HUGH O'DONNELL WINS
SUPREME COURT VICTORY
pLouisiana's Highest Tribunal
Sets Aside Conviction and
Jail Sentence
Hush A. O'Donnell. Philadelphia globe
trotter, lecturer and newspaper business
manager, today won a Louisiana Supremo
Court decision that leaves him victor in a
battle which for months was the sensation
of New Orleans.
The court unanimously reversed a crim
inal court verdict which had convicted
O'Donnell of libeling Mayor nchrman and
the New Orleans Commission Council while
publisher of the New Orleans American,
last January. He was sentenced to four
months In prison after a trial In which
Mayor Behrman, Commissioner of Public
Safety Newman and other city omclals
we.ro witnesses.
During a city "clean-up" campaign
started by the American, tho paper pub
lished an editorial which alleged that the
Mayor and other omclals had taken part
In race-track deals In New Orleans. Mayor
Behrman, Commissioner Newman and the
other Commissioners promptly filed suit for
criminal libel. This step and the subse
quent moves In the American's "law and
order" crusado created a furore In the
city, which was alleged to bo honeycombed
with vice nnd misrule.
When Mayor Behrman waB called to the
Btand he admitted that he and others of the
City Commission had taken part in race
track dlckerlngs H. D. ("Curley") Brown,
owner of the Havana race track, testified
that he had met Mayor Behrman in New
lork and Chicago to arrange, In a "friend,
ly way," for Brown to race In New Orleans.
The O'Donnell libel suit Is said by racing
experts In New Orleans to have killed horse
racing In that city. O'Donnell called as a
witness a New Orleans race-track ofllclal.
who made admissions as to the manner In
which gambling was conducted at the track.
Following this testimony, the District At
torney prosoouted the racing omclals, ac7
cutting them of violating the State antl
oookmaklng statute, known as the Locke
law. Recently the officers wero found
guilty, with sentence suspended. It Is be
lieved that bookmaklng at tho New Orleans
track Is now a thing of the past and that
Its exodus marks the end of horse racing
there.

Services for Educator Held In First
Unitarian Church
Dr. J. Liberty Tadd, educator, author and
lecturer and head of the Industrial Art
School of Philadelphia, was burled, after
Jmple services at the First Unitarian
Church, Twenty-second and Chestnut
streets, at 11 o'clock this morning.
Services wero conducted by the Rev, Al

Dr. Clyde I King, chairman of the Gov
ernors' Trlstato Milk Commission, declared
that something must be done to
remedy the present acute milk situation In
this section, Ho also said that he was
going to tako up tho case aoon.
Milk dealers echoed thin statement, and
many of them declared that the publlo
would have to pay eloven cents a quart for
milk or the farmers would slaughter their
cattlo and sell them for beef. In that case,
these distributors asserted, thcro would be
a serious shortage of milk and that the sit
uation possibly might develop Into a famlno
If It wero not checked and corrected.
Doctor King hai been confined to his
homo at Springfield, Pa., for more than a
wock. During that time, ho said, he had
kept Informed on tho milk situation through
tho telephone.
"Just as soon as I nm nble," he said, "I

still selling on tho doorstep nt nino
cents a quait, but that an Increase to eleven
cents might bo exported bv July 1, or Phila
delphia would face the prospect of a milk

Baltimore anil New York distributors. It
was pointed out by these dealers, nro re
tailing milk nt eleven cents a quart nnd
paying tho farmers hern seven cents. This
puts tho Philadelphia distributor In direct
competition with theso outsldo factors nnd
meani a higher prleo on tho doorstep, or
no milk In this neighborhood In nddltlon,
tho prlco of meats hns soared to such a
figure that cows nro worth moro'ln stca't

C Henderson Supplre. a member of tho
commission nnd a largo distributor, said-
"Philadelphia and Pennsylvania must
pay a higher prlco to keep cows In the
bottles or else find them nil on tlie platter"

tion at AVllkes-Harrc. Tho record last
month was the largest In the history of tho
region, with tho exception of March this
year.
Aggregate shipments reported by tho
mlno carrier companies nmounted to 0,917.
625 long tons, an Increase, as compared
with tho same month last year, of 1,369,B2G
tons, exceeding April, this year, by 1..12B,
22G tons. Tho maximum record of March
of this year exceeded tho shipments of last
month by only 71,550 tons, or a little oer
1 per cent
Tho Heading Company led In May ship
ments, with 1,341.087 tons, tho record for
that company, with the exception of March
this year and October, 1912. The i.ehlgh
Valley's showing of 1,275,513 tons was ex
ceeded by that company only In April. 1915.
Tho Iacltawnnna nlso reported shipments
exceeding 1,000,000 tons, and made only
one tieuer rccuru, in .wnrcn of this yenr.
The Delaware nnd Hudson nnd tho I.ehlgh
and New Kngland companies both made
record shipments last month.
Tho total shipments for tho first five
months of 1917 have amounted to 30.C1S,
05G tons, as compared with 27,784, G90 tons
for the Bamo period In 1916 and 26.863.3SI
tons in 1915.

HELD IN $95,000 THEFT
Pittsburgh Restaurant Manager Indict
ed on Charges of Woman
PITTSBUnOH. Juno 12. Unable to fur
nish 125,000 ball, William C Hollowny,
manager of the Penway Restaurant, busi
ness agent for Mrs. Frances Clapp Hall, and
accused by her of cmbezllng $95,000 of her
money, was committed to jail.
An Indictment containing nine counts
was returned by the Grand Jury. Three of "
tho counts charge embezzlement by ngent.
three embezzlement by employe and three
larceny by trick nnd artifice. The Indict
ment Is based on three payments of money
alleged to have been made by Mrs. Hall to
the defendant, In tho sums of $50,000, $31,
000 and $14,000.
The Indictment alleges that Holloway, be
lng'the agent and employe of Mrs. Hall, was
Intrusted with this money for the transac
tion of certain business and appropriated it
to hlB own use. ,
