Tbe Contest Between William L. Scntt and
the fierce.
Mercer Dispatch te the I'm;.
The ceuteEt for tbc control of tbe
Sbarpville railroad between Wm. L. Scott
iu tbe iutcrest of the Pennsylvania com
pany and tbe piesent management uuder
contiel of tbe Pierces, of Sbaipsville, con
tinues unabated. Thin read, which con
nects tbe Oil City and Chicago railroad,
atWilniingteu Junction, and tbe New
Yerk, Philadelphia and Ohie and Erie
and Pittsburgh railroads, at Sbarpville.
Iim latpltf trrnwn in imnortaneo en ac
count of the coal fields along its
routes, which contribute largely in
freights te tbe competing through
lines, ana, also, as competing with the
Pennsylvania company in freights te and
from the furnaces and mills in tbe Shenan
go Valley. Scott, im behalf of the Penn
Hylvania company, underfoot te obtain
control ever tbe lead and purchased about
'A noe shares of the 7,000 hhaics of stock.
The Pierces, however, in order te protect
themselves, bought 400 .shares from the
Greenville bank, giving them a majority
of the stock, but as they had net bought
these shares hixty days before the elec
tion, tha Pieices were enjoined by the
court from voting the same. However,
Scott had a majority of the vetabla stock,
and voted a.39G votes for Scott as president
and six directeis. Ihe Pierce tactien
voted under tbe cumulative system 4 550
votes for four directeis, but the elcctieu
beard decided in favei of the Suett ticket.
Beth beards ui gauized, and tbe Pieice
faction applied for a quo warrante agaiiiht
tbe Scott director-, and the Scott meu ap
plied for an injunction against Walter
Pierce as superintendent, and tbe ethers
as directors from excicising control ever
the read. Beth the bill for injunction and
tbe quo warrante were argued befere
Judge McUermitt yesterday hy -liuige
Vincent and J. Ress Thompson Ter the
Pennsylvania company, ami J. II. M
Crecry and J. A. Stranahan for the Pieice
faction. The court has net : endured a
decision yet, but it is believed by the bar
generally that under the facts the in
junction will be dissolved. This will
leave the management and virtual cei -trel
or the boa:d iu tbe hands of
Walter Pieice, who has been mpeiiu
tendent, until the quo warrante te
decide who const itute-i the legal beard or
directors is finally settled iu tbe supieme
eeuit. This morning Walter Pierce filed
a suggestion for a quo warrante against
Scott acting as presnienr, alleging mat uv
is an officer or the Erie & Pittsburgh read,
a parallel and competing read, and be
cause a lartre number or the votes cast for
him had been transferred within sixty
days of the election. The court today
tiled a decree lcfusing te enjoin tbe
(irecnville national bank from selling tbe
100 shares of stock te Walter Pierce,
which was claimed by Scott as having been
bought by him en option. This gives tbe
Pierce faction the majority of tbe stock in
tbe read and at the next election they
will be able te control it.
