sylvan ia railroad parties has uncovered the
fact that this enterprise is burthenetl with
a mortgage debt of $20,000,000 and a capi
tal stock of $20,000,000, wlille the estimated
cost of construction is but $15,000,000.
The method of getting this amount of
water into the concern, notwithstanding
the requirements of the Pennsylvania laws
forbid stock or bends te be issued
except for money paid or labor dene or
materials furnished, was the usual ene of
interpolating a construction company.
One was chartered under the New Jersey
laws with a capital of $100,000 of which
2,000 was paid in by three empleyes of
Mr. Vanderbilt, who theieby became the
American construction company. This
company then agreed with the Seuth Penn
sylvania railroad company te build Its
read for the amount of its stock and bends
$40,000,000. It next agreed with Vnnder Vnnder
bilt,liagaley and the ether prometcrsof the
SeutlrPennsylvania railroad, te sell them
these $40,000,000 of bends and stocks for
15,000,000 ; and the job was thought te be
neatly done of getting $40,000,000 of capi
tal upon a railroad that would cost less
than $15,000,000, the laws te the contrary
notwithstanding. Manifestly, however,
tliis method of whipping the devil around
the stump will net de, when it is exposed,
provided the ntterney general of PeniisvJ:

Everyone in Pennsylvania is friendly te
the Seuth Pennsylvania railroad and te
every ether new railroad enterprise, but no
ene in Pennsylvania will think it right
that the wholesome law shall be
violated which seeks te limit the bends
and stock of a railroad te its
real cost. "When it is plainly disclosed
that this railroad is doing tliis, it is needful
, that it should be halted It must reduce
its bends nnd stock te $15,000,000 lefere it
can be permitted te operate its read. It is
well that it should understand tliis be
fore it has put its securities en
the market. If they arc an illegal
Issue, as they would seem te be te the ex
tent of ever sixty per cent., the company
would run great risk in marketing them.
It does net help it te knew that every new
railroad company nowadays does the bame
thing. Pennsylvania railrcads can no
longer de it. Its laws forbid it.
An Important Sewerage Problem.
In his recent annual message te councils
Mayer llesenmiller reverted te the subject
of draining the northeastern section of the
city, which is one that has steadily come te
claim mere and mera the attention of prop
erty ewnem of that quarter, and of thought
ful citizens everywhere. The facts are, as
he states them, that " this section of the
city has grown wonderfully within the past
ten years and by reason of lying se low is
cut off from all connection with any of the
city sewers" ; the surface drainage thence
finds it way, at considerable distance te be
sure but eventually, into the Conestoga ;
and, with an increasing population, the
dangers te the purity of our water supply
must be largely Increased.
The mayor urges upon councils that tliis
question receive serious consideration, as
being paramount te almost any measure
which they will be called upon te consider.
But as yet it has net had such considera
tion, and it is doubtful if the public mind
has strieusly grappled with the important
considerations Involved in the proposed Im
provement. Fer it is common te assume
that the construction of sewers leading te
the water levels above Itanck's mill, in
volves the removal of the city water works
te a point above that at which the sewerage
would empty into the Conestoga. We may
well pause at the enormous expense of buy
ing land for a new site, erecting new
engine, boiler, engineer's and firemen's
houses, laying miles of 24 or 30-inch mains,
rebuilding the pumps, erecting temporary
works during the transfer, buying water
rights and ether expenses necessarily te be
iucurred in a removal of the water weiks
te n point further up the stream. In the
present condition of the city debt, such a
change would be impracticable and impos
sible. If the drainage of the northeast
quarter Is dependent upon the removal of
the water works, it Is a hopeless case for a
long time te come.
But, as Mayer MacGonigle pointed out
in his message of 1SS3, in discussing tliis
same question, there is a far cheaper and
quite as practicable a way te drain this
part of the city, without removal of the
water works ; it has ether advantages, tee.
This Is " te build nn Intercepting fewer
from near the point nt which the sewerage
of the northeastern section of the city
must enter the Conestoga, run it along the
west bank of the stream te some point be
low the present water works. This Is the
plan recently adopted by the city of Phila
delphia te get lid of all the vitiating mat
ter which enters the Schuylkill river en the
east side from Mnnayunk te below the

