A Withheld Judgment.
The supreme court of Pennsylvania has
adjourned for the summer without final de
termination of the question as te the judi-.
cial district of Butler and Lawience coun
ties. It will be remembered that Butler
was made the constitutionally " separate "
district by the judicial apportionment of
1883, with Lawrcnce "attached," and
te the district thus formed were al
lotted two judges. In the elections
that followed this apportionment Greer,
Rep., and Bredin, Dem., had a plurality of
the,vetes in Butler, but were beaten in the
'consolidated vote of the whole district by
Ilazen, Hep., and McMichnul, Dem., el'
Lawrence, who get the ceitificates of
election ; and their title was confirmed by
Ihe Judgment of the lower tribunal which
was summoned te hear the cubc. They are
acting judges of the dibtrict, and the
singular result is presented of Lawrence,
the " attached" county, supplying two law
and two lay judges for the district, while
Butler, the " beparate " district, author
ized by the constitution and created by the
statute, furnishes none.
Messrs. Greer and Bredin appealed their
cases te the supreme court, maintaining
that as Butler was the ' district," its vote
and its vote alone should elect the judges;
en the ether side it was argued that the
judges of a district should be elected by the
voice of all its voters. The supreme court,
it Is understood, was evenly balanced in its
view of the case ; Judge Green, being ab
sent and net having Ireard the argument,
tog en the Judgment. Se the mat-

a majority judgment and net unanimous

liberty ought te be clear and unquestioned.
The decision of disputed judicial elections
eughl te be prompt. It must boas uncom
fortable te the sitting judges as it is unjust
te the contestants te have their case thus
hung up, at llie convenience of the su su su
premoceurt judges. Surely the issue is one
of such supreme importance that it ought
te have gene te the top of the list, and have
had the benefit of a re-hearing l)efere a full
bench.
It Is only justice te Judge Bredin te say
that some comments in these columns upon
this famous controversy were liable te the
misconstruction that he and ether Butler
countyDcmecratswero partly responsible for
the atrocious apportionment which yoked
them with Lawrence and w liich has led te
all this trouble. The contrary is the fact.
It was the Eepublican politicians of But
ler, especially Greer, who had the district
thus formed, in order te secure the beuefit
of Lawrence county's big Republican vote.
In his defeat Greer will get no Democratic
sympathy ; but even he is entitled te a
hearing and decision of his claim ; while
Judge Bredin, whose case lias been pre
sented te the supreme court with great
cogency and completeness, has, from every
point of view, just reason te complain that
he is deprived of the benefit of a judgment
which, if even adverse, could net de mere
than keep him out of a scat from which he
is new excluded.
Ne Extra Session .Probable
The failure of the apportionment bill
raises the question as te whether the legis
lature will again be called in extra session
by the governor te perform the duty which
the constitution makes mandatory upon it.
The governor lias net intimated his pur pur pur
pose in the matter, nnd is said te be di
versely advised upon it by his Democratic
counsellers. It is supposed that the reasons
which induced him te call the last extra
session te consider appoitlenment, prevail
with like strength new. But this is hard
ly se. The result of that extra session was
net satisfactory. It demonstrated that the
Republican members would net be in
duced te a fair apportionment by any
amount of consideration of the question.
The same lessen hiis been taught at this
session. The Republican majority is
clearly resolved te apportion the districts
in the state unfairly in its interest. AVilli
this demonstration there is no inducement
te the governor te call an extra session en
this matter.
Xer is tliere much better reason te ex
pect that the legislature would, in an extra
session, legislate as the peeple want it
te de upon the sub'ject of freight dis
crimination. This subject has been treated
at this session in 8uchn way as te wholly
discourage any hope than at an extra ses
sion the same men would lxs inclined te
any adequate legislation ; no law would iw
passed that would net be a delusion. The
question must go ln-ferc Ihe ieople and is
in geed condition te meet them. The leg
islature that is next elected will lxs very
sure te have a sharper appreciation of its
duty in this regard, and te it falieuld the
question be relegated. AVe see no useful
end that can be served by an extra session,
just new atleast, ami we have no idea that
ene will be called.
Why
Entering West Point.
The beard of visitors at West Point is
looking into the matter of the examination
of cadets for entrance te the institution.
At present the, requirements are very
strict in regard te thoroughness of knowl
edge in the elementary branches of educa
tion. Great stress is laid upon proficiency
in the three It's. The applicant must write
well, spell well, read well and be well
posted in geography and history. The idea
is te have a thorough greuud work for the
"West Point educatieu.
And the idea, like most ideas, i3 a great
deal better thau the practice. The first
and very objectionable consequence
is that the sons of rich parents and
of theso resident In the states near
the academy, ceme better prepared for
the peculiar examination than these from
afar off nnd theso with less cash. The ne
cessity for West Point entrance is that the
appointee shall be particularly prepared at
schools established near West Point for
the purpose, or by a tutor who is acquaint
ed with the requirements. The young men
are from seventeen te twenty-two years
old ; at tliis age they have long since passed
through their elementary history, grammar,
geography and signing book, and are net
fresh in the rules which they must have at
their tongue's end te get Inte West Point.
The censequence annually is the failure of
many intelligent young men te pass these
examinations; and they are generally from
distant part of the country .where the West
Point standard is net known, or where
they cannot ceme te the Hudsen liver in
stitute, te be especially prepared for en
trance. Tills objection should sulllce te condemn
the system ; which Is ceudemued with
equal force, however, by the fact that it
gives te the West Point authorities uudue
power te nnnul the nomination of a cou ceu
