Toe Jauguage of the constitution
teems very clearly te include all damage
done that can be ascertained, and the
tribunal set down by the laws for the
ascertainment of damages is n jury.
There does net seem te be any geed
reason why a Jury verdict should net as
. definitely fix the damage dene te prop
erty by a structure in front of it us en
top of it. Evidently the supreme court
was net willing te trust such determina
tion te a jury nnd allow it discretion te
decide that damage was caused by an
elevated railroad fifty feet away from a
residence, lest a jury might go a mile
away te find damage ; and just as
clearly the Beading railroad com.
ptvny is net willing te take such
Jury risks. This is natural in the rail-
read company, but unnatural in the
supreme court. It may be bad public
policy te give a loose rein te a jury te fix
damages for publle improvements ; but
that is a question for the constitutional
convention and the legislature, and net
for the judges, who construe the law and
de net make it ; which they tee often
seem te think te be their duty.
In truth the people find it very difficult
te enforce their judgment against cor cer cor
erations ; and the state of Pennsylvania
J having a particularly trying time just
new. After the law makers have been
persuaded te execute the will of their
constituents, the courts ceme in te up
set it by a constitutional construction
that happens with remarkable regularity
te work against the people and for the
corporations. The Dauphin court has
lately been very freely knocking out the
corporation taxes assessed by the state,
in obedience, the judges say, te the latest
instructions of the United States
supreme court as te inter-state traffic ;
though it would seem te have been
better if our Judges had taken the
risk of deciding Jn favor of Pennsylvania
law, leaving the corporations te defeat It
With the federal bludgeon if they could
wield it en appeal.
The supreme court's declslenas te rail rail
read damages leaves the peeple of Phil
adelphia without redress for such dum
age. if they permit the railroads te be
fcailt; and even the legislature cannot
give it te them. It is net certain that
tee contract could be maintained be
tween the city and the railroad company, if
the latter should agree te pay the damage?.
Under these circumstances the city can can
net prudently allow the construction of
railroads that premise great damage te
private property ; aud se the very argu
sent upon which the supreme court
based its decision, namely, the need of
promoting public Improvement, should
reverse that decision. Public improve
ments cannot be permitted which de
net compensate injury dene te private
property. This Is old law and old seuse ;
and new railroad projects must remain
in abeyance until it is ie-e3tablished as the
law in Pennsylvania Justice Slerrett
was the only supreme court judge that
kept a level head in considering the
question. lie dissented from his associ
ates, holding that ".wherever there Is a
substantial Injury the constitution was In
tended te provide a remedy, whether a
part of the property was taken or net, and
this remedy was Intended te Include In one
action all injuries, whether from the con
struction or operation of public works."
"Which is a curious illustration hew ece

Democracy Thirty Years Age.
On taking his seat as president en
March 4, 1857, James Buchanan deliv
ered an Inaugural address, some portions
of which sound as if they were written
te-day. Then tee there was a menacing
surplus, of which the new president said.
' Our present financial condition is with.

ever before been embarassed from tee
large a surplus in the treasury. This
almost necessarily gives birth te extrav
agant legislation. It produces uiM
schemes of expenditure and begets a race
or speculators and jobbers, whose ingen
ulty is excited in contriving and proraet.

The first message of this honored Dem
ocratic president te the country is similar
in tenor te the last deliverance of the
present distinguished chief executive. It
is the old sound Democratic doctrine of
abolishing the surplus by letting it re
aia in the pockets of the people. In

sad : It, u beyeni an question the true
principle that no mere revenue ought te
be collected from the people than the
aawunt necessary te ittnj the expenses
of a wise, economical and efficient ad
ministration of the government."
This is the exact position of the Demo
cratic party of te-day, and this is the is
sue en which it will go before the people
and win in this coming election. A
proper modification of the tariff laws
with due regard te the Intmsts of cstab
lished industries and the welfare of the
American werklngman is what the Dam Dam Dam
ocrate in Congress are contending for.
And ihey will win the fight, because the
peeple are behind them.

College Athletics.
The overseers of Harvard college have
adopted by a two te one vote a resolution
te the effect that " an undue prominence
is new given te athletic contests in the
college, aud the excesses and abuses at
tending the came, and mainly Incidental
te inter-colleglate contests, should be
checked and guarded against for the
future." They therefore restrict the
athletic contests te Cambridge, where
Yale college is situated, or te some ether
Xew England town that may be desig
nated by the committee en athletics.
This action of the everseeis will cause a
howl from all theso who believe that one
of the best means of advertising an
institution of learning is te nurture
therein a chnmplen base ball or beat
club. But the course Is undoubtedly
right. Athletics are net the primary
reasons for attending college. Tiiey are
a mere incident which deserve encourage
ment, butwhich should never be per
mitted te entirely usurp the place of the
class room. Hereafter Harvard athle
tes will liave n chance te display their
powers throughout New England, ntid
this is n big enough grazing ground for
these with whom athletics ought te be a
secondary consideration.
