the purpose of examining all persons who
desire te enter upon the practice of modi medi modi
eino in Pennsylvania.
If tbe objcet In creating this beard is te
combine in the spirit of conciliation for
the honorable purpose of elevating their
professional standard, and of giving im
proved obaraetor te the medleal profession
and stability te modleal oel loges, with
unity of purpose and action in that direc
tion, then their metlvs is geed. Ont the
plau proposed for its accomplishment
cannot be regarded with favor by any
unprejudiced mind. This proposed law
provides that tbe examining beard shall
consist of nine persons, seven of which
number are te be taken from the allo alle allo
patbie, and two from the homeaapathio
school.
In legislating upon a subjoet of se much
importance te the medical profession, tbe
publics geed should be consulted. But we
doubt whether the publie geed would be
scoured by an cnaetment whieh would
bind the physieians of tbe dissenting
schools hand aud feet, and oenslgn them
te the tender mercies of their allopathic
step-brethren,
Publio geed would be assured by an
cnaetment whieh would seoure the high
est standard of attainments te tbe
different medleal uolleges, and yet which
would net give te any one soheol the
power of erushinc the ether en account of
its being numerically weaker, or of net
being in the regular line of succession.
Unless we are prepared te take the
narrow and arbitrary grounds of deelaring
te the people that they shall be doetored
aoeordlng te the theery of ene aoheo, we
shall net venture by elass legislation te
put all ether soheols at the morey of theso
who excel in numerical strength only.
We are net ready te de that, and the peo
ple de net favor it. The tendeney of the
nineteenth ecntury Is toward mental in
dependence, personal right, and constitu
tional liberty.
The time was when only ene Bystem was
legally sanctioned ; new ethers enjoy
legalized rights duly constituted under the
authority of the law, and who new
desir no monopoly, seek no protective
statutes but demand an open field and fair
play. Education will de much toward
elevating and ennobling tbe medical pre
feselen, but prescription and class legisla
tion will net de much in the work of pre
venting quackery.
While all admit that a thorough knewl
edge of anatomy, physiology, pathology,
botany, toxicology, surgery, ehemlstry,
hygiene, &e., are prerequisites, India India
pensible, ptill acknowledge of materia
medica and the material agents employed
In the treatment of disease and the
bearing of the law upon which they are te

Anether reason stated in this bill for the
necessity of its craatien is that there are
tee many physieians for the needs of
olesoly settled districts. Se by limiting
the number of physieians there would be
a better ohanee for obtaining a livelihood,
and charging the dear peeple what they
please, thus ignoring the generally con
ceded fact that competition is ene of the
great incentives te perfection In any call,
ing. In doing this they tacitly concede
their inability te oempeto en their own
merits for publie patrenage, standing
alone, as tbey de, in asking for legislative
statutes whieh discriminate In their favor
exclusively. In opposing this bill we
would net be understood as upholding
quackery or disparaging erudition, and no
one would take exceptions te sueh laws as
will proteet Its citizens against mistakes
of incompetent practitioners, or sueh as
would punish physieians and surgeons for
malpraotlee. But we are contending for
principle, for that hsritage of inalienable
right bequeathed te us by our sires of '70.
II, Yeas ley.
Our osteomed urvi:pendent misappre
hends tbe position of this journal with
regard te sueh legislation. While it is en
tirely trup,as held by tbe Intelligencer,
that " any precautions that bave for their
objeot the protection of the publie from
incompetent praolitieners must be hailed
with joy," it is net se plain that tbe legis
lation favored by the local medical society
will accomplish any sueh result. In faet,
It will be found that legislation will net
make geed doctors any mero than it will
furnish geed preaehers, geed lawyers,
geed dentists or suppress quaeks in any
of these professions. There are men who
have the healing art in all the soheols, and
pretendeis and imposters and bunglers
and butohers masquerade under eaeh of
their several names. The colleges turn
out praotitienors of very uneveu merit,
and with widely varying knowledge of
medioine and oenoeptions of professional
honor and etiquette. We find about as
mueh jealousy, distrust and animadversion
of oaeh ether among the adherents of the
same school as exist between dlsolples of
different faiths in modlelnos.
