136 peunde of flour were stolen.
Tee principal wltnem for the prosecution
wan Levi Marthall, and he testified that he
lived In one part of a houae In Earl town
hip and the aecuaed In the ether. On tlie
evening of the robbery he overheard a con
venation between I'atterj, hla own eon and
Calvin Davla, In whleh it wa Agreed te rcb
Brnbaker'i mill. He concluded te watch
and he waa rewarded by seeing these three
men leave Fatten'a beuse, go te the mill and
return te Patten'e heum with the flelr stolen
there, which waa divided between tbm.
The aceuaed went en the witness stand
and denied all of Marshall's allegations. The
eaae waa submitted without argument te tl e
Jury and they rendered verdict or guilty,
after a brief deliberation.
iiewla Falser waa Indicted for forging thn
the name or William Dyer te n Judgment
note for (24. Tbe note was dated March 12,
1880 and waa payable In sixty days. Lxecu
tlen waa Issued en tbe note, Oyer's persona!
property was levied upon by tbe sherltr and
byer then paid the note, but en the same
date entered suit against Felser for forging
his name te the note. The nole for J2I was
submitted te Dyer en tbe witness stand, nnd
he pronounced It a forgery, his name net
even being spelled correctly. Thodefenxe
was that Felser and Dyer had a horse trans
action In which Dyer waa te ctve 20 and
hla horse for Felser's horse. In addition
Dyer owed him M balance due en a sewing
machine and In paymentef this Indebtedness
Dyer gave him this Judgment note for $21, In
tbe presence et witnesses. Heme days alter
warda Dyer gave Felser another note w 1th
his mother as surety, and told him that be
could get the money out of the ML Jey bank
and when he get the money he was te return
tbe Judgment note. Felser went te the bank,
but they refused te give him any money en
the note. 11 e waited some time for Dver te
pay htm the Judgment note and finally
Issued execution en it, and after Dyer's prep
ertywas levled upon, tbe ne'c wa paid.
Jury out.
Friday Evening. Court re-asscmbled at
7:30 o'clock and the Jury in the Lewis Feler
r forgery cue rendered a verdict of net guilty,
with county for costs.
Henry Selverllng was put en trial en a
charge of embezzlement. Frem the testi
mony en the part of tbe commonwealth !
appeared that James Ream, a cigar dealer of
Vogansvllle, employed the defendant in the
nummereriSSA te sell clears for hi in. All
moneys above ?I2 per thousand received ty
Selverllng was te be bis. The defendant
was furnished with 10,400 cigars which he
sold. He returned te Keaui (19.lt and ap
preprlated the balance te his own use.
The defense claimed that Selverling
sold only 4,100 cigars en commission
and tbe balance of the cigars weie
purchased direct from Ream and he was
unable te pay for the same by reason of
losses In business. It wasdltBcultteget the
defendant te glve an Intelligent account et
tbe transaction between tbe parties and the
Impression from bis testimony was that he
was net of sound mind. On trial.
Saturday Morning, Court met at 0 o'clock
and the Selverllng embezzlement case was
argued. Tbe Jury rendered a verdict of
, guilty and recommended him te mercy.
In the perjury case against Jehn Miller, a
verdict of net guilty was entered, tbe district
attorney stating that the case could net be
rmJe out.
A verdict of net guilty was entered In the
case of commonwealth vs. WIntield S. Hayes,
horse stealing. This case was tried at tbe
Ustsossien and the Jury, altera deliberation
of 42 hours, reported that they were unable l
agree. The district attorney stated that he
did net think tbere could be a conviction
under tbe testimony, en account of the doubt
as te the Identity of the man who hired the
horse.
A similar disposition waa made of tbe
Reduction case in wnicn Lyuinn isnzer was
the defendant.
Abraham S. Kauflman was put en trisl
for committing an assault and lattery en J.
J). Randall. The prosecutor testified that he
was getting a drink of water at tbe pump In
he rear r tbe Franklin house, this city, en
tbe evening of July 3d. when Kaullman
tlrevu Inte the yard. Witness and Deme
frienfs did net get out et the read as quick
as Kauflman thought they should and that
made him angry, and after be put his horse
a ay be walked te where prosecutor was and
struck him.
The defense was that after tbe liery of
Kauflman was put away, Kautfuian walked
towards the hotel and Randall approached
him with an uplifted rane In bis band and
Kauflman believing Randall was going te
strike him knocked blra down. A dozen
witnesses who knew Kaallman for many
years gave him a geed character for peace.
The Jury rendered a verdict of net guilty,
and divided the costs equally between the
prosecutor and the defendant.
bURETT AND DERCr.TIO.S CASES
Leah Cenner was charged by Sarah Ster
rett with having threatened te " knock
damnation " out of barah Sterrett In June
last. The parties at tbe time lived in the
neighborhood of Christiana and Mrs. Sterrett
was a tenant of Mrs. Cenner. Dismissedwltb
Leah Cenner for costs.
Mary Cenner, a daughter of the defendant
in the previous case, wis charged by the
same presecutrix with making similar
threats en August 12th. The case was
dismissed Tilth costs divided between the
parties.
Mrs. Sterrett, tbe presecutrix iu the abeve
cases, was put en trial ier threatening the life
of Mrs. Cenner. The presecutrix testified
that Mrs. Sterrett en a number of occasions
said she would kill her, If she had te hang
for It. This case the court dismissed and
directed the defendant te pay the costs. The
order as te Mrs. Sterrett was reconsidered te
give her an opportunity te ral'e the costs y
next Saturday.
The surety of the peace cases against Henry
Hchied and Henry HUdebrand, were (ill
missed with county for otllce costs.
Tbe desertion case against William l .
Christ was continued te gie the parties an
opportunity te reconcile their dlllerences.
J extend Miller was charged by Samuel
Miller, of Liberty Square, with hating
threatened te sheet him if he blots ed en him
for attempting te burn his father's barn. Tbe
accused denied having made the threats. The
court directed him te enter bail in the sum of
foOOtekeep the peace, and pay tbe co its of
prosecution.

Frank Beyd,w he pleaded guilty te stealing
6,100 cigars from the Ephrata station and was
convicted of stealing two horses, was sen.
tenceed te underge an Imprisonment In the
Kantern penitentiary for tbe period of thru)
years and three months.
Jehn I'atten, who was convicted en Jeur
charges of larceny and one of felonious entry
was sentenced te undergo an lraprUenmeut
in the Lancaster county jail ler two years
and n half.

ing. She was reprimanded for falling te at
tend court after she had been duly sub-rcr-naed

was paid and Jennie was released Irem cus