Common Sense In Oleomargarine.
Prem the very outset of the discussion
the Intf.llieknchr has opposed the re
cently enacted anti-oleomargarine law as a
bit of unjust, unconstitutional and absurd
legislation; and we have predicted that
any intelligent and just court called upon
te review it would condemn it.
The court of appeals of Xew Yerk has
Justified these expectations; and it has de
clared unconstitutional the New Yerk law
upon which the Pennsylvania statute was
modeled. There is a like fate, no doubt,
in store for the creature of our legislature.
It i3 refreshing te ben this wholesome
check by the judiciary upon offensive legis
lation. It is also rcficshlng te see the Phil
adelphia Times, which se hcnitily appieved
the law a month age, new se emphatically
condemn it, and give such excellent reasons
why it should net have been pasted, and
why, having been passed, it should be nul
lified by the courts.
The Pittsburg iien nianufacluiers have

made out and persisted in, by this applicant

In this case depositions, were taken by
both sides, and read te the court, but It did
net appear lu any of tlie testimony that the
applicant had ever sold liquor en Sunday or
in miners, or te persons niioxicaieu, or nau
violated the law lu any of these particulars,
nnd that fact should go far te condeno some
miner eUunces against the law.
The proofs ap;eariiig In the depositions
read did show that tliis applicant had do
llied te persons en nt least two dlllerent oc
casions, no mere, meals and entertainment
when asked ler by travelers, and when
wanted, tee, nt net unreasonable hours.
Onu of these occasions at least, was a lla
grant disregard of the duties imposed en pub
lic: housekeepers, under the license granted
by me court.
Tlie applicants for entertainment in this
Instance had traveled twenty-llve miles in a
nrivate conveyance, v ithetit anything te cat
olnce early dinner, and arrhed at this hotel

the evening. Net an unreasonable hour, we

dated for the night ; the reply was In the

warm supper. He replied that he could net
get up a warm supper at that late hour of the

prise, nnd tlien requested te lie accommo
dated w itli a cold check, and said that would
be satisfactory. This request was as promptly
refused, and lieing extremely hungry, they
resorted te a store hi the vitlage, and there
with crackers nnd cheose and celli water,
that wero kindly furnished te them, they
abated the hunger se far as was at all s.ife en
the diet mentioned. They returned te tlie
hotel nnd wero furnished with geed beds anil
a promlse of breakfast, nt a certaln hour,
which was entirely tee early ter the conven
ience of his guests, and they accordingly
adopted a later hour for rising, supposing
that the rules of tlie heuse would hardly do de
pri ve them of breakfast, ifappliud for lu tlie
morning at S o'clek. In this the guests were
fortunately net disappointed for a little eiler
tlie hour mentioned, they were provided
witli n most excellent and bountiful break
last. Had tliis proprietor regarded his privileges
properly, and tlie evening previous read
the court llconse hanging en the wall, he
would have seen that It was expressly there
printed, that "a llconse te keep u hotel, Inn
"or tavern ought te be granted te liiin te no ne no

"strangers and travelers."
New there was certalnly no excuse for
such dorclictien of duty such apparently
wilful Indlll'eroiice te the wants and necessi
ties of theso strangers, for whose entertain
ment he had asked for and obtained a spe
cial grant from the court. A refusal te en
tertain travelers under tlie circumstances
mentioned, whether it resulted from ignor igner ignor
unee of tlie laws or otherwlse, had it been
shown te have been of frequent occurrence.

What is the duty of the court in the
premises?
The net of 1S75, the last law enacted regu
lating the crauting of licenses, says " tlie
court shall tlx by rule or standing order a
tlme at which application for licenses shall be
heard, and nt wliicli time all persons apply
ing or making objections te license, may be
heard by evidence, petition, renionstrance or
counsel," and under the proper discretion,
It is understood the court may grant the
llconse or refuse tlie same, whenever In the
opinion of the court the same is net neces-.
sary for tlie accommodation of the publle and
entertainment of strangers and travelers;
and also upon sulllclent cause being shown,
the court may roveko any liceiise granted by
thorn.
Our supreme court have held that It Is the
duty el the court granting license te bear and
detormine each case en its ovldenco and facta
te ascertain the lltness of tlie applicant, the
necessity of his heuse for the accommo
dation as a hetel, or as un eating-house, and
te soe that the applicant has fully complied
with the law before his llcense can be
granted.
This Is a large discretion, and It Is te be
exercised primarily for the public geed and
secondarily for the prlvate interest, say the
supreme court. It Is an error te suppose that
tlie sole duty of the court Is couilned te the
Inquiry whether the applicant Is a cltizen of
the United States and la a man of geed
moral character and temperate haDlts."
Tliis large discretion, however, Is no war
rant for the oxerciso or arbitrary power.
The law of the state,says the supreme court,
has determined that licenses shall exist, ami
has left it te the courts te ascertain the
proper instances In which the llcense shall be
grauted, and thorefero has given It te the
court te doclde upon each case as it arises In
due ceurse of law.
The act of deciding is Judicial, nnd net ar
bitrary, or willful. Tlie discretion vested In
the court Is thorefero a sound judicial discre
tion, nnd te he a rightful Judgment It must
be exercised In the particular case nnd UKn
the fuels and circumstances bofero the court
alter they have been heard and duly consid
ered. Thus It will be scen that the court has a
