federal election laws. Let it be admit
ted that a speedy trial ol the accused is
not only proper but commendable. No
fault is to he lound with the adminis
tration for an earnest endeavor on lis
part to execute the laws. Indeed so
tar as a display ol vigor in I hat direction
i concerto d it deserves praise rgper
man censure, But the history ol past
trial* of cases in the S.>uili similar in
character to those no* pending in
South Carolina, is not calculated to give
a-surance that the prosecution ofdeuiu
crats lor cllenses against the election
laws m thai section is intended to sub
serve the ends ol justice, but rather im
presses the impartial mtntl with an ul. a
thai It is to be made the instrument ol
revenge in the Hands nl defeated and
disippointed politicians. Tue Ku lilux
trails, it will li remembered, were the
tneiesi travesiiea ol justice. Innocent
men were made the victims of laws
framed to condemn and juries organis
ed to convict. Testimony drawn Ironi
t hw e xci I ed litis gi nations of superstitious
and deluded freedtneti was made to
satisly an ignorant jury and a partisan
court, in one notable instance the
evidence o! a negtess who had unsexed
hersell was sufficient to secure convno
lion. I tie men wlio fell under the ban
of this shameless judicial persecution
were thrown iuio prison, snrne of tlieui
never to come out alive and others to be
pardoned by a republican administra
tion which virtually conles-ed the harsh
ness ol the laws and the Injustice of the
courts by which they were deprived of
their liberty. Is history about 10 repeat
itself in these South Carolina cases and
must there tie another sacrifice lo the
Moloch of partisan hale? The testimo
ny already taken indicates that some ol
the witnesses fur the government are
accomplished knaves and it remains to
be seen whether the court and jury are
emulous of (he inlainy that will torcv r
damn the proceedings in the Ku Klux
trials.
Meanwhile what is the law of the
United Stales hi South Cirolma is or
ought to lie ihe law in New York or
Massachusetts, it negroes were ililimi
daled at the elections in South Caroli
na, while workingnien were treated in
a like manner at the polls in the north
ern states. If "tissue" ballols were
voted in O'Cotmr'g congressional dis
trict "Chinese ballots" were thrust into
the hsnds of the laboring men by die
tatoiial bosses in almost every nianufac
turing town in the north. If fraud and
corruption | revaiied in the southern
elections, they also c.irried h- Uay in
New York and Brooklyn and gave the
electoral vote of the Empire state to
Garfield and Arthur, it is not to be
argued that the wrongs committed in
the interest ol one political p.rty ought
to be condemned because there w#
equally flagrant violation of the law for
the benefit of its adversary, (lo the
contrary crimes against the purity and
freedom ol the ballot should fie punished
wherever perpeiraled no matter whoare
the guilty parties. The law should tie
enforced with perfect impartiality, with
out regard to locality or party politics.
This has not been done in the past.
Even when s conviction of a most des
perate and notorious offender was hnd
in the person of Brown, the Philadel
phia "twenty-timer,''a speedy pinion
followed through the clemency of a re
public, n president. There is plenty of
work for the federal courts in the north
ern states of a tiatuie bku that which
now engross- a the attention of ihp de
partment ol justice in South Carolina.

The federal office-holders in Ihe south,
too, are active in stiring up prosecutions
of democrats under the laws of the
United States. They find their account
in that tort of work in secttri ng fees and
in earning Ihe f ivor of the powers that
be. It is different in the north where
not even the republican* have yet learn
ed to regard the federal authority as
tbe be-all and end-all of civil govern
ment. But if the election laws of the
Untied Slate* are to be enforced in one
section of the country for the sake ol
enabling defeated partisans to wreak
their petty revenges, it will not I long
ere an effirt will be made to put them
in motion elsewhere at least lor the pro
tectlon of the ballot and tho punish
ment of scoundrels who are guiltier far
than the men who are now on trial in
Mouth Carolina.
