terest opponents have conceded his geed
qualities and praised his Btreng points.
Much that has been true has been fitly
said ; much that is new has been called out
for the enrichment of history and biogra biegra
nhy, and seme tilings that me false and in
111 taste have marred the solemn ceremony.
But the heart of the whole pcople is
stirred te profound sympathy with the
event of te-day. The spectacle in the me
tropolis of the country is one that nil its
many millions of citizens view with inter
est, and the accounts of the ceremonies
will be read with eager attention by the
people of all the civilized world. There
may have been intelligent desire and rea
sonable expectation that le&4 pomp and
simplicity would have marked the inter
ment of tlie citizen soldier and president,
but te the popular mind and te the foreign
view Gen. Grant embodied the successful
completion of a bitter struggle for the gov
ernment's cxisteuce and the conquest of
peace after prolonged and horrid war.
It is well for trade and business te some
times step their manifold activities
and contemplate the transiterincss of
earthly things. It is wholesome for fifty
millions of people te be inspired at seasons
by a common sentiment. It is patriotic
for the representative men of all sections
and parties te gather by the bier of ene
who, dead, represents unity and recencilia
tien, Uuii'hty power of n free people, the
le-
public.

these tribunals differ sometimes, and the

The case hinged en the question of
whether the petitioner's great-grandfather,
Cel.IMcb.ard Maltland.und Mary M'Adarn,
the mother of his son, had been lawfully
married In New Yerk in 1772. It was
admitted that their son, the grandfather
of the claimant, was born before this mar
riage, but the law then as new seems te
have been that the subsequent marriage
legitimatized the issue. The counter
claimant's case was that the law of that
day required publication of the banns, that
no such publication had been matle in this
case, and that therefore the marriage was
invalid and the descent therefrem could
net inherit.
Minister Phelps was called te testify as
te whether the " Duke's laws" or 1002 and
1CS1, in which the requirement of banns
had its origin, herein ferce in New Yerk
in 1772, and he gave as his opinion that
they had had no ferce sinee 1091. At the
same time he testified that it had been held
by the highest court in America that it was
net necessary that banns should be pub
lished, or a license obtained te constitute a
valid marriage In New Yerk ; there had
been no alteration in the law of marriage
in New Yerk between 1772 and the pres
ent tlme.
Upen the continuing ferce of the
" Duke'a laws" in 1772, Senater Edmunds
squarely joined issue with Minister Phelps ;
but upon this point, though there was an
intimation by Lord Selberne against Mr.
Phelps' position, there was no direct de
cisien. The whele case was decided for the
taimant en a technical rule of evidence as
i burden of proof. The counter-claimant
did net preve that banns or license had net
been published or obtained, nor did the
claimant preve that they liad been. All the
oyidence showed that a clergyman sol
emnized a marriage according te the forms
prescribed by the Anglican prayer book,
and that, shortly afterward, the husband
diet!. Whereupon the IIouse of Lords took
the charitable view, in the absence of any
proof te tlie contrary, that It was te be
presumed what should have been dene was
dene, and the validity of the marriage was
sustained. After this question had been
disposed of, the next was whether or net
" the marriage made legitimate the sons al
ready bem; that was promptly decided In
tlie affirmative.
The case is ene of large interest, net
only because of the eminent witnesses
called and the high authority of the testl testl
ueny given, and for the exhaustive in
quirlea into tlie colonial laws of New Yeik,
.Dutch and English, that have been made
leth in Londen and New Yerk ; but be

beenafllnued the disposition of the courts

legitimatize the issue thereof, wherever

But ns Mr. Keach, after receiving the
bounty of the government le the extent
of mere than ten millions of del
lars, has thought proper te make an
assignment, which many well-informed
persons beliove te be bogus, it is the part
of geed pel Icy for the government te take
what it can gel . If Mr. Reach's definitive
gratitude had included favors received as
well as favors expected, Ihere would have
been no difficulty in making an arrange
ment by which neither he nor the govern
ment would have suffered.
But Mr. Reach and his attorney, William
12. Chandler, had u point te make against
the changed methods of the navy depart
ment, and an assignment was considered a
geed way of making it. Even if the gov
ernment docs net get the worth of its
money out of the new cruisers, if will be
no new thing. It has seldom dene this
when dealing with Mr. Iteach duriug the
past twenty years. It will, however, get
rid of the contractor himself for geed and
all. Andthiswillbemucli. Whether it shall
build the vessels of the future in its own
yards or let them out te ether contractors,
it may be able te get a pretty geed propor

Secretary Eudicelt has been rather slew
in getting down te effective weik, but his
first positive and far-reaching order will
bring consternation te tlie army favorites
who have long been luxuriating in fat and
pleasant places. The new army regulation
which tlie secietary has promulgated pro
vides lliatan officer must serve atlcastthree
years with his company Ixsfore he can be
detached for staff or ether scrvice, and
that no officer shall remain detached for n
longer time than four years, unless as
signed te duty at the war department.
This ought te break up the worst abuses
which can find lodgment in the army in
limes of peace. Scrvice with Ills company
en the frontier is net exactly a life of
pleasure. It is remote from cultivated
society, with few of the advantages which
life in Washington or the larger cities
afford. But it is positively all we have for
our soldiers te de. It is in this work that
all military training is secured. If by
favoritism or any ether cause or excuse the
officer misses this wliile he Ls still a young
man, he is practically without use te tlie
government which has home the expense
of his education. If Secretary Eudicelt
can send out t'.e idlers and the drones he
