at length, and the court this morning refused

The first case attached for trial en Monday
aftornoen in the lower court room was that
of U. Wilmer Moero vs. Themas Towson,
appeal by defundant Irem the judgment of
Justlce Jehn C. Lewls. The inirtles te this
suit reside in Fulton township, and there ure
a large number of wltneases in attendance.
The facts as dovclencd bv the plalntllls
witnesses are as follews: On the 'Z!d or
March, 1SS3, Towson had a public aile and
among the block disposed 01 was a nuire.
She was guaranteed te Ik) sound and It was
&iid would work anywhore except in the
lead. Moero paid 5100.50 for the maie and
took her home. On the next clay he hitched
her te n vehicle and she balked, plunged ami
kicked. A few days afterward he again
hltclieil her te n vohtcle. She again
kicked and he could de nothing
with her. He then went te Towson and
asked him te take the mare back, as she was
net as rcprcsonted. Towson declined te de
se, but agreed te buy her back for (2H.
Moero declined that preposition, and notified
Towson that he would advortise the mare,
soil her nnd held him for the balance. He
did soil the mare, after ndvertislng her, and
received for her $110. He then brought this
suit te recever fhO.SO, the dlfforenco between
what he paid and rccel ved for the mare.
The de fen se was that the mare as net
guaranteed, and that she was sound und
gentle when sold. On trial.
