Murder, father and son. This la the first
time In the history et the county where a
father and son sorved en the same murder
trial
The opening speech for the common
wealth was made by Win. N. Apple. After
referring te the case with which the Jury
was aelected, indicating test it Is an inpor inper
tant case, the speaker dwelt upon the enor
mity or the crime of murder. A man may
kill bis enemy, one may slay his friend lu
anger but when a son strikes down a lather
there is net langusge strong enough te ex
press the horror ene feels when hearing hi
such acrlme. In this oaae the defendant In all
the vigor of young manhood, atruck down
In cold blced his aged father who at the
meat had but a short time te llve. Ne one
witnessed tbe fatal blew but he who is
charged with the crlme. The common-
wealth has no direct testimony te oiier te
prove tbe oll'enee cbarced but a chain of
circumstances will be preved that point te
the deleudant as the slayer of his aged
father.

The facts as the commonwealth expect te
preve them are these: On December -1,
1SS7, Chrlstlau lludy upwards, of CO yeats
of two. wasau Inmate of the Lancaster
county almsheuse. On the morning of that
day between 0 and 10 o'clock iChristlan
Kudy left the almtbouse te visit his sister,
who lives In tbe seuthern section of tbe
eltv. He returned about neon and took
dinner. About 4 o'clock in the nflor nfler nflor
neon the defendant cime down the
front walk of the almshouse grounds
and asked for his father. Ills father
came out of the building and had a
abort conversation with him. The seu left
and the fAther went In te supper. Mr. Ap Ap
ple then described Iho buildings then being
orccted by Harry (I roll ou the Philadelphia

Christian JtuJy was murdored, and en
which buildings the defendant werked
as a carpenter. On the evening el Hun
day, the tth of Dccomber, tbe prlsoner
was seen loitering en the GrelT prom prem
ises by Mr. Frellch, who occupled
the heuBO adjoining Mr. Grefl and he was
also heard In G roll's ntable moving lum
ber. Ou the same ovenlng the deg of W. U.
Inman, who also Jives in the Bame neigh
borhood, was very restless and barked con
stantly. On the following morning when
Mr. Greir went te his house he saw Kudy
tbore. Hhertly afterwards Wohlsen's
wagon dellvered Heme lumber and Mr.
Gretr ordered It te be put in the stable
When the men icached tiie stable
Kudy wai Inside scraping the

Shortly alterwardi Kudy came te the
bouse where Grelt wan and Raid
down thore la my father ; he has
been murdered ; aome of theso
peer liouse prople killed him for his to
bacco and thlngM he bad. Grefl Bald te
him, "Ne ene would harm your old
father." Mr. Grell and ethers went te
where the body k.-ii and found bis coat
pulled ever his head, near him a Btone and
peel of bleed and net tar of his cane and
hat. Mr. Grefl went for the coroner and
Kudy went te the heuse. Whlle thore
Kudy raw that thore was bleed en his
baud nud cletticn, and with nn oath
said be did net knew hew the bleed get
there Kudy was taken Inte custody boeh
afterwanls and ledgod lu Jull. The peat
mertem examination showed that death
reiulted from novero blows en the back of
the head which fractured the Bkull.
At the conclusion of Mr. Apple's Bpeeeh
countel for the prlsoner suggosted that the
jury vlew the ptoraises be that they would

court adopted the suggestions and the Jury
went te the ground and wero Bhewu the

timony by Martin N, Brubaker, surveyor,
who made the draft et the same.

When the Jury roturnett te the court
room the (Humiliation of witnesses was pro pre pro
eoodeil with. The first called was Dr. Win.
Oompteu and his testimony was : 1 um n

been sluce 1851 ; 1 was aummoned by the
coroner en the morning of Dcccmber 0 te
held the Inquest en Chrlgtlau Kudy ; It was
about 11 o'clock when I get te the Grefl
propeny ; found Iho body of Christian
Kudy thore ; he was lying In a field en his
face ; thore was n wound en the back of
his head about "' inches long, through
the Bcnlp. The bone was fractured as
with a sharp Ins'ruineut ; the benes
at the base et the skull were crushed ; the
upper weuml.w as made with a tharp In
strument hut the lewer wound with a blunt
Instrument ; tbe wounds could ha ve been
made with mi nxe ; bU body was
cold ; It had rained the night be be be
tere and part of the bleed wes wnshed
from the wounds ; bis death was caused by
concueelen of the brain ; en inquest was
held at the tlme and a pest-mortem made
en the Wednesday following ; the body was
carrlod'frem the llelu te the stable, wbore
thejury vleweu It; the pest mertem was
made ut the heuse of ene of Kudy'arola Kudy'arela Kudy'arola
tlvei en Maner street; Dr. Davis tsalated
at the pest mertem.
Crees-esamlnid : I could net tell hew
long Kudy was dead when 1 saw him; hla
clothing was very wet; it had rained very
hard about 12 o'clock en Sunday night; was
net acquainted with Kudy; de net knew
that he was a paralytic; have no means of
knowing wbether the fracture of theskull
was offer death or bofero death; thore was
sufllclent fracture te have caused death; Dr.
Davis and I made a pest-mortem examina
tion afterwards; tbe defendant was net
present when tbe body was examined.
Ko-dlrect.- There was bleed en the clothes
of deccasie'1, and a peel el bleed about tbe
feet from whero I saw the body ; it took
aoveralblewB te break tbe Bkull as it was
brekeu ; it is bard te Eay whether ene or
mero blew swoie struck; paralysis would
net have followed such an illusion el bleed
as I found it ; deceased could net have ro re
celved such Injuriea by falling en the
ground ; bucu injuries might have been
roeelved by falling down an embankment ;
but there w as no embankment near whero
he was; the wound that caused the frac frac
ture of the skull cauecd the death.

lying en bis buck about 10 yards from Mr.

was when passing out the west avenue of

1837, Bt 4:30 p. m ; he was going towards
Gretl's new buildings ; he was in bis
usual health en that day; he was alone
when he left the almshouse ; he was an
Inmate for aome tlme ; he took supper be bo be
fere he left; aupper was eerved at i
o'clock ; he did net again relurn
te the almsheuse; his bed was net
uied en the night of December 4 I next
saw him dead en the next morning In
Fralich'a stable; he could meve around,
although affected some with paralysis.

was there when I came tbore ; cannot tell
without looking at the books hew many
lnmates there were at the almsheuse; we
had Germans, Irish, Heets and Americans
at the almsheuse ; the inmates et the alms
house and hospital come in contact with

seen Kudy In company with lnmates of the
hospital ; Kudy walked about with tbe aid

Kudy went affer he reached the turnplke

years past, though ber death was rather
unoxpectod. She leaves three sons,

Allen G. Thurmaa, a gentleman held in
the highest esteem by both political parties,
and statesman et learning, expenenee
