testimony of the prosecutor was that the m

Daniel Tammany, jr., washidlited ler as
saultaud battery. Thu testimony et Hailread
Olllcer Hey, the piosecuter, was that en the
evening of January ;tl, Tammany approached
him at thu Pennsylvania railroad station,
and without any piovecatiou, struck him a
severe blew in the lace, knocking him down.
Several (Mirsens who saw the assault were
positive in their identity of Tammany as the
assailant.
The dolense was that Tammany was
iiotiilthe Pennsylvania railroad station en
tlie evening of January :tl, that he did net

was assaulted Tammany was in Callagliers
barbel shop, and when the crowd ran up
North Queen street, he walked out of ihe

Henry D. Smith, colored, was put en trial
for committing an assault and battery en Jehn
II. Piosberry en March SI. The ollenso, It is
alleged, was committed at the restaurant of
Kltch & Stiiplererd, and occurred through
Prcsberry telling Kltch about the number or
games of cards Smith and a jiarty hid played
in ene et the rooms.
The defense was that Prcsbeny was the
airercsser and that Smith only struck the
prosecutor alter he believed he was going te
lie attacked with a nurer. Tlie jury tendered
a verdict et net guilty ami divided the costs
equally between the prosecutor and the
defendant.
Lorenzo Floyd w as charged w 1th sin assault
and battery en flcrtrude Shay. Tlie assault
was committed en the U8th et March in tlie
