from tbe truth te buy that, while 1,800 or J
1,400 murders nre committed in this
country every year, fower than a bundrcd
of the murdenrs sull-sr tbe extreme pen
altyofthelaw. When the willful slayer
knows that be has 13 chances out of 11 of
escaping tbe full penalty of tbe law the
deterrent influence of punishment caunet
be said te be very pewerfu'.
What tbe law could uet de, or has uet

te explain the relation of these facts. Tbe
inefficiency of the machinery of justice has
led te the introduction of these barbarous
methods. The laws agaiiibt murder are
Btreng enough ; but when the people kuew
that net one in a dozen of the wilful tuur tuur tuur
dorers roceives the just ri'comjKjnse of bis
Uoeds, and that technicalities aud quibbles
are constantly allowed te shelter tbe worst
criminals, they themiielves becorae des
perate ; mid, breaking through the just
aud salutary restraints of law, they deal
vougeauce right aud left in a bloody and
turuuient lasmeu.
It cannot be tee often nor tee strongly
proclaimed that these lyuehiugs themselves
are crimes ; that they ate utterly without
orcufe ; that they turnlsh a -raedy which
is werse than the disease. vt'lien a score

ing their detestation of murder turn by
boeoming murderers themselves, our
civilization soems te have rodueed itse f
te an absurdity. Moreover, lynch law is
uet much tnore aoeurato in its measure
ment and dispensation of justice than the
lax administration against which it pro pre
tests. The mob is neither judicial nor
chivalrous ; the weak aud defenceless are
far mere likely te sufft rat its hands than
the strong aud prosperous, as is shown by
tbe fact that the vietiras of mere than half
the lynchinKB reported last year were
Southern negrees.
Nevortheloss, the fallure of criminal
justice, which makes room for mobs nnd
lynching, is a greater disgrace than tbe
mvagery of the mobs. The fact that
thirtoen out of fourteen murderers es'iapu
the gallows is the one damning faet that
blaokens tbe recerd of our criminal juris juris juris
piudonce. It is often nlleg.id that the failure of
juries te conviet murdorers is due te their
unwillingness te inlliet capital punishment :
and it is argued that if the extreme penal
ty wero imprisonment for life a much
smaller number would escape it is pos
sible that this roaseulng may explain some
cases of disagreement or acquittal, but the
real difficulty is much mere serious. It
arises; in part, from tbe exaggeration of
the rights of the individual as oempaicd
with these of society.
Out of this exaggerated estimate of the
criminal's rights have arisan these meth
ods of legal proeoduro which se disgrace
our criminal courts, under which crafty
lawyers are permittetl the use of all man
ner of ridiculous quibbles and technicali
ties for tbe sake of defeatiug the ends of
justice. The faet that the American bar is
distinguished for its fertility in the in
ventian of thone vicious expedicn't. by
wbieh trials are eudlcssly protracted, nnd
the proeewcB of the law are latally en
tangled, and the mluds of jurors are hope
lesaly confused, is a faet net greatly te
our credit, but it throws a Heed of light
