The llr-!!tat (Jommlsslen forbids Discount
te lrg Hhlpnsrs.
The Inter state commerce oem mission ha
rendered It decision In the complaint of the
Providence otaileompany against the Prevl
denee .t Worcester railroad company, Thl
la the case where discrimination sgalnst
smalt shlppers wa altoged, In the shape of a
lu wr cent. Jlsoeunt te hipr of ever
;W,Wil annually. It wa also alleged that the
coal company wa discriminated against by
the rale being llxed at the same llgure from
both Providence and Kast Providence. The
opinion I a voluminous document, prepared
by the chairman, and has the amour rem of
all the commissioner. It says :
The llrst question of importance that arise
concern the eiler by defendant et a 10 Ir
cent discount te any person, linn or coriiora ceriiora coriiera
tlon who within any one year shall recelve
consignment of coal aggregating UO.Utsi tens
at any one station.
A discrimination audi a the offer and Its
acceptance by one or mere dealera would
create must have a necessary tendency te
destroy the businesselsmalldealera. Under
the evidence In the case It pKar almost
certain that this destruction must result, the
margin for prellt en wholesale dealing In
coal being very small. The discrimination
Is therefore necessarily, unjust within the
meaning of the law. It cannot be supported
by the circumstance that the eiler 1 open te
all ; fur though made te all It la net possible
that all should accept. Moreover, In letting
such a discrimination we must consider the
principle by which It must be supported and
the prlnclpie that would support a ao.dei) ten
limitation would support one of Mi.Uiu or
I W,oeo equally well ; the quantity named
would be arbitrary In any case H might
easily be made se high as practically te be
open te the largest dealer only. A railroad
company if allowed te de se might In this
way hand ever the whele trade en Us read In
Heme necessary article of commerce te a single
dealer, for It might at will make the discount
equal te or greater than the ordinary prellt
In the trade: and competition by these wbe
could net get the dteceunt would obviously
be then out of the question. The Injustice
would be equally manifest ifseveral dealer,
instead of one, were able te accept the etfer.
A railroad com toy has the right, by any
discrimination uet grounded In reason, te
put any single dealer -whether a large dealer
or a small dealer te any Mich destructive
disadvantage.
The comiiilaslen does net mean te bs under
stood as Intimating that detendaut Is net savi d
something In cost and in labor by hav lug the
coal carried by It received In large quantities
by singlu couslgneoK, ()u the cutitrary, it is
readily agreed tint lu service ler large
dealers Is somewhat less In proportion te
quantity of freight transported than is the
like service porlenned (or small dealers. It
Is also agreed that defendant may, therefore,
seem te have an interest In restricting Its
dealings be far en lawsteiu te large dealers.
Hut this Is an intureHt that can only be con
suited and acted upon In strict subordination
te the rules of law ; and one of the most im
portant of IhOHe rules is, that In any discrim
ination betwten dealursjustlce, it net a par
amount consideration, shall at least be kept
in view. 1 he carrier cannot regard Its own
interest exclusively If it could It might al