It is hard te see hew a beard te be ap
pointed by the governor, and te inolude
representatives from the two leading
soheols would remedy this. It would be
an extraordinary power te oenfer upon
nlne men the right te dotermlno who
should praetice medicine in Pennsylvania ;
and what assuranoe Is there that, as our
correspondent suggests, the allopathle
majority would net ignore and outvote the
homccepathlo minority; orbethcombico
te crush out the aspiring women doetors ;
or that the Jeffersen and University
soheols would net engage in unseemly
atrife te oentrol the beard and eaeh te get
the advantage for its graduates ?
Or, if the doctors are te be examined,
Yiby net bave tbis beard analyze the vast
quantities of patent medioine nostrums
whieh are sold and with whieh se many
people profess te heal themselves ? And
what about the magnetizurs and pow pew pow
wewers in whose works se many bave
sueh Implicit faith? The logie of sueh
legislation as is proposed would be the
creation of an authority with sueh extraor
dinary powers as te be an anomaly under
our system of government. The truth is
that the whole preposition is luipraotloa luipraetloa luipraotlea
pls and absurd, and of ft put with a great
deal of omplrieal legislation that thought,
lets lawmakers have eumbered the statute
boezs with of late years te no real
publie advantage.
A spoelmen of this ts the medical regis,
tratien aet of 1891, the enforcement of
which in this locality, alter being unsuc
cessfully attempted In tbe interest of
professional blackmailing, operated only
te give some se-called "quaeks" a certi
ficate and quasi standing that tbey never
had before. The only oase of oenvlotion
under It that has reeently oeme te our
noties is ene that seems te invelve a
pceullar hardship and Illustrates hew
oppressive and Iniquitous sueh a law may
be made. In Columbia county, ene
Jeseph L. Bauer, graduate of a St.
Leuis college, has been oenvloted
and Is new awaiting sontenoa for practic
ing medioine oentrary te this act.
It seems that the law requires the
holder of a diploma issued by a col cel col
lego In another state te lay " the same
bofero the faculty of one of the medleal
colleges or universities of this common-
wealth for Inspection ; and the faeulty,
being satisfied as te the qualifications of
the applicant and the genuineness of the
diploma, shall dlroet the dean of the
faeulty te enderse the same, after whieh
sueh person shall be allowed te register
as required by seotien two of this aet."
In Bauer's case he appears te have made
an effort te comply with this regulation;
he applled te the University of Pennsylva
nia at Philadelphia. Dr. Tyson, aetlng
secretary of the faeulty, talked with Dr
Bauer, loekod at his diploma, and gave
tiltn a certificate, printed In blank and
fllled in by the secretary, with the
name, nativity, residence, medical degree
with date and name of institution confer
ring it, plaees of continuous praotieo and
addressed It te the prothenotary of
Columbia oeunty, adding, " I have ex
amlned the diploma, bolleve it genuine,
and that the bearer is the person te whom
it was issued."
Thereupon the Columbia county pro pre pro
thenotvy registered him, but the registry
wast stricken off by the court, en motion
en the ground that the regulations of the
aat were net strietly cemplied with, in
that the university Bcoretary had issued a
certificate te Bauer and had net " on en on
dersod " the diploma. The registration
being thus tcohnieally doelared void, Dr.
Bauer became liable te punishment for
practicing medioine for gain without hav
ing registered, and was prosecuted, tried
and convicted, and new awaits sentence.
The penalty prescribed in the aet is a fine
of ene hundred dollars and imprisonment
in the oeunty jail for a term net exoeeding
ene year either or both, at the discretion
of the court.
Such a law as this without regard te the
merits of Bauer's oase ean very easily be
made an instrument of persecution and
tyranny by men'.and associations who are
