of Middle street, charged with committing an
assault and battery en a boy named Charles

boy, residlng with his parents en
Charlette street, appoared at Dr. McCer
mick's oIUce te liave a gun-shot wound in his
left hand dressed. He was accouipanled by
anether boy, who told tlie doctor that he and
Shilling wero playing en Grant street, when
a mancame along and shot Shilling through
the hand. Tlie doctor oxamined the wound
nnd found that a pistol ball had penetrated
the palm ofthe hand near the foreilngerniid
passed out at the back of it near the llttle
linger. The llesh was burned with pow
der, showing that tlie weapon had been
held close te tlie hand when dis
charged. Dr. McCermlck bolieving the shot
te have been an accidental ene, cross-qucs--tiened

Jeseph Lamer was the defendant tills
