeary
a woman, claiming to be Kate McGeary. tho
widow of A. L., came forward and presented a
will purporting to have been made by her hus
band, and leaving all his estate to her. While
the family had known of relations between A
L. McGeary and this woman they were not
aware of the marriage and contested the will.
The case went to the Supreme Court and was
finally deemed in favor of the w idow. She re
covered SliWJ from Henry S. McGeary, as ad
ministrator or her husband's estate.
The dav after the decision of the Supreme
Court in "the case was announced Henrv S.
McGearv committed snicide by shooting him
self. This was followed 6hortlv afterward by
the suicide of Marshall H. McGeary. who also
shot himself. The widow of Henry S. McGeary
took out letters of administration for the es
tate of her husband ana instituted proceedings
against the estate of Marshall H. McGeary to
recover the share of A L. McGear's estate
which Henry S as administrator, afterward
lial to refund to the widow of A L.
In this case Judge Over yesterday made a de
cree ordering the estate of Marshall H. to pay
S6,769 69 to the estate of Henry S. McGeary.
The case will probably be token to the Supreme
Court.
Tho Parochial School.
An answer was filed yesterday to the bill in
equity entered by Thomas Maxwell, against the
school directors of the First ward and Rev.
Morgan M.Sheedy, relative to renting a por
tion of the public school building to Father
Sheedv. The defendants in their answer deny
that Thomas Maxwell, the plaintiff, is a resi
dent of the First ward. They further deny
that the use of the said rooms is exclusive of or
in anv manner interferes with any use which
could possibly be made thereby for public
school purposes by the said school directors.
Grand Jury Work.
The grand jury yesterday returned the
following true bills:
George V. Backof en and Agnes Taylor, as
sault and battery: James Moorhead, nuisance.
The following bills were ignored: P Mc
Ineirny, Peter McGovern, and Link Morgan
roth, assault and battery; Anna King, assault;
Jacob Needy, false pretense; Elizabeth John
ston, selling liquor without license, to minors
and on Sunday; N. C Cowan, nuisance.

August Steisiki was convicted yesterday
of selling liquor without license, in the Twenty
eighth ward.
Cuaeles Bond yesterday pleaded guilty to
the larceny of an overcoat from C. H, Alters,
of Homestead, and was sentenced ten months
to the workhouse.
JomrW Fkiedmax yesterday entered suit
against John F. Maeder and James McGarty
for SLWX) damages, for breaking down the
fence and trees on bis property.
David Sax DS yesterday entered suit against
the borough of Scwickley for $0,000 damages
caused to his property by a change of grade in
the streets oh which it abutted.
Judge Hawktss, of the Orphans' Court,
yesterday dismissed the petition of the heirs
of the Rothman estate, asking for the removal
of the guardian, William Rothman.
Iw the Criminal Court yesterday, John
Harper pleaded guilty to burglary. He en
tered the house of C. W. Phipps, in Allegheny,
October- 23. and stole $150 worth of silver and
chinaware, which was afterward recovered.

