The suit of Christian V. Kendlgvs. lleerge
Oreaaman was attached for trial thla morn
tog. Thl case came into court aa an appeal
from the Judgment of Alderman Spurrier.
The facta of the case from the testimony et
plalntlfl were aa follews: On Novem
ber 21, 1SS2, the plalntllf purchased a
horse from. Gressman who gave him
agusrantee te buy back the horse In these
words, sold te-dsy te Christian Y. Kendlg,
a roan horse for Jit! A which 1 agree te buy
back en April 1, mt, for 1200, It he Is as
sound as he Is new." Kendlg lives near
Mlllersvllle, and a few days before the first
of April he met Gressman and told
him be would bring the horse in
en the first of April. Oreaaman told
him te wait until the 23d when he had a
ssle. On that dsy Kendlg drove the horse te
aressman's stables where he was examined,
and by Uresiman put In the stable. The
horse was effered for sale, but a sufficient
price was net bid for It and he waa with
drawn. After tbe aale was ever Oressman
requested Kendlg te take the horse home
again and keep him two weeks longer, which
was done. On the 2Stli of April the horse
died, and Kendlg nude demand for the 200
which Oressman agreed te pay for the horse,
lie was put cU from time te time and finally
he brought this suit.
The defense waa that when the horse was
returned by Kendlg A Oreaaman It was net
In as geed condition m when Beld and that
he was riot bound te buy It back for that

burglars. They prlrd open one of the bsck
shutter-, with achls3l or Jimmy and went
directly Inte the barroom, where they stele
72.25 from the money drawer. They then
went through the house, ransacking all the
drawers and cupboards, but did uet steal
anything else. They made an ell'ert te get
up stairs and succeeded in breaking one belt
oil the deer. They were unable te move
the ether, se they remained below. This
morning a large butcher knife which had
been taken from one of the drawers was
fenud lvlng en a down stairs table. It is be
lieved that the thief had armed himself with
this lu order te be prepared In case he was
discovered while in the house.

president, trustees and cashier of the bank

In the vaults. Cashier Kelly, who la also
treasurer of the Mutual Fire Insurance com
pany, en Monday went te Kennebunk te
leek after a fire less and left McNeely te
finish up the day's accounts. When Kelly
opened the bank Tuesday he found that

pleted and McNeely was -absent. President
Ooedall waa notified and an examination of
the sates followed, when the theft was dis
covered. President Ooedall this morning said that
as the less is much less than the surplus the
bank will be perfectly sale. Hank Examluer

arrive. Detectives have been sent In all
directions. It 1 said that McNeely went te
Bosten and there took the beat for Yarmouth,
N. S.
