He Did Net Tell Them.
Mr. Jehnsen presented his bill te coun
cils last evening and asked for its payment;
which was a veiy proper thing for him te
de. But we de net observe by the proceed
ings that he informed councils that he had
already paid himself the amount of the
bill : and common council does net seem te
bave been aware of it, since it passed a
resolution approving the bill and directing
the mayor te drawn warrant for its pay
ment. Select council seems te have known
better, and refused te adept the rese
lutien. It is tee manifest for dis
pute that Mr. Jehnsen has no
claim te the money in his hands
until councils approve his bill. lie admits
this by asking the approval et his bill.
And yet he holds the money which he peti
tions councils te grant him. The position
is absurd. Councils can pay no attention
te Mr. Jehnsen's bill until Mr. Jehnsen
settles.

A meeting et the city councils was held
Wednesday evening.
In select council the following named

The following petitions uere presented
and referred :
Te grade Kast Walnut street, Ivetween
Hblppen and Plum : te lay water pipe en
Ltuie, betwten Kast King and Walnut; te
grade and gutter Kast King street beyond
Franklin ; te pave the tint half square In
North Duke street with aspballum or ether
noiseless pavement. This last petition was
signed by the Judges of the court, the mem
bers of the bar and the county officer.
A reoelutlon attached te It, which was
adopted by select council, directs that the
work shall be done, and Messrs. Riddle and
Berger were appointed a committee te confer
with the county commissioners te have the
curbs reset and the pavements repaired.
The monthly rejierl of the street commit
tee was read. It contains no Important
matters that have net already arpearea In the

An ordinance, prepared for the considera
tion of councils by the beard of health, re
quiring burial permit te be obtained and
prescribing penalties ler neglect of com
pliance with the Baine, and ale fixing the
nulary of the secretary of the beard of health
was read once and laid ever under the rules.
The deeds made by Jacob Oriel, sr., and
Jacob I Frey te the city for certain lands
taken for opening streets were read and ac
cepted. Common council concurred.
On motion or Mr. Riddle he niitter of
directing the telephone company te take their
wires from the city poles, was postponed In
order te allow the Ore committee te leek up a
contract between the city and the telephone
company in which It Is claimed the latter lias
a right te de as they have been doing.
Trem common council was rocslved a
report of the finance committee containing
extracts from the minutes of the committee
detailing the action taken by the committee
te reen er rrem J. w. J onnsen, ex-city solici
tor, certain moneys belonging te the city and
Improperly retained by htm until a few days
age. Accompanying the report was a bill
from Mr. Jehnsen for extra services, amount
ing te 350, which the commlttce refused te
allow without the sanction et councils.
Common council having voted te pay the bill,
Dr. Bolenlus moved that (.elect council con
cur. Mr. Berger demanded the yeas and nays.
Dr. Belenlus held that as the ordinance de
clared that the city solicitor shall receive no
pay for his services except bis specified sal
ary was passed fourteen years age, and as In
the meantime e'.her solicitors had received
extra compensation It was only fair that Mr.
Jehnsen should also be paid, especially as the
city Is crewing and the business el the solici
tor's elnce Increasing.
Mr. Berder Bald tuat the city had already
paid Mr. Jehnsen FJOO extra during the past
year.
Mr. Riddle asked Pr. Bolenius te uame
any city solicitor who had received extra
pay, and the ameut he bad received.
Dr. Bolenlus did net bae the figures, but
named some cases In which be understood
that former solicitors had been paid.
President Kvans explained that the moneys
bsd net been paid te lermer solicitors, but te
assistant counsel engaged In the, trial of
important cases in which the city was In
terested. The yeas and nays being demanded en a
motion te concur In the action of common
council (te pay Mr. Jehnsen's claim of iiiO)
the vote resulted as fellows :

In the absence of the chairman, Mr. Baum
gardner was elected president pre lem, and
he called the meeting te order, the following

Eberman, Trailer, Ceedell, Oretf, llarnlsh,

Mr. Kbermaa presented a petition accom
panied by a resolution, asking that the name
or Arch alley be changed te Arch street. The
resolution was adopted,
Mr. Hershcy presented a potltlen for a
gutter en the weitaldel Mary street, from
West King te Grant strcet, Referred te the
street committee.
Mr. Cummings presented a petition asking
for the grading and guttering of Cherry alley
for one-half square north of I.emen street.

Mr. Moere presented a petition for a cross

which was referred te the street committee.
The report of the finance committee in
reference te the difficulty with ex-City Soli Seli Soli

