Counsel for Bergdoll recently began
action In the Federal Court in Kansas
City te obtain Bergdoll's release en
the grounds that he has served the
maximum sentence which could be given
a war-time deserter under President
Wilsen's1 proclamation of December 10,
1020. Under the previsions of the proc
lamation the senieiiee for ordinary de
sertion was limited te eighteen mouths.
Officials of the adjutant general's of
fice today said Bergdoll whs convicted
of desertion und sentenced before the
proclamation was Issued. If Bergdoll's
action is puMicu in tue Kansas city
courts, Government representatives will
argue ngulust his release.
