He knew that the law of West Virginia permitted him to do this, but he did not know about the "bone dry" law recently enacted by Congress for the purpose of preventing persons living In dry States from Importing liquor for their own personal use. At Kenova Mitchell was arrested by the Authorities and Indicted In the Bouthcrn dis trict of "West Virginia. The case was heard on an agreed statement of facts and there was no trial by Jury. The District Judgo acqulttod Mitchell and held that whllo the bringing of the liquor Into the Ktnto on his person was transportation of liquor, there was no phase of commerce connected with It and. therefore, thero was no "transporta tion In Interstate cominercn" within the Meaning of the "bone-dry" law. The District Attorney proposed an Imme diate appeal of the case. In order that tho United States Supreme Court might pass upon tho constitutionality of tho law, but the Department of Justice called a halt and directed him to drop the appeal. The de partment took the ground that the- Supreme Court was without Jurisdiction, In that an appeal In such a case, It being a criminal case decided against the Government, would amount to placing tho defendant In Jeopardy twice, contrary to the Constitution. Widespread Interest attaches to the case, which would Indicate a disposition upon the part of the Federal Courts to construe1 as legal the Importation personally Into a dry State of liquor Intended for the per sonal use of the man who brings It In. If this view is sustained, any person living In a dry State may go Into a wet State and bring back with him as much liquor for his own use as the laws of his own State will permit. In West Virginia and Virginia each person Is permitted one quart of "hard" liquor a month. Other dry States have different laws. GROUND IS BROKEN FOR SUBWAY LOOP Operation Starts on Locust Street "Leg by Excavation for Re-Laying of Sewers Ground for tho Locust street leg of the delivery loop of the subway high-speed transit system was broken this morning, when workmen began the work of open lng Locust street at Eighth for the relay ing of two sewers. One square at a time will be dono so as not to hamper property owners on Locust street too seriously. The paving for a distance of forty-flve feet on each end of tho afreet will be kept Intact dur ing the operation. The delivery loop will tun from Broad and Arch streets under Arch to Eighth, under Eighth to Locust and under Locust to Broad street, and will cost nearly $7,000,. 800. Contracts for the Arch and Locust streets sections are held by tho Keystone State Construction Company, which Is the concern of Senator McNIchoI.
