pany to construct, operate and maintain a
railroad track or elding on American street,

In the Thirty-third Ward.
Section 1, The Belect and Common Councils
of the City of Philadelphia do ordain:
That the Philadelphia and Reading Rail
way Company be. and la hereby, authorized to
lay and maintain a railroad track or siding
from a point ot connection with their eastern
most track on American street. Immediately
south of Indiana street, thenoe running south
on American street for a distance of about two
hundred and ninety (200) feet to the building
line of said American street and the property
of the American Ice Company, and continuing
on said building line to a point Immediately
north of Cambria street, as shown on plan on
file In the Bureau of Surveys (Department of
Public Works), Provided, That the work here
in authorized shall be done undei the super
vision and direction of the Department of Pub
lic Works (Board of Highway Supervisors) and
that aald siding shall be removed upon the
passags of an ordinance to that effect, with
out any expense to the City of Philadelphia,
and without any recourse for damage against
aald City, either property, personal or other
wise, and that the sum ot fifty (SO) dollars
shall first be paid Into the City Treasury for
the publication of this ordinance.
Section 2. It Is hereby understood and
screed that neither the purpose nor Intent, nor
the obligation of this contract. It and when
approved by the Publlo Service Commission ot
the Commonwealth of PennsyUanla, Is such
aa to Impair or In any wise afreet the exercise
by said Commission of any of the powers
vested in It by the Public Service Company

tion of a subway railway In Broad street,
from League Island to Olney avenue, with
the necessary branch lines northea.it and
northwest from Broad street, and the con
struction of an elevnted railway from Front
and Arch Mr-its to Rhawn street, via Front
street, Kensington avenue and Frankford
avenue to Rhawn street.
Section 1. Tho Select and Common Councils
of the City of Philadelphia do ordain: That the
Mayor, City Controller and City Solicitor, or
any two of them, be, and are ihereby author
ized to borrow, at such times and In such pro.
portions as In their Judgment tha best In
terests of the City demand, either by popular
subscription or from the highest bidder or bid
ders, by advertisement, at not less than par,
on tho faith and credit of the City of Philadel
phia. R sum or sums "which In the aggregate
shall not exceed six million (0,000,000) dollars,
to be expended ns provided for In the second
section cf this ordinance.
Section 2. The said sum of six million (A.000,.
000) dollars, Authorized to be borrowed by th.
first section of this ordinance, shall be used to
ward the construction of a subway railway In
Broad street, from league Island to Olney ave

as the lender may require, In the sums ot one
hundred (IP") dollars and Its multiples. In reg
istered or coupon form, and It shall be ex
pressed In the Mid lertlflratea that the loan
therein mentioned la payable In thirty years
after date thereof, and that the principal and
Interest on said loan ro payable in lawful
money ot the. United States, free from all
Surtlon 4. Whenever any loan ahall be created
by virtue of this ordlnsnce there is, by force
of this ordinance, en annual tax levied of six
per centum on the par value of. such certificates

enter Into contracts for the construction of
branch sewers on the east and west sides of
Delaware avenue, between Snyder avenue and
Mifflin street, and to enter Into contract with
competent pavers for the paving ot Delaware
avenue with granite blocks upon a concrete
base between the south side of Snyder avenue
and the north side of Mifflin street.
Section 2. That the Director of the Depart,
ment of Public Works shall advertise, accord
Ing to law, for proposals for the construction
of sewers and paving of said avenue, and th
contract shsll be awarded to the lowest re.
sponsible bidder, and It shall be a condition of
said contract that the contractor shall accept
the sums assessed upon and charged to pron
erty lying upon the line of said sewers tn
manner end form authorized by existing ordl
nances. The contract for paving shall contain
a condition that the contractor shall collect
the cost of paving from the owners of property
respectively fronting on aald avenue, provided
such charges shall not be more than the con
tract price, and shall enter Into an obligation
