Jj. Lawrcnce Weber, Jr., remained un

through their attorneys, had assailed

The boy's father Is n theatrical man

MlM Edith Haller, the boy's mother,
'were married In 1018. Weber ob eb
Ulned a divorce In Buffalo and Miss
Bailer, well known en the stage and
in the movies, was married te Jehn
Dillen, motion-picture director.
Weber's decrce awarded te him the
custody of his (son, but Mrs. Dillen al
leges he subsequently entered an agree
ment undcfwhlch each would hnve the
j,0T tit months of the year. "Weber's
failure te deliver the boy te her at the
iinlratlen of his Klx months' period
mused Mrs. Dillen te kidnap him from
his nurse in Central Park.
lllsi Louise Gerllch, the nurse, told
hew two women suddenly jumped from
behind bushes. seized him and put him
in nn automobile, James Hughes, em em
nleved by Weber te guard the boy In
lust such en emergency, was with Miss
Gerllch.
"There wers some men In another
automobile and the enrs 6ped away
while Hughes gaye chase, calling for
aid," aaid Miss GcrJich.
Weber testified yesterday that he had
"a small private stock," but denied the
accuat!en of his former wife's counsel
that he drank te excess.
A clerk in the Hetel Laurelton,
where Miss Ilnller ence resided, al
leged he had heen her come Inte the.
Jietel intoxicated en several occasions.
At the previous henrlng Justice Burr
awarded temporary custody of the child
te Supreme Court Justice Marcus, of
Buffalo, who is staying with Weber at
the Idaho Apartments. Tn adjourning
the hearing until September 13, Justice
Burr continued the tempernry arrange
ment and directed that Mrs. Dillen be
permitted te vltit her bon nt all reason
able times.
On the stand Weber testified that

withdrawn when he married her.