clusion Mr. Cormeny Bald be bad a bill In
his band of J. W. Jehnsen for extra servlces
and as he bad examined Inte the matter and
found ether solicitors bad been paid for
similar services, be moved it be paid.
Mr Moere requested that Mr. Jehnsen, who
was outside, be invited te appear before
council and make a statement if he desired
te de se.
Mr. Jehnsen wassent for, and pending bis
arrival, Mr. Eaby called for the read leg of
the ordinance regarding the fees of the city
solicitor.
When Mr. Jehnsen arrived be said In ex
pUnatien of bis bill that he was only follow
ing the practice laid down by councils allow,
leg former solicitors pay for extra services
performed under the same ordinance under
which he was working, lie read from
printed reports of the tlnance committee
showing where such fees for extra services
had been allowed and paid, and said that In
making up his bill his sole care had been te
make it small rather than large.
After Mr, Jehnsen retired the motion of
Mr. Cormeny was put and carried, with only
two or tbree dissenting vetes, and the mayor
was instructed te draw bis warrant for the
amount of the bill. Select council non-cen-curred.
The report of the city treasurer for the
month of August was read. The report
showed total receipts, tl37,402.07 ; total pay
ments, fSl,S7.M ; balance In the treasury,
156,103.43.
The report of the water committee for the
past month was presented by Mr. Cummings
and read.
The report et the flre committee was read.
The committee oaked for authority te pur
chase new heaters for Nes. 1 and 3 engine
houses, the old ones being entirely unfit for
uae. On motion et Mr. l.berman the com cem com
tclttee was authorized te make the purchases.
Select council concurred.
Mr. iUumgardner presented n petition
from the Judges of the courts and nearly all
the members of the bar, asking that the city
lay a new nelaeless pavement en the first
half eftbe square of Duke street, between
Kast King and Orange streets. Tlu petition
was accompanied by a resolution instructing
the street committee te lay en asphaltum or
composition pavement In the hair square
mentioned, provided the county of Lancaster
bears one-half the expense, ana provided the
property-owners en the uast side and the
county or Lancaster en the west side of the
street retset their curbs according te the direc
tions of the city regulator. The resolution
was adopted. Select council concurred.
Mr. Leng presented an ordinance imposing
a tax en Itinerant doctors, surgeons, etc., who
shall practlce their profession for money In
the city limits. The ordinance fixed the tax

Hew It Is still possible te use the vague
charge of conspiracy te punish men for strik
ing Is shown by a recent caw in Washington
oeunty.
During a strike last fall en one the peels
of the Monongahela river, n body of miners
from one eftbe ether peels came up In a
steamboat with a brass band and paraded
around the mines while a committee urged
the men who had remained at work despite
the strike te come out and Joia them. Dar.

curred, and a couple of the men who bad re
fused te join the strike were assaulted,
though, as It seem, without serious conse cense
quencee. This was tnade a pretext for n
charge of conspiracy against the principal
men in the strike. Informatiens were sworn
out by a coal and-lren ellcemau, and a
large number of the men who had been

and theso who could net give ball committed
te tall. The strlke proved a failure, the men

the old price. But the companies were
determined te take the opportunity te pun
ish the rlngtettders, and Irtuslly prosecuted
the case, employing three lawyers for the
purpose. On their part the mluerx secured
the services of W, J. Urvnnen, of Pittsburg,
and two lawyers of the county. The
cases were tried at the county ieat In
the agricultural part of Washington county,
in May. The only miner en the panel
was peremptorily challenged by the prose
cution, and the Jury was inade up
almost entirely of farmer, who in this part
or the country, it net throughout the state,
have a class prejudice against miners and
miners' strikes, which rodiice tbe market
for their produce, and as some of them think
Increase the tendency of poultry, etc, te
mysteriously disappear. The cases as te
some et the men indicted were dismissed by
the prosecution, tint real reason being, It
is said, that the men were or use politically
or owed money te the companies and tw enty
seven were put en trial. Agtlnst three of
these neevidence whatever could be adduced,
and In their cases verdicts of net guilty were
entered during the progress of trial by
direction of the court. Oae of the men thus
released bad already lain in Jail ler fourteen
weeks, another for se en weeks and In the
case ofthe third It was shown that be bad
been working In Ohie ter nearly a year, and
had only returned te Pennsylvania a few
days belore the grand Jury had found n bill
In the case. Yet his name bsd been Inserted
In the Indictment without any preliminary
bearing, and he bad been taken out of his
bed at midnight en a bench warrant, and had
lain In Jail until the trial. Ouly two et the
ethers were In any way connected by the
evidence with the violence, but the theory of
the prosecution, enforced In the charge of the
Judge, was that the lolcnce was a result of a
conspiracy In whkb all who took part In the
miners' strike and meetings were concerned.
It wai proved as te some et thorn that they
were net even In the neighborhood when the
violence occurred, and that their ceunselshad
always bten against force or threats of force,
and eue of the things Incidentally shenn
In the trial was that the strlke In Us Incep
tion had been encouraged by the principal
mine owner, wne ai mai uuie imu a consid
erable stock of ccal en hand. The twenty
four were, however, all found guilty in a
body, and with one exception were all pen
tenced te eight months imprisonment s. lib
bard labor. The exception was in the case of
a man who was in the last stages of con cen con
sumptien, and who was cendemned te six
months imprisonment in tbe county JalL
Among the men thus sentenced were a num
ber who bear the very highest character in
their neighborhoods. One et them, a
veteran of the war, In which he was
wounded himself, and lest his father and two
brothers, and who bas a wife and eight
children dependent upon hltu, was connect
ed with the conspiracy only by the mak
ing of a speech In which, whlle he sup
ported the strike, be had been careful te
warn the men against any Infringements of
the law ; another is a Methodist local preach
er, a devoted Christian and ardent temper temper
ance advocate. Snch is the reputation of
these men, that the deputy BherllV who took
them te prison te serve out thelr sentenees,
allowed them while waiting for n train in
Pittsburg te go about the town en their
premise te return. What tney were really
convicted of was net violence or locltlncte
vlplence, bnt participating In a strike,
which by fiction of the old Lngllshconsplr Lngllshcensplr
acylaw ia made te Involve all who parUcl
pated In It, in an ollenso which was only an
accidental incident After scriug out about