TO ELEVATE THE KEYYSIES.
An Official' Idea of Licensing and Oversee
ing the Kids Conncils Will Try to Break
Up the Syndicates.
The newsboys are to be elevated, not by
the toe of a boot, as many would suppose,
but by Chief Brown with the aid of Coun
cils. "The plan is the same as that in vogue
in other large cities, and will be submitted
to Councils at next meeting.
The newsies will be registered, numbered
and duly licensed, and those not licensed
cannot sell. Those under 8 years cannot
receive a license, nor can those who are un
able to read and write. They will have
badges and be under police surveillance.
The bootblacks will probably be included
also.
In a talk yesterday Chief Brown said
that both boys and newspapers would be
benefited, for the former would be pro
tected and the latter would receive more
reliable service. He said some boys now
selling are scarcely 5 years of age, but the
worst feature is that many are controlled by
a syndicate of Hebrews or Italians who pay
them a few cents for selling. The boys are
frequently so ill-treated they fear to go
home.
He proposes to pay some attention to the
syndicates and some certain inhuman pa
rents. He wishes to compel them to send
their children to school if he possibly can.
HOW PEOPLE ARE ROBBED.
The Drtngcrons Game Played on Charlei
Wolfe.
"William Jasper, who was charged with
robbing Charles "Wolfe, a butcher of
Apollo, Pa., in a house on Clay alley about
two weeks ago, had a hearing before Alder
man Gripp yesterday, and was committed to
jail, in default of $1,000, for a hearing in
court. Mr. Wolfe was present, and testified
that he had met Jasper when he was in the
city two weeks ago. The latter enticed him
to the house, where Jasper and a colored
woman in the house succeeded in stealing
S1G5 in gold, some paper money and a gold
watch and chain from him.
Wolfe admits the crime, and says the
woman was to receive half the money, but
that he has not settled with her.
TO START AT OKCE.
The Western University Building Scheme
Acted Upon Yesterday.
The Board ot Trustees of the Western
University met yesterday to hear the report
of the committee appointed in June last to
arrange for erecting a school building. A
report was made as to the observations made
in other cities. At its conclusion the mat
ter was discussed, and at the committee's
suggestion it was decided to go ahead at once
with the new building.
The committee was continued with in
structions to proceed at once and procure
plans and specifications.
The resignation of Prof. Dausc, the Pro
fessor of French, was read and accepted.
EAPID TRANSIT.
On a Road Where the Cable Has Not Been
Introduced.
The team attached to car No. 43 on the
Pittsburg, Allegheny and Manchester road,
took fright yesterday afternoon on Beaver
avenue, near Brady street, Allegheny, and
run off. When near Washington avenue
the team and car collided with one of Clark's
sand wagons with such force that the wagon
was nearly demolished and the street car
mules were thrown to the ground.
The dash-board of the car was broken and
the driver, Thomas Williams, had his leg
crushed. One of the mules will have to be
shot.
TEAT FATAL 0SE CENT.
The Recovery of His Money Too Much for a
Conrt Litigant.
Prosperity was too much for George James,
the man from whom $14 01 was stolen a few
days ago. The court returned the money
to him and imprisoned the thief for three
months. George began to celebrate the
event, ending in the Central station with a
charge of drunkenness and $7 46 about him,
with that fatal one cent, with which he
couldn't buy anything worth while. His
costs will probably be $4 54, leaving him
with two dollars and that one cent with
which to begin the world anew.
Down on the Scalpers.
In an interview at the Union depot yes
terday, Judge Cooley, the head of the
Inter-State Commission, who was on his
way from Toledo to Washington, remarked
that he hoped all railroad companies would
cease to pay commissions for the sale of
railroad tickets, and so do away with
scalpers. He wants a law passed to that
effect.

A TAILOR'S JOKE.
How a Fifth Avenne Merchant Was Cured
of Drinking.
A number of jokers, including several of
the most prominent citizens of the Sixth
ward, victimized a Fifth avenue tailor on
Wednesday. On New Year's Day he got
glorious and suspended business. The people
residing in the vicinity were surprised early
Wednesday morning by the appearance of
a bow ot crape upon the door of the small
tailoring establishment. If there is one
thing many of the Sixth warders like better
than another it is a wake, and with visions
of a rally flitting through their minds they
stepped closer to the door to read the in
scription overthe crape: It was as follows:

he read the latter part of the notice his ire

To the Select and Common Councils of the City
of Pittsburg:
The undersigned Viewers of Street Improve
ments in the city of Pittsburg, aopointed by
the Court of Common Pleas, of Allegheny
county, and authorized by an ordinance passed
on the 1st day of March. A. D. 1888, a copy of
which is hereto attached, to make an assess
ment of the cost and expense of grading, pav
ing and curbing of Oakland avenue, from Fifth
avenne to Bates street, in said city, upon
the property benefited thereby, under-
the provisions of and in accord
ance with an Act of Assembly of the Common
wealth of Pennsylvania, entitled, "An Act au
thorizing and directing Councils of cities of tbe
second class to provide for the improve
ment of streets, lanes, alleys and public
highways, sewers and sidewalks, requiring
plans of streets providing for the appointment
of a Board of Viewers of Street Improvements,
prescribing their duties, granting appeals to
Councils and Court, providing for the assess
ment and collection of damages and benefits,
authorizing the use of private property and
providing for filing liens and regulating pro
ceedings thereon, and prohibiting the use of
pnblic streets without authority of Councils,"
approved the 14th day of June, A. D. 1867, re

That, having been first duly sworn and quali
fied according to law, tbey proceeded in the
manner and according to the directions of said
Act, to discharge tbe duties of their appoint
ment; that, having viewed the premises, they
made an assessment of said cost and expense
upon the property benefited, and caused a plot
and statemect'to be made, as required by said
Act, and having given to tbe owner of each lot
ten days' notice of the time and place of meet
ing, they met on the COtb day of December, A.
