Dead Charters.
We liave n, renert from New Yerk that
the Pittsburg iteeple who organized u
fuel gas company anil ran against u deci deci
clslen of the supreme court of l'ciinsylvii
nia, that its laws did net aullinrize the
incorporation of natural gas companies,
have undertaken te get out of their ililll
cultyhy organizing under the cluutcref
the American transfer company. This was
one of the omnibus charters which wcre
abundantly passed in this btale a score of
years age, and which authorized the in in in
corperators te de anything and cvery-
thing that anyoue could itessibly wisli te
de. They wcre made for sale and have-had
a high commercial value. This American
transfer charter has leen used in the busi
ness of piping oil, but the company was
long slnce absorbed by the bland
ard oil company, and its charter was
transferred te the National transit
company, which undei took te keep it alive.
Although it had no use for it, having all
the chartered nrivileces it needed. Its con
cessions, however, were tee valuable te be
lest, if they could be saved ; and the ques
tion for Mr. Hosteller and the ether gen
tlemen who have invested in the charter is
as te whether it is a ical live and kicking
parchment. "We presume that they rntis
iied themselves that It is all right or they
would net have lraughl it ; but the opinion
or their lawyers has deceived thcuionce and
possibly tl.ey may come te gtief again ; for
it does notseem te be altogether clear that
a charter granted te ene company and used
v It for certain purposes can Iw tranMcd
at will te another company tq be used for
their nurneses. The courts may deiij this
convenient locomotive (tower te a charter,
and may consider its virtues te Ik- net only
exhausted by long nen-nscr but also te be
limited te the company llrst feimcd and te
the uses te which it has applied its privi

state that a charter should bokeptalive
after the company which it erected is prac
tically dead ; audit is net te be supposed
that the supreme court will care te held a
chatter te be the immortal part of a mor
tal company, as the soul is the immortal
paitef a mortal body. "When a man dies
bis soul departs. "When a company is dis dis
selved itschartercannetstay. This probably
will net be denied, but it will be maintained
that the company is still alive, though it
docs no business. "Whether it is living or
dead will be the question for decision, and
it would seem te be advisable for the holders
of its charter te be able te show decided
activity in their corporation te persuade the
court, sitting as a coroner's juiy, that It is
net viewing a corp"-
Appointments and Itenieiiils.
There is n wide-spread popular misap
prehension that civil service reform, or
what passes for that, as a system of ap
pointments provided by the civil service
lawandadministeiedby the commission
ers, consists mainly in keeping in efllcc
by letaining r leapiwinting them these
who happen te be in olllce. Such is net
the case. There is no such prevision in the
civil setvice law framed by Mr. Pendleton
and administered by Mr. Eaten's commis
sion. It was purposely emitted, boas te
leave the power of removal as free te the
executive as ever it was. And a very val
uable and necessary power it is.
"When it comes te making new appoint
ments, of that particular grade which is
comprehended under the civil service law,
and which does net include the lower class
of laborers and empleyes, nor the heads and
chiefs of departments, it is understood that
the president will observe the law, and
cause it te be observed. Under that law
he appoints a commission, consisting of two
Democrats and ene Itepublican, who in
turn appoint ether examining Iwards who
investigate all applicants and lepert upon
their fitness ; and whenever a place is va.
cant they can recommend four icrsens for
it, from which the appointing power in the
exercise of its discretion selects ene for the
position.
Tills is the whole hcetw and effect of the
law, and it does net apply te any elllces or
departments wheiein there aie less than
fifty appointees.
It will readily be Men that this makes no
prevision whatever for the retention of
present officials ; and in every case wliere
they have been appointed for an indefinite
term, the very proper question te 1k asked
concerning them is whether or net they
would be new' appointed If their olllce was
vacant. Their eccuimncy of it gives them
no lieu en it; nor does their honest and
capable discharge of itsdutics. If they are
belter qualified than anybody else, that is
sonie consideration. Hut the t acUhat tliey
have been appointed hitherto by a Republi
can administration, in ninety-nine cums
out of a hundred for partisan reasons,
establishes no claim en their init

pointed no Democrat's met it was consider
ed for a moment. The assumption of such
appointees that they have a divine right te
the offices is nsempty as it is Impudent.
Tims it happens that the administration
finds a Republican in the New Yerk post pest post
efllce, who was appointed because he had
been the son-in-law of a previous ltepubli
tun. It seems that he has miule a fair
postmaster, barring some complaints of ir
tisau misuses. Hut his. term Is finished.

fied fertile place, he will probably get it ;

The enlay against Higgins is ery cum

suspicion. The fact that the dubiousness
of his character has made him an object of
national inlei est, shows what a lelly ped
estal this administration standi upon in
public estimation.
