H. M. North, attorney for the Pennsylva
nia railroad company, filed a bill in equity
against Stephen Newhouse, Henry Massey
and Geerge W. Ramsey, supervisors of
Kadsbury township. The bill seta lerth that
the supervisors threaten te cut down tbe em
bankment at the Newport read crossing at
the Gap, te the grade of the railroad tracks
and te open the said Newport read crossing
at the grades erthe railroad tracks ; that such a
proceeding Is without any legal authority and
the grade crossing at said point where the
railroad is en a sharp curve, would be
dangerous te travel both en the public reail
and en the rnilread, and the said crossing is
unnecessary because there is an overhead
cresHing within a shertdistance thereof, made
by the said railroad company which changed
the alte or the said Newport read at said
crossing. The railroad company prays that
an Injunction be granted restraining the said
supervisors from interfering with or attempt
ing te restore or open aald Newport read
across the Pennsylvania railroad until the
final hearing. The court granted a prelimi
nary injunction.
