WAGNER'S 2,000 VICTIMS.
In Frederick county, Mil:, about
2,000 of the suite instituted by Dr.
Harrison Wagner, the professional lit
igant, against citizens of the county,
were settled, the defendants being com
pelled to pay various sums, ranging
from 850 to 875 iu each case. The
operations of Wagner are without a
• parallel in the United States. About
two years ago he was geuerally con
sidered to be harmlessly insane. Ilis
actions were calculated to confirm this
theory, ami his eccentricities were re
garded with indifference by every one
who knew him. In the fall of 1870
Wagner caused much amusement by
going before an obscure country mag
istrate, and entering several hundrid
suits for damages against leading citi
zens, chosen at random in all parts of
the county, who hud never seen or hud
auy dealings with him. The amount
of damages sued for in each for in
each case was between 890 and 8100,
the limit for which suits cau he
brought before magistrates in this
Stale. No attentiou was paid to the
supposed lunatic's suits, and the cases
were soon forgotten, but were several
times recalled to memory by notices of
hundreds of other suits beiug brought
by Wagner, who frequently entered as
high as one hundred claims against
one person.
Early in 1879 Wagner disappeared
from public notice, but in the fall of
that year the entire community was
thrown into a furor of excitment when
it was learned that Wagner had com
menced proceedings to enforce judg
ments in 1,800 of the suits. It was
then learned for the first time that the
Krsons sued, having failed to appear
fore the magistrate to answer, judg
ments had been entered in each case
for the amount named iu the com
lilaint. Wagner made no effort to col
ect the judgments until a year had
expired, when by law the power of
appeal had lapsed. In November last,
therefore, he was possessed of 1,800
judgments, averaging 875.00, against
about three hundred county residents
and corporations. Each judgment was
endorsed, "by default and "no appeal
taken," and of course they amounted
to a lien on any property owned by
the defendants.
During Wagner's absence several
persons against whom he bad obtained
judgmeuts died, aud his first move was
to file the judgments in the orphans'
court as claims against the estate.
Martin Shank, one of his victims, had
died and left an estate valued at
$8,500 to bis wife and three sruali
children. Wagner filed judgments
against the estate amounting to 80,200
and the orphans' court was compelled
to postpone the hearing of the claims
several times in order to avoid the
necessity of admitting their validity.
At length several citizens employed
counsel for Mrs. Shank, who filed an
application for an arrest of judgment
on the ground of fraud. The same
policy was pursued by all the other
victims, and since that time the cases
f have beeu dragged along in the court*,
the indications poiutiug to Wagner be
ing eventually successful in enforcing
all of them. The courts ruled that
the failure of the victims to contest
the suits was in law a virtual acknowl
edgment of the justice of the claims,
while the further failure to take an
appeal from the magistrate withiu the
period prescribed by law placed them
beyond remedy.
'After be had begun to enforce the
judgments Wagner found the county
hi) hot to hold him, and went to New
York city, where he now is. The pro
ceedings against his victims have been
carried on by counsel there, and the
settlement made in nearly all the cases,
it is thought, will net him nearly $lO,-
000. He does not pretend that he
had any legal claim for damages in
any of the cases, yet be has succeeded
id obtaining considerable portions of
the estates of several deceased resi
dents of the county, besides mulcting
hundreds of farmers of hard-earned
money.
LUMBER made of straw is a recent
invention. An exchange, describing
it sa j* : "The new material appears to
be capable of beiug worked under the
plane and other tools of the carpen
ters, and has the special advantage of
being free from knots and not liable
to shrinkage, swelling, warping and
splitting. The material, judged from
the sample, resembles hard wood in
appearance, being about as dark as
oak, but more dense in texture, and
with a specific gravity one-fifth great
er than thoroughly seasoned black
walnut. Its tensible strength is r*-
ported to be about double that of
of the same thickness.
