Tuesday morning William Knox, of Knox .V
Reed, and counsel for the P. . iu K. read,
presented affidavits te the effect that Colonel
J. M. Schoenmaker, ene of the directors et
the P. & L. K. read, who Is new absent In
Europe, would net be aile te get home In
time for the trial ei the suit of McGrann
against tbe P. A L. 11 read, which was fixed
for the 21st Instant, and he asked that the
case be postponed until some time In October.
Jehn Oalzeli. esq., counsel for McUrann,
exhibited a written agroemeut, Bigued by the
counsel en both sides, te try the case en the
date fixed. He charged the counsel for the
railroad with seeking a postponement In
order that it might net be considered at the
present session of the supreme court should
an appeal be taken.
Mr. Knox said that Mr. Schoenmaker was,
an important witneas, and had been cable
grained te come home. It the court would
postpone the case until the Urst Monday In
October he would be responsible for the pres
ence of Mr. Schoenmaker at that term.
Judge Ewlng granted a postponement until
the first Monday In October.
